IN WITNESS WHEREOF, I have hereunto set my hand and affixed my official seal, the day and year written above. �/� -' .SGA- / NOTAR UBLIC FOR IDA O Resident at Caldwell, Idaho BILL NO. 16 ORDINANCE NO. 1991 AN ORDINANCE DETERMINING THAT CERTAIN LAND LIES CONTIGUOUS OR ADJACENT TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO; AND THAT THE OWNERS OF SAID LAND HAVE PETITIONED THAT SAID LAND BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-1 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT; AND DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH;AND DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREAS TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE STATE TAX COMMISSION OF THE STATE OF IDAHO, PURSUANT TO IDAHO CODE, SECTION 63-2219. BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: SECTION 1. That the following described land is contiguous and adjacent to the City of Caldwell, Idaho on the North; and that the owners of said land have requested that said following described land should be annexed to the City of Caldwell, Idaho: Said property consists of sixty (60) acres and is located generally south of Meadow Avenue, west of the intersection of Airport Avenue and Beech Street and includes the western one-half of the Airport Avenue right-of-way. Said property is more particularly described as follows: The southeast Quarter of the Northwest Quarter in Section 33, Township 4 North, Range 3 West of the Boise Meridian in Canyon County, Idaho; The Northeast Quarter of the Northwest Quarter in Section 33 Township 4 North, Range 3 West of the Boise Meridian in Canyon County, Idaho; EXCEPTING THEREFROM the following described property, to wit: Commencing at the Northwest corner of the said Northeast Quarter of the Northwest Quarter and running thence South 25 feet to the REAL POINT ORDNANCE- PA , OF BEGINNING: thence South 410.5 feet; thence East at right angles 210 feet to the center of the Government Drain Ditch; thence Northeasterly along the center line of the said Government Drain Ditch to a point 25 feet South of the North line of the said Northeast Quarter of the Northwest Quarter; thence West 355 feet to the real point of beginning, said land being in Section 33, Township 4 North, Range 3 West of the Boise Meridian; ALSO EXCEPTING THEREFROM: Beginning at the Northeast corner of the Northeast Quarter of the Northwest Quarter of Section 33, Township 4 North, Range 3 West of the Boise Meridian in Canyon County, Idaho, and running thence South 1125 feet along the East boundary line of the Northeast Quarter of the Northwest Quarter of the aforesaid Section 33, thence North 50°0' West 1200 feet; thence South 63°0' West 137 feet to the intersection of the center line of the Parker Drain Ditch of the Pioneer Irrigation District, thence meandering along the center line of the aforesaid Parker Drain Ditch North 6°20' West 150 feet; thence North 21°50' East 300 feet to the intersection of the North boundary line of the aforesaid Section 33; thence East 955 feet along the North boundary line of the aforesaid Section 33 to the point of beginning, containing 16.4 acres, more or less; including to the centerline of the Airport Avenue right-of-way. Together with all water, water rights, ditches and rights of way for ditches appurtenant thereto or in anywise appertaining; Together with all and singular the tenements, hereditaments and appurtenances thereunto belonging or in anywise appertaining; SECTION 2. That the above-described real property be and the same is hereby annexed and made a part of the City of Caldwell, Canyon County, Idaho. SECTION 3. That the real property herein by this ordinance annexed to the City of Caldwell hereinabove described shall be zoned and a part of the R-1 zoning district and the official zoning map is hereby amended accordingly. SECTION 4. That the City Engineer and the Planning and Zoning Director is hereby directed to alter all use and area maps as well as the official zoning maps, comprehensive plan and all official maps depicting the boundaries of the City of Caldwell in accordance with this ordinance. SECTION 5. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. SECTION 6. This ordinance shall be in full force and effect from and after its passage, approval and publication, according to law. ORDINANCE- P.2 SECTION 7. The Clerk of the City of Caldwell shall, within 10 days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman manner plainly and clearly designating the boundaries of the City of Caldwell, including the lands herein annexed, with the following officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and shall also file simultaneously a certified copy of this ordinance with State Tax Commission of the State of Idaho, all in compliance with Idaho Code §63-2219.
