passed by the City Council of said City at their Regular
City Council Meeting held the 16th of November , 1987 , as
said Ordinance is officially of record in my possession .

ORDINANCE NO. 1761
AN ORDINANCE VACATING, ABANDONING AND DISCONTINUING THE PLAT OF
• NOTTINGSHIRE NORTH SUBDIVISION TO THE CITY OF CALDWELL, IDAHO,
AND THE LOTS, BLOCKS AND COMMON AREAS APPEARING THEREON; RECITING
PETITION FOR VACATION AND RECITING DUE AND PROPER NOTICE FOR THE
HEARING ON VACATING SAID PLAT WAS GIVEN ; DETERMINING THAT NO
OBJECTIONS HAVE BEEN MADE AND FILED TO THE VACATION OF SAID PLAT;
DETERMINING THAT THE VACATION OF SAID PLAT IS IN THE BEST
INTEREST OF THE CITY OF CALDWELL, ITS CITIZENS AND PROPERTY
OWNERS; PROVIDING THAT THE TITLE TO THE PROPERTY DESCRIBED IN
SAID PLAT AS VACATED SHALL REVERT TO THE PERSONS DEDICATING THE
SAME, THEIR SUCCESSORS, HEIRS OR ASSIGNS; AND REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
IDAHO, THAT VACATION OF THE FOLLOWING DESCRIBED REAL PROPERTY
SHALL BE MADE:
Lots 1-8 inclusive, Block 2; Lots 1-4 inclusive, Block 3;
Lots 1-8 inclusive, Block 4; and Lots 1-4 inclusive, Block
5; and also all designated common area5as the same appear on
the official plat of Nottingshire North filed for record in
the office of the Recorder of Canyon County, Idaho, at 11 : 56
a.m. , December 8, 1978, in Book 17 of Plats at Page 10.
BE IT FURTHER ORDAINED:
Section 1. That an application_ has been presented to the
Mayor and Council of the City of Caldwell, Idaho, requesting
passage and approval of an ordinance vacating the above-described
property located in Caldwell, Canyon County, Idaho.
Section 2. That a motion has been passed by the Council and
approved by the Mayor of the City of Caldwell, Idaho,
establishing a public hearing ; statutory notice has been given to
citizens and owners of property in the .City of Caldwell, Idaho,
in accordance with Section 50-1306A, Idaho Code ; and said public
hearing has been held on November 16, 1987, at which hearing no
objections were heard to said vacation.
Section 3. That the City Council has determined it is in
the best interest of the public that the above-described premises
in the City of Caldwell, Canyon County, Idaho, be vacated subject
to such easements and easement rights as determined by the City
Engineer to be necessary for construction and maintenance of
utilities.
Section 4. That title to said premises in the City of
Caldwell, Canyon County, Idaho, above-described, shall pass and
revert to the persons dedicating the same or their successors,
heirs and assigns.
Section 5. Repealing all ordinances or parts of ordinances
in conflict herewith.
