Call to Order—Commissioner Betsy Hunsicker called the meeting to order at 7:10 p.m.
Roll Call—
Members Present: Betsy Hunsicker, Shawn Hannan, Brett Slaughter, Alex Zamora

REPORT FROM CDBG:
Elizabeth McNannay, CDBG coordinator for the City of Caldwell at 3325 motor Creek Road,Mosier,
Oregon
Carrie Foster, CDBG specialist for the City of Caldwell at 126 Barbara Drive in Middleton, Idaho
Ms. McNannay&Ms. Foster provided a presentation for the Community Development Block Grant for
the City of Caldwell. She communicated how the grants are funded and distributed. They explained the
income requirements for qualification. They explained the restrictions of the grants. They explained
what drives the administrative costs.The provided some examples of specific ways these grants have
benefited the City of Caldwell residents and the community as a whole.
Commissioner Hunsicker had some questions.
Ms. McNannay and Ms. Foster responded to all questions.
The Commissioners responded in support to the presentation.

Old J3usiness:
1. Case Number OA-21-05: A request by the Planning and Zoning Department amending
Chapter 12 Article 05-3M, of the Caldwell City Code, regarding Placement of
Nonpermanent Items in City Center Design Requirements with a new designation
"Outdoor Seating".
Testimony:
Jerome Mapp,P& Z Director, at 620 Cleveland Blvd,Caldwell,ID, stated that he is bringing the revised
ordinance,which replaces the placement of non-permanent items. The previous code did not provide any
type of standards for outdoor dining; originally, it was called outdoor seating, but when finalized,the
ordinance will be outdoor dining. He explained that the purpose of this ordinance is to provide some
standards, guidance and direction as well as to implement this'program:He explained that most cities
like to have outdoor dining in the downtown area. Outdoor dining brings people downtown. It provides
an ambience of excitement and of activity in the downtown area.The ordinance that we provide
identifies the City Center boundaries on page two.This ordinance addresses concerns regarding life
safety in regards to the disabled community. He also explained the location of umbrellas,heaters,and
fencing around this activity. At our Open House/Workshop, we discussed speakers and music.The City
already has a noise ordinance, which will be implemented into this ordinance.He explained that there
would be no advertising allowed on umbrellas. Destination Caldwell has red umbrellas in the plaza.This
ordinance will require the same color as the Plaza umbrellas for continuity.There are some provisions
for outdoor lighting.This ordinance will help to promote the downtown area.
Commissioner Hunsicker asked about the distance from the building that you could set up the tables and
chairs.
Mr.Mapp stated that the measurement is based upon keeping a 36"wide pedestrian space for the
disabled. It will only be allowed in public space. Space that is owned by the city.
Commissioner Hunsicker had concerns about the outdoor dining being just adjacent to the business.The
width of the building and 15-20 feet out.
Mr.Mapp stated that their outdoor dining may only be as wide as their business.The width is based
upon accessibility. From the back of curb to the building and allowing for the 36"space for the disabled.
Based upon the number of seating areas a business may have, they may be required to have a permanent
fixture around the area.
Commissioner Zamora stated that he sees a renewal cost associated with the outdoor dining within the
ordinance. He wants to know if the renewal fee is the same as the initial fee.
Mr.Mapp stated that in the ordinance there is a$75 initial fee.There is currently not have a renewal fee
amount as part of the ordinance. He said that he would take Commissioner Zamora's concerns under
advisement.
MOTION TO CLOSE PUBLIC TESTIMONY: Commissioner Harmon SECOND: Commissioner
Slaughter. Passed: Unanimous voice vote.
Commissioner Zamora stated that he was at the Open House/Workshop. He stated that feedback was
provided to Staff at that time and that staff was receptive to that feedback.
Commissioner Hunsicker was concerned about the serving alcohol outside of the establishment.

Mr. Mapp stated that based on the liquor permit, they could have food and drink outside of the
establishment.
Commissioner Zamora clarified that with the liquor license, the business must provide a map where they
can only provide liquor within that map area. A business would have to re-submit a map for the liquor
license which would include the new outdoor boundaries.
Commissioner Hunsicker stated concerns about designating only red umbrellas.
Mr.Mapp stated that it would be for continuity in the City Center.
Commissioner Hunsicker stated that continuity with variety. Maybe use the Downtown design or color
guide.
RECOMMENDATION FOR OA-21-05 (Outdoor Dining). MOTION: Commissioner Harman that
Case OA-21-05 be approved with the following conditions(use the City Center Facade Handbook for
the umbrella colors)SECOND: Commissioner Slaughter. Passed: Unanimous roll call vote.
New Business: N/A
Planning and Zoning comments/concerns:
Next Planning and Zoning Commission Scheduled Public Meeting Date: July 29,2021.
