ORDINANCE NO. 3285
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY
OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE
REZONED TO THE C-3(SERVICE COMMERCIAL)ZONE AND THE M-1 (LIGHT INDUSTRIAL)ZONE;
DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND
ZONING DIRECTOR TO AMEND SAID PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF
CALDWELL, IDAHO; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS
THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and
following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal
Code, approved Case No. ZON-20-05(AeroSky Park Rezone) at a public hearing held, April 5, 2021.
Section 2.The parcel is within the City of Caldwell, Idaho and the applicant has requested that said
following described property should be rezoned to C-3(Service Commercial)and M-1 (Light Industrial)
zone:
C3 Zone
A parcel located in the NW '/ NW '/ of Section 25, Township 4 North, Range 3 West, Boise Meridian,
Canyon County, Idaho, and more particularly described as follows:
COMMENCING at the NW corner of said NW '/ NW '/, from which the NE corner of said NW/4 NW/4
bears N89°49'35"E, 1328.86 feet; thence SO°26'50"W, 50.00 feet along the westerly boundary of said NW
'/ NW '/ to the POINT OF BEGINNING; thence N89049'35"E, 1328,75 feet to a point on the easterly
boundary of said NW '/ NW '/; thence SO°34'08"W, 325.56 feet along said easterly boundary; thence
S89°44'39"W, 879.28 feet to a point of curvature; thence 155.85 feet along the arc of a 100.00 foot radius
curve left, said curve having a central angle of 89°17'49" and a long chord bearing S45°05'44"W, 140.55
feet to a point of tangency;thence SO°26'50"W, 77.23 feet to a point of curvature;thence 156.85 feet along
the arc of a 100.00 foot radius curve right, said curve having a central angle of 89*52'12" and a long chord
bearing S45°22'56"W, 141.26 feet to a point of tangency; thence N89°40'58"W, 250.23 feet to a point on
the westerly boundary of said NW '/ NW '/; thence NO°26'50"E, 599.74 feet along said westerly boundary
to the POINT OF BEGINNING. Contains 12.16 acres, more or less.
M1 Zone
A parcel located in the NW '/ NW Ye of Section 25, Township 4 North, Range 3 West, Boise Meridian,
Canyon County, Idaho, and more particularly described as follows:
COMMENCING at the NW corner of said NW '/ NW '/, from which the NE corner of said NW '/< NW '/<
bears N89049'35"E, 1328.86 feet;thence SO°26'50"W,649.74 feet along the westerly boundary of said NW
'/ NW '/ to the POINT OF BEGINNING; thence S89°40'58"E, 250.23 feet to a point of curvature; thence
156.85 feet along the arc of a 100.00 foot radius curve left, said curve having a central angle of 89'52'12"
and a long chord bearing N45*22'56"E, 141.26 feet to a point of tangency; thence N0026'50"E, 77.23 feet
to a point of curvature; thence 155.85 feet along the arc of a 100,00 foot radius curve right, said curve
having a central angle of 89°17'49" and a long chord bearing N45°05'44"E, 140.55 feet to a point of
tangency;thence N89°44'39"E,879.28 feet to a point on the easterly boundary of said NW'/NW'/;thence

Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are
hereby instructed to so designate the same above described property on the official zoning map and other
area maps of the City of Caldwell, Idaho as C-3 (Service Commercial)and M-1 (Light Industrial).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law,

The Ordinance Includes a provision to arriend the official maps of the City by designiating the
above-described property as C-3 and M-1 and providing an effective date, which shall be when
published in the Idaho Press Tribune on the 131h day of April, 2021. Ordinance No. 3285 was
passed by the Council and approved by the Mayor on the 51h day of April 2021. The, full text of
the Ordinance is available at Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho. The Mayor
and City Council approved the foregoing surnrnary for pubfication pursuant to Idaho Code 50-
901 A on: the 5111 day of April, 2021.
