BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No. 1451, approved Case No. ANN21-000004 (Soterra Annexation) at a public hearing held February 7, 2022. Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be annexed into the City of Caldwell as C-2 (Community Commercial) and R-1 (Low Density Residential): C-2 Zone: A parcel of land situate in a portion of the W'/: NE'/< of Section 4, Township 3 North, Range 3 West, Boise Meridian, Canyon County, Idaho being more particularly described as follows: COMMENCING at the N '/ corner of said Section 4; thence S89°40'41 "E, 536.37 feet on the north line of said Section 4 to the POINT OF BEGINNING; thence continuing S89°40'41 "E, 795.83 feet on said north line to the E 1/16 corner of said Section 4 (from which the NE corner of said Section 4 bears S89°41'05"E, 1332.08 feet); thence S00°15'19"W, 659.79 feet on the east line of said W '/: NE'/< to a point common with the northwesterly boundary corner of Cumberland Subdivision No.4, as same is shown in Book 46 of Plats at Page 36, Canyon County records; thence N89°44'41 "W, 1182.99 feet; thence S87°31'56"W, 32.92 feet to a point on the centerline of the Phyllis Canal; thence following said centerline the following seven (7) courses: N15°53'39"W, 45.22 feet; thence N16°13'44"W, 20.18 feet; thence NO2°45'03"E, 47.51 feet to a point of curvature; thence 186.77 feet on the arc of a curve to the right, having a radius of 211.26 feet, a central angle of 50039" 7", and whose long chord bears N28006'42"E, 180.75 feet; thence N53°24'14"E, 286.41 feet to a point of curvature; thence 217.00 feet on the arc of a curve to the left, having a radius of 300.69 feet, a central angle of 41 °20'55", and whose long chord bears N32°43'44"E, 212.32 feet; thence N12°03'19"E, 42.22 feet to the POINT OF BEGINNING. Contains 15.791 acres, more or less. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as C-2 (Community Commercial) and R-1 (Low Density Residential) Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman -like manner plainly and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the following officials of the County of Canyon, State of Idaho, to -wit: the Recorder, Auditor, Treasurer and Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code 63-215. The Ordinance includes a provision to amend the official maps of the City by designating the above -described property as C-2 (Community Commercial) and R-1 (Low Density Residential) and providing an effective date, which shall be when published in the Idaho Press Tribune on the date 15'" day of February, 2022. Ordinance No. 3334 was passed by the Council and approved by the Mayor on the data 7'" day of February, 2022.
