AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING
CHAPTER 10, `ARTICLE 12, SECTION 10-12-01, OF THE CALDWELL CITY CODE,
PERTAINING TO THE PURPOSE OF THE CENTRAL BUSINESS DISTRICT;
AMENDING CHAPTER 10, ARTICLE 12, SECTION 10-12-02, OF THE CALDWELL
CITY CODE, PERTAINING TO THE APPLICABILITY OF THE CENTRAL BUSINESS
DISTRICT; AMENDING CHAPTER 10, ARTICLE 12, SECTION 10-12-04, OF THE
CALDWELL CITY CODE, PERTAINING TO USE STANDARDS IN THE CENTRAL
BUSINESS DISTRICT; AMENDING CHAPTER 10, ARTICLE 12, SECTION 10-12-05,
OF THE CALDWELL CITY CODE, PERTAINING TO DESIGN REQUIREMENTS FOR
THE CENTRAL BUSINESS DISTRICT; AMENDING CHAPTER 10, ARTICLE 12,
SECTION 10-12-; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR
SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS
AND PARTS THEREOF, IN CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon,
State of Idaho:
ARTICLE 12
CENTRAL BUSINESS CITY CENTER D ZONING DISTRICT
Section L That Caldwell City Code Chapter 10, Article 12, Section 10-12-01, be
amended as follows:
10-12-01: PURPOSE:
The purpose of the Central Business District eity evi4or a....: , (CBD-G-E) is to protect,
enhance, and revitalize the historical city center in accordance with the Caldwell
comprehensive plan and to:
(1) T"Erovide for a mix of land uses that allow for residents to live, work, play and
shop;
(2) T"Provide for the location of essential community services including public and
quasi -public, cultural, financial, and recreational uses;
(3) Te-PProtect and maintain the Indian Creek corridor;
(4) To ^'zv llow fer Encourage aesthetically pleasing, energy efficient and environmentally
sustainable structures;
(5) Protect, revitalize, and enhance the existing historical architecture and
structures;
(6) Te-bBalance the needs for parking and vehicular circulation with dw-development
to ensure ef-a walkable, pedestrian environment; and
(7) 'Te.create a To create a Central Business District center that is a regional magnet for
residential and commercial investment.
(8) Strengthen and enhance the City of Caldwell's Central Business Zoning District
(downtown area) as the urban center of the County;

(9) Ensure that redevelopment or new projects are compatible with existing styles in the
surrounding neighborhood;
(10) Maintain economic restructuring and business recruitment and;
(11) Continue the promotion and marketing of the Central Business District
Section 2. That Caldwell City Code Chapter 10, Article 12, Section 10-12-02, be
amended as follows:
10-12-02: APPLICABILITY:

The Central Business Zoning District shall apply to the area defined below and on the
official zoning map.
CENTRAL BUSINESS ZONING DISTRICT (CBD) BOUNDARIES: The CENTRAL

tracks. WITHIN THE CENTRAL BUSINESS ZONING DISTRICT INCLUDES:

Avenue, Kimball Avenue, 9th Avenue, loth Avenue, Cleveland Boulevard and Blaine
Street from the railroad tracks to the southerly side of Cleveland Boulevard and to the
southerly side of Cleveland Boulevard, both sides of Arthur Street, and both sides of Main
Street from the westerly side of 51h Avenue to the westerly side of 1 oth Avenue, including
the southerly side of Cleveland Boulevard and both sides of 5th Avenue.
INDIAN CREEK CORRIDOR ZONING DISTRICT, BOUNDARIES: Land in proximity
to Indian Creek as it flows through Caldwell. The corridor extend southward a distance of
one hundred fiftyf(150') from the banks' high watermark. Any portion of a piece of
property that exists within the one hundred fifty feet (150') from the banks' high water mark
classifies the entire piece of property as existing completely within the Indian Creek
corridor and thus having to comply with all rules relating to development within the Indian
Creek corridor.
CITY CENTER CALDWELL HISTORIC ZONING DISTRICT, BOUNDARIES: The
half -block bounded by Seventh, Main and Kimball streets and the alley between Main and
Arthur streets, and adjoining buildings facing Seventh or Kimball. See Central Business
Zoning Ma .

