ORDINANCE NO. 3376
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY
OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE
REZONED TO THE _M-1_ (LIGHT INDUSTRIAL) ZONE; DETERMINING THAT SAID CHANGE IN
ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO;
DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID
PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission/Hearing Examiner and following the public notice and hearing procedures as required in
Section 10-03-03, Caldwell Municipal Code, approved Case No. ZON21-000002 (Eisenberg Rezone) at a
public hearing held, January 18, 2022.
Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said
following described property should be rezoned to M-1 (Light Industrial) zone:
A parcel of land situated in the N'/z NE'/< NW '/4 of Section 25, Township 4 North, Range 3 West, Boise
Meridian, City of Caldwell, Canyon County, Idaho, being more particularly described as follows:
COMMENCING at the N Y< Corner of said Section 25; thence S 89049'32" W, 1328.87 feet on the north
section line of said Section 25 to the W 1/16 N corner of said Section 25, from which the NW corner of said
Section 25 bears S 89049'32" W, 1328.76 feet; thence S 00'34'05" W, 70.01 feet to a point on the southerly
right-of-way line of US Hwy 20/26 AND the POINT OF BEGINNING; thence North 89049'32" E, 1258.71
feet on said southerly right-of-way line; thence S 36'31'00" E, 49.65 feet to a point of curvature on the
westerly right-of-way line of Smeed Parkway; thence on said westerly right-of-way line, 159.68 feet on the
arc of a curve to the left, having a radius of 2040.00 feet, a central angle of 04°29'05", and whose long
chord bears S 01'51'06" E, 159.64 feet; thence S 04005'38" E, 312.72 feet to a point of curvature; thence
78.61 feet on the arc of a curve to the right, having a radius of 1960.00 feet, a central angle of 02'17'52",
and whose long chord bears S 02'56'42" E, 78.60 feet; thence leaving said westerly right-of-way line S
89046'16" W, 1325.65 feet to a point on the west line of said NE'/< NW '/<; thence N 00°34'05" E, 591.37
feet on said west line to the POINT OF BEGINNING. Containing 17.67 acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are
hereby instructed to so designate the same above described property on the official zoning map and other
area maps of the City of Caldwell, Idaho as M-1 (Light Industrial).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 3376
REGARDING ZONE DESIGNATION
OF CERTAIN PROPERTY
This ordinance provides for the rezone of a parcel of land in the City of Caldwell as M-1 (Light Industrial).
A parcel of land situated in the N % NE'/ NW '/ of Section 25, Township 4 North, Range 3 West, Boise
Meridian, City of Caldwell, Canyon County, Idaho, being more particularly described as follows:
COMMENCING at the N '/ Corner of said Section 25; thence S 89°49'32" W, 1328.87 feet on the north
section line of said Section 25 to the W 1/16 N corner of said Section 25, from which the NW corner of said
Section 25 bears S 89°49'32" W, 1328.76 feet; thence S 00°34'05" W, 70.01 feet to a point on the southerly
right-of-way line of US Hwy 20/26 AND the POINT OF BEGINNING; thence North 89°49'32" E, 1258.71
feet on said southerly right-of-way line; thence S 36031'00" E, 49.65 feet to a point of curvature on the
westerly right-of-way line of Smeed Parkway; thence on said westerly right-of-way line, 159.68 feet on the
arc of a curve to the left, having a radius of 2040.00 feet, a central angle of 04029'05", and whose long
chord bears S 01 051'06" E, 159.64 feet; thence S 04005'38" E, 312.72 feet to a point of curvature; thence
78.61 feet on the arc of a curve to the right, having a radius of 1960.00 feet, a central angle of 02°17'52",
and whose long chord bears S 02°56'42" E, 78.60 feet; thence leaving said westerly right-of-way line S
89-46-16" W, 1325.65 feet to a point on the west line of said NE'/ NW '/n; thence N 00°34'05" E, 591.37
feet on said west line to the POINT OF BEGINNING. Containing 17.67 acres, more or less.
The Ordinance includes a provision to amend the official maps of the City by designating the above -
described property as M-1 and providing an effective date, which shall be when published in the Idaho
Press Tribune on the 25th day of January, 2022. Ordinance No. 3376 was passed by the Council and
approved by the Mayor on the 18th day of January, 2022. The full text of the Ordinance is available at
Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho. The Mayor and City Council approved the foregoing
summary for publication pursuant to Idaho Code 50-901A on the 18th day of January, 2022.
