HomeMy WebLinkAboutORD 3408ORDINANCE NO.3408 BILL NO. 14 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 3, ARTICLE 21, SECTION 03-21-019 CALDWELL CITY CODE, PERTAINING TO THE APPOINTMENT OF THE CITY ENGINEER; AMENDING CHAPTER 39 ARTICLE 219 SECTION 03-21-039 CALDWELL CITY CODE, PERTAINING TO THE QUALIFICATIONS AND JOB REQUIREMENTS OF THE CITY ENGINEER; AMENDING CHAPTER 3, ARTICLE 21, SECTION 03-21-05, CALDWELL CITY CODE, PERTAINING TO THE POWERS AND DUTIES OF THE CITY ENGINEER; AMENDING CHAPTER 3 BY THE ADDITION OF A NEW ARTICLE, ARTICLE 22, SECTION 03-22-019 03-22-039 AND 03-22-05, CALDWELL CITY CODE, PERTAINING TO THE PUBLIC WORKS DIRECTOR FOR THE CITY OF CALDWELL; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES; RESOLUTIONS, ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1. That Chapter 3, Article 21, Section 03-21-01, of the Caldwell City Code, is hereby amended as follows: ARTICLE 21 03-21-01: APPOINTMENT: There is hereby created the office of City EngineerMu���. The City Enginee-, �Publir. Weriks Di shall be appointed as provided in Section 03-02-01 of this Chapter. The City Engineerm - i Ale' Di works under the broad policy guidance and direction of the Mayor. Section 2. That Chapter 3, Article 21, Section 03-21-03, of the Caldwell City Code, is hereby amended as follows: 03-21-03: QUALIFICATIONS AND JOB REQUIREMENTS: (1) Required Skills, Knowledge and Abilities: A. Good administrative, supervisory, communication and problem -solving skills are required. B. Knowledge of: 1. Generally -accepted engineering and construction practices; 2. Accounting and budgeting practices; Ord. 3408 — Page 1 3. Equipment specifications and maintenance requirements; and 4. Construction and property surveying techniques. C. Knowledge of City Codes and Ordinances. D. Ability to deal with suppliers, contractors and the general public and administer large- scale public works contracts. (2) Acceptable Education and Experience: The City Engineers b ) -efksDifectef shall have a Bachelor of Science degree in engineering and at least six (6) years of managerial experience in municipal engineering publie works or related, field and experience in property and construction surveying or an equivalent combination in education and experience. (3) Necessary Special Requirements: The City Engineerm ��shall have and maintain a valid Idaho driver's license and shall be a licensed Civil Engineer with the State of Idaho. Section 3. That Chapter 3, Article 21, Section 03-21-05, of the Caldwell City Code, is hereby amended as follows: 03-21-05: POWERS AND DUTIES: (1) General Statement of Duties: The City Engineers 41 V; 'T TN is responsible for management of all of the publie ' and engineering functions of the City. (2) Supervision Exercised: He/she supervises a large number of departmental personnel either directly or through subordinate supervisors. (3) Illustrative Examples of Duties: A. Approves and gives general supervision of most of the City's construction projects. C. That Chapter 3 of the Caldwell City Code is amended by the addition of a new Article, Article 22, Section 03-22-01 through 03-22-05, as follows: 03-22-01: APPOINTMENT: There is hereby created the office of Public Works Director. The Public Works Director shall be appointed as provided in Section 03-02-01 of this Chapter. The Public Works Director works under the broad policy guidance and direction of the Mayor. 03-22-03: QUALIFICATIONS AND JOB REQUIREMENTS: (1) Required Skills, Knowledge and Abilities: A. Reviews subdivisions and proposed public facilities and services as needed. E. Supervises preparation and approval of Public Works Department equipment specifications. F. Coordinates the work of consultants when hired by the City to prepare specialty reports or design specifications. G. Assists in developing capital improvement schedules for all departments of the City. H. Serves as member of Grievance Review Board. I. Grants applications for vehicle and public facility bids. J. Prepares long-term facility improvement plans for Public Works Department. K. Serves as chair of the Caldwell Traffic Commission. Section 5. This ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law. Section 6. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Sections 1 through 3: Amends Chapter 3, Article 21, Sections 03-21-01, 03-21-03, and 03-21-05, by removing certain enumerated duties and responsibilities from the description of the responsibilities of the City Engineer, including, but not limited to, supervision of the public works department, assisting in developing capital improvement schedules, serving on the grievance review board, and preparing long term facility improvement plans for the public works department. Section 4: Amends Chapter 3, Caldwell City Code, by the addition of a new article, Article 22, section 03- 22-01, 03-22-03, and-3-22-05, which article sets forth the job description for the Caldwell Public Works Director, including, but not limited to, qualifications and specific job requirements, supervisory duties, and development of capital improvement plans. Sections 5 through 7: Provides that this ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law; provides for severability; repeals conflicting ordinances, resolutions, and orders. Ordinance No. 3409 provides an effective date, which shall be on the 291 day of March, 2022. Ordinance No. 3409 was passed by the Council and approved by the Mayor on the 21" day of March, 2022.