Section 3. That Caldwell City Code Article 10, Chapter 12, Section 10-12-04 be
amended as follows:
10-12-04: USE STANDARDS:
(16) Parking:
A. Residential uses in Central Business District shall have the same reauirements as set
forth in the R-3 zone. When commercial and industrial uses abut a residential zone.
setbacks shall be the same as are required in the adjacent residential district. Residential,
mixed uses, and uses located in properties listed on the National Register of Historic Places
are exempt from the parking requirements when they are located City Center Zoning
District.

Section 4. That Caldwell City Code Article 10, Chapter 12, Section 10-12-05, be
amended as follows:
10-12-05: CITY CENTER DESIGN REQUIREMENTS:
(8) Standards for Pedestrian Amenities: Pedestrian amenities shall be provided in one of
the tluee (3) two 2 following ways as set forth in this subsection.
E Pedestrian amenities are provided that in the determination of the planning and
zoning director are equal to or greater in value to the pedestrian environment than
what would be required under the standards in subsection (8)A of this section.
(11) Standards For Murals:
A. The content of the mural is consistent with the architectural, geographical,
sociocultural and historical context of the city center.
B. The mural may be located on the front, rear, side or alley side of the
building, as approved by the Public Art Management Team (PAMT).
C. The size of the mural is limited to two hundred (200) square feet or will be based
on the size of the structure, as approved by the Public Art Management Team
P( AMT).

D. The surface material is resistant to vandalism and weather.
E. The mural cannot include advertising, but it may include the business name as long
as it shall not dominate the design of the mural. Not ine6de advertising or -

F. All murals shall be reviewed and approved by the Public Art Management Team
(PAMT).
Section 5. This ordinance shall be in full force and effect from and after its passage,
approval, and publication, according to law.
Section 6. This ordinance is hereby declared to be severable. If any portion of this
ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions
shall continue in full force and effect and shall be read to carry out the purposes of the
ordinance before the declaration of partial invalidity.
Section 7. All ordinances, resolutions, orders and parts thereof in conflict herewith are
suspended until such time as this ordinance shall expire.

ORDINANCE NO. 3366
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 10,
ARTICLE 12, SECTION 10-12-01, OF THE CALDWELL CITY CODE, PERTAINING TO THE PURPOSE
OF THE CENTRAL BUSINESS DISTRICT; AMENDING CHAPTER 10, ARTICLE 12, SECTION 10-12-02,
OF THE CALDWELL CITY CODE, PERTAINING TO THE APPLICABILITY OF THE CENTRAL
BUSINESS DISTRICT; AMENDING CHAPTER 10, ARTICLE 12, SECTION 10-12-04, OF THE
CALDWELL CITY CODE, PERTAINING TO USE STANDARDS IN THE CENTRAL BUSINESS
DISTRICT; AMENDING CHAPTER 10, ARTICLE 12, SECTION 10-12-05, OF THE CALDWELL CITY
CODE, PERTAINING TO DESIGN REQUIREMENTS FOR THE CENTRAL BUSINESS DISTRICT;
AMENDING CHAPTER 10, ARTICLE 12, SECTION 10-12-; PROVIDING FOR AN EFFECTIVE DATE;
PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS
AND PARTS THEREOF, IN CONFLICT HEREWITH.
Section 1: Amends Chapter 10, Article 12, Section 10-12-01, Caldwell City Code, by clarifying the purpose
of the Central Business District.
Section 2: Amends Chapter 10, Article 12, Section 10-12-02, Caldwell City Code, by amending the
definitions of the Central Business Zoning District, the City Center Zoning District, and Indian Creek
Corridor Zoning District, and the City Center Caldwell Historic Zoning District.
Section 3: Amends Chapter 10, Article 12, Section 10-12-04, Caldwell City Code, by clarifying which
parking requirements apply in the City Center Zone and the Central Business District Zone, updating sign
requirements and mural requirements in the Central Business District.
Section 4: Amends Chapter 10, Article 12, Section 10-12-05, Caldwell City Code, by removing the option
of donating to a public art fund as a method of meeting amenity requirements.
Sections 5 through 7: Provides that this ordinance shall be in full force and effect from and after its passage,
approval, and publication, according to law; provides for severability; repeals conflicting ordinances,
resolutions, and orders.
Ordinance No. 3366 provides an effective date, which shall be on the 14th day of December, 2021.
Ordinance No. 3366 was passed by the Council and approved by the Mayor on the 6' day of December,
2021. The full text of the Ordinance is available at Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho
83605. The Mayor and City Council approved the foregoing summary on the 6" day of December, 2021,
for publication on the 14" day of December, 2021, pursuant to Idaho Code § 50-901 A.
