HomeMy WebLinkAboutORD 33542021=075783 RECORDED 11 /02/2021 04029 PM 11111111111111111111111111111�IIIIIII III �I CHRIS YAMAMOTO CANYON COUNTY RECORDER Pgs=3 LBERG NO FEE ORDINANCE CITY OF CALDWELL Canyon County Recorder's Office Document Cover Sheet BILL N0. 35 ORDINANCE NO. 3354 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-1 (LOW DENSITY RESIDENTIAL) ZONE; DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63=215. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO. Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No. 1451, approved Case No. ANN21-000009 (Vallivue SD Annexation) at a public hearing held November 1, 2021. Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be annexed into the City of Caldwell as R-1 (Low Density Residential): A parcel of land situate in a portion of the North One Half of the Southwest Quarter of Section 10, Township 3 North, Range 3 West, Boise Meridian, Canyon County, Idaho being more particularly described as follows: BEGINNING at the W '/ Corner of said Section 10 (from which the C '/ Corner of said Section Inkears North 89°52'27" East, 2649.49 feet); thence North 89°52'27" East, 1324.74 feet on the east/west section line of said Section 10 to the CW 1/16 Corner; thence continuing on said mid -section line, North 89052'27" East, 47.07 feet to a point on the centerline of the Forest Canal; thence the following sixteen (16) courses and distances along said centerline of the Forest Canal: South 36032'45" East, 6.01 feet; thence South 47042'51 " East, 115.13 feet to a point of curvature; thence 89.76 feet on the arc of a curve to the right, having a radius of 236.88 feet, a central angle of 21 °42'42", and whose long chord bears South 36034'31" East, 89.23 feet; thence South 23011'17" East, 142.00 feet to a point of curvature; thence 82.12 feet on the arc of a curve to the left, having a radius of 97.34 feet, a central angle of 48020'15", and whose long chord bears South 52023'05" East, 79.70 feet; thence South 80044'17" East, 87.52 feet to a point of curvature; thence 137.16 feet on the arc of a curve to the left, having a radius of 639.97 feet, a central angle of 12016'47", and whose long chord bears South 86005'43" East, 136.90 feet to a point of non -tangent compound curvature; thence 120.70 feet on the arc of a curve to the right, having a radius of 134.43 feet, a central angle of 51 026'43", and whose long chord bears South 7805739" East, 116.69 feet; thence South 52052'26" East, 53.17 feet to a point of curvature; thence 115.65 feet on the arc of a curve to the right, having a radius of 357.81 feet, a central angle of 18031'07", and whose long chord bears South 47018'53" East, 115.15 feet; thence South 34046'07" East, 178.14 feet; thence South 39005'50" East, 65.75 feet to a point of curvature; thence 87.24 feet on the arc of a curve to the left, having a radius of 85.52 feet, a central angle of 58026'50", and whose long chord bears South 66050'33" East, 83.50 feet; thence North 87003'25" East, 95.75 feet to a point of curvature; thence 45.91 feet on the are of a curve to the right, having a radius of 151.00 feet, a central angle of 17025'11 ", and whose long chord bears South 85010'35" East, 45.73 feet; thence leaving said centerline of the Forest Canal, South 00022'08" West, 598.68 feet to a point on the south line of said N Y2 SW 1/ of Section 10; thence South 89045'56" West, 1142.28 feet on said south line to the SW 1/16 Corner; thence continuing South 89045'56" West, 1328.80 feet on said south line to the S 1/16 Corner common to Section 9 and Section 10; thence North 00043'04" East, 1324.04 feet on the west line of said N Y2 SW Y4 of Section 10 to the POINT OF BEGINNING. The above described annexation area contains 64.32 acres more a less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as R-1 (Low Density Residential). Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman -like manner plainly and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the following officials of the County of Canyon, State of Idaho, to -wit: the Recorder, Auditor, Treasurer and Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code 63-215. Ordinance No. 3354 was passed by the Council and approved by the Mayor on the 1 day of November, 2021.
