AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING
CHAPTER 2, ARTICLE 19, SECTION 02-19-05, OF THE CALDWELL CITY CODE,
PERTAINING TO THE ORGANIZATION AND MEETINGS OF THE CALDWELL
TRAFFIC COMMISSION; AMENDING CHAPTER 2, ARTICLE 9, SECTION 02-09-05,
OF THE CALDWELL CITY CODE, PERTAINING TO THE ORGANIZATION AND
BYLAWS OF THE CALDWELL GOLF COURSE BOARD; AMENDING CHAPTER 2,
ARTICLE 25, SECTION 02-25-03, OF THE CALDWELL CITY CODE, PERTAINING TO
THE MEETINGS OF THE AUDIT COMMITTEE; AMENDING CHAPTER 2, ARTICLE
299 SECTION 02-29-03 OF THE CALDWELL CITY CODE, PERTAINING TO THE
MEETINGS OF THE SENIOR CITIZENS CENTER COMMITTEE; AMENDING
CHAPTER 2, ARTICLE 31, SECTION 02-31-07, PERTAINING TO THE MEETINGS OF
THE FRIENDS OF THE CALDWELL DEPOT; AMENDING CHAPTER 2, ARTICLE 32,
SECTION 02-32-05, OF THE CALDWELL CITY CODE, PERTAINING TO MEETINGS
AND RECORDS OF THE PATHWAYS AND BIKE ROUTES COMMITTEE;
AMENDING CHAPTER 2, ARTICLE 35, SECTION 02-35-01, OF THE CALDWELL
CITY CODE, PERTAINING TO THE YOUTH MASTER PLAN COMMITTEE;
PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF,
IN CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State
of Idaho:
Section 1. That Chapter 2, Article 19, Section 02-19-05, of the Caldwell City Code, is
hereby amended as follows:
02-19-05: ORGANIZATION:
The commission shall meet quarterly (4 times per year) meet''• ^* ^ ^ t time and leeafieH
eeiwenient to -n^mbe-s. Additional meetings may be called for by the Public Works Director, as
necessary. The public works director shall serve as, chair of the commission and the chief of police
shall serve as the vice chair of the commission. The chair shall preside at meetings of the
commission. The vice chair shall, in the absence of the chair, perform the duties of the chair. All
meetings of the commission shall be open to the public and follow the requirements of Idaho's
open meeting laws 1 . The commission shall keep minutes and other appropriate written records.
A simple majority of commission members present at any given meeting constitutes a quorum.
Section 2. That Chapter 2, Article 9, Section 02-09-05, of the Caldwell City Code, is
hereby amended as follows:

(1) In lieu of any previously adopted bylaws, and to the extent not addressed through other
provisions within this article, the following rules and regulations shall govern the basic business
of the Caldwell Golf Course Board:

^ ugtt,., and Oeta Additional meetings may be called by the Chairperson, City staff, or at the
request of the Mayor upon at least seven (7) days' written notice to the members of the board. The
Chairperson will prepare the agenda for each meeting. Complete minutes shall be kept by the
Secretary. Following each meeting, copies of the minutes shall be distributed by the Secretary to
each member of the board. A quorum shall consist of one-half (1/2) or more of the appointed
members of the board.
Section 3. That Chapter 2, Article 25, Section 02-25-03, of the Caldwell City Code, is
hereby amended as follows:
02-25-03: MEETINGS:
(1) Meeting Times: The Audit Committee is to meet at least two 2 tree (3) times per year
unless additional meeting(s) are necessary as determined by the Finance Director and as many
tinges as the Cemmiaee deems neeessar-y.
Section 4. That Chapter 2, Article 29, Section 02-29-03, of the Caldwell City Code, is
hereby amended as follows:
02-29-03: GENERAL PROVISIONS:
(4) Meetings: The commission shall meet holdatleast f3uf (4) regular- ti b year-, w held

on a quarterly basis (4 times per year), unless additional meeting(s) are necessary as determined
by the Chairperson, City Staff or at the request of the Mayor. A majority of the appointed members
of the commission shall be, necessary to constitute a quorum at any meeting. All meetings of the
commission shall be held in compliance with Idaho Code title 74, chapter 2 (Idaho Open Meetings
Law), and written minutes of all such meetings shall be kept in accordance with said law. All
records created by the commission 'or its members in the conduct of the commission's business
shall be considered "public records", and shall be subject to the requirements of Idaho Code title
74, chapter 1 (Idaho Public Records Act).
Section 5. That Chapter 2, Article 31 of the Caldwell City Code, is hereby amended
by the addition of a new section, section 02-31-07, as follows:

02-31-07: MEETINGS
The Friends of the Caldwell Depot shall meet quarterly (4 times per year) unless additional
meetings(s) are necessary as determined by the committee chair.
Section 6. That Chapter 2, Article 32, Section 02-32-05, of the Caldwell City Code, is
hereby amended as follows:
02-32-05: MEETINGS/RECORDS:
(3) Meetings: The committee shall meet quarterly (4 times per year) unless additional
meeting(s) are necessary as determined by the Planning & Zoning Director howe at least (4)

Section 7. That Chapter 2, Article 35, Section 02-35-01, of the Caldwell City Code, is
hereby amended as follows:
02-35-01: PURPOSE:
'The p ffpose of the youth master plan committee shall meet quarterly (4 times per year) (unless
additional meeting(s) are necessary as determined by the chair) be to:
Ll) prepare, formulate, revise and implement the Caldwell youth master plan, a plan intended to
make improvements in the lives of Caldwell's youth by increasing both the availability and
awareness of community based activities during out of school hours;
(2) to protect children from and prevent bullying and to provide safe places to gather for
educational purposes; to better educate youth, and their parents, on nutritional issues and to provide
better access to healthy food and active lifestyle opportunities;
M to encourage postsecondary educational pursuits and to teach skills necessary to prepare
youth to become productive members of the workforce;
f to encourage youth to participate in volunteer opportunities, to have an active voice in the
community and to learn about decision and policymaking; and,
to prepare the youth to succeed socially in the community and to learn to communicate and
resolve conflict in a respectful and constructive manner.
Section 8. This ordinance shall be in full force and effect from and after its passage,
approval, and publication, according to law.
Section 9. This ordinance is hereby declared to be severable. If any portion of this
ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall
continue in full force and effect and shall be read to carry out the purposes of the ordinance before
the declaration of partial invalidity.

Section 10. All ordinances, resolutions, orders and parts thereof in conflict herewith are
repealed.

Sections 1 through 7: Amends Sections 02-19-05, 02-09-05, 02-25-03, 02-29-03, 02-31-07, 02-32-05, and
02-35-01, Caldwell City Code, by reducing the number of meetings of the Traffic Commission, Golf Course
Board, Audit Committee, Senior Citizens Center Committee, Friends of the Caldwell Depot, Pathways and
Bike Routes Committee, and Youth Master Plan Committee.
Sections 8 through 10: Provides that this ordinance shall be in full force and effect from and after its
passage, approval, and publication, according to law; provides for severability; repeals conflicting
ordinances, resolutions, and orders.
Ordinance No. 3405 provides an effective date, which shall be on the 29' day of March, 2022. Ordinance
No. 3405 was passed by the Council and approved by the Mayor on the 21" day of March, 2022. The full

Mayor and City Council approved the foregoing summary on the 2151 day of March, 2022, for publication
on the 291 day of March, 2022, pursuant to Idaho Code § 50-90IA.
