Canyon County Recorder's ffi Document 2021-053006 yer, Sheet RECORDED 07/29/2021 08:20, AM10063436420210053,0060070076 CHRI YAMAMOTO CANYON COUNTY RECORDER Pgs=7 MBROWN NO FEE ORDINANNCE C1TY OF CALD ELL 01 "N" 0"N', PTwV 1, BILL NO. 13 ORDINANCE NO. 3333 ANI ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYONI, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL,IDAHO, AS PART OF THE,R-1 (LOW DENSITY RESIDENTIAL) ZONE; DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS,, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF'THE AREA TO BE ANNEXED WITH CANYONI COUNTY,STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63-215. BE IT'ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 11. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning, Commission and following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No. 1451, approved Case No. ANN21-000003 (Autumn Ridge West Annexation) at a public hearing held April 13, 2021. Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be aninexedi, into the City of Caldwell as R-1 (Low Density Residential): Located in the NE % NW 114 and the NW 114 NE 1/4 of Section 24, Township 4 North, Range 3 West, Boise Meridian, Canyon County, Idaho and more particularly described as follows,- COMMENCING at NW 1/16 corner of said Section 24, from which the west 1/16 corner of said Section 24 bears N.0002602"E., 1322�.40 feet; thence N.89"30'41"E.,643.63 feet along the south boundary of said NE 114 NW 1/4 to a point on the centerfline of a drainage ditch, being on the east boundary of Peaceful Acres Subdivision, recorded in Book 13 of Plats, at Page 1, records of Canyon County, Idaho and the POINT OF BEGINNING;thence along said centerline and east boundary the following courses- N20033'153"W.,348.50 feet;thence 4.26'11911 8"W.,261,72 feet; thence N.02002'1 8'W., 123.32 feet;thence leaving said centerline, and east boundary S.61'51'35"E., 114.16 feet; thence S.68028"43"E,, 258,45 feet; thence S.79'23'09"E,., 128,37 feet; thence S.890371 9"'E., 166.20 feet; thence N.87006'34"E., 255.88 feet; thence S.0001 V26"E., 113,41 feet; thence N.89'27'3,2"E., 110.97 feet; thence S.02048'16"E., 405.13 feet to the south boundary of the NW 1/4 NE 1/4; thence S.89031'21"W., 93.52 feet along said boundary to the to the SW corner of said NW % NE 1/4; thence 5.89030'41"W., 684.11 feet along the south boundary of said NE 1/4 NW 114 to the! POINT OF BEGINNING. Containing 10.62 acres, more or Mess, Section 1 That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as R-1 (Low Density Residential). Section 4. Alll ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in, effect from and after its passage, approval and publication, according to law. Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman-like manner plainly and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the following officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code 63-215.
