ORDINANCE NO. 2115
AN ORDINANCE DETERMINING THAT CERTAIN LAND LIES CONTIGUOUS OR
ADJACENT TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO; AND THAT SAID LAND BE ANNEXED TO THE CITY OF
CALDWELL, IDAHO, AS PART OF THE R-1 (SINGLE FAMILY RESIDENTIAL) ZONING
DISTRICT; AND DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON
COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR
PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER
AND PLANNING AND ZONING DIRECTOR TO ADD SAID PROPERTY TO THE
OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK
OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND
MAP OF THE AREAS TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO
AND THE STATE TAX COMMISSION OF THE STATE OF IDAHO, PURSUANT TO
IDAHO CODE, SECTION 63-2219.
BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
SECTION 1. That the following described land is contiguous and adjacent to the City of
Caldwell, Idaho on the North, West and South and that the City is proposing that said
following described land should be annexed to the City of Caldwell, Idaho:
A parcel of land situated in the SW Quarter of the SW Quarter of Section 34, Township 4
North, Range 3 West, BM, Canyon County, Idaho, and is more particularly described as
follows:
BEGINNING at the Southwest corner of the SW Quarter of Section 34, Township
4 North, Range 3 West, of the Boise Meridian;
thence N 0° 12' 30" W a distance of 1650.50 feet;
thence N 89° 25' 47" E a distance of 201.0 feet;
thence S 0° 12' 28" E a distance of 165.02 feet;
thence N 89° 25' 12" E a distance of 461.20 feet;
thence S 0° 12' 30" E a distance of 164.94 feet;
thence N 89° 24' 30" E a distance of 253.92 feet;
thence S 20° 18' 30" W a distance of 383.42 feet;
thence S 61 ° 00' 45" W, along said centerline a distance of 482.75 feet to a point;
thence S 0° 12' 30" E a distance of 732.24 feet to the center of Ustick Road;
thence S 89° 20' 30" W a distance of 358.59 feet along the South boundary of the

SW Quarter of said Section 34 to THE POINT OF BEGINNING.
Together with all water, water rights, ditches and rights of way for ditches,
appurtenant thereto or in anywise appertaining. This parcel contains approximately
18.5 acres.
SECTION 2. That the above-described real property be, and the same is hereby annexed
and made a part of the City of Caldwell, Canyon County, Idaho.
SECTION 3. That the real property herein by this ordinance annexed to the City of Caldwell
hereinabove described shall be zoned and a part of the R-1 zoning district and the official
zoning map is hereby amended accordingly.
SECTION 4. That the City Engineer and the Planning and Zoning Director are hereby
directed to alter all use and area maps as well as the official zoning maps, Comprehensive
Plan and all official maps depicting the boundaries of the City of Caldwell in accordance
with this ordinance.
SECTION 5. All ordinances, resolutions, orders or parts thereof in conflict herewith are
hereby repealed, rescinded and annulled.
SECTION 6. This ordinance shall be in full force and effect from and after its passage,
approval and publication, according to law.
SECTION 7. The Clerk of the City of Caldwell shall, within 10 days following the effective
date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a
draftsman manner plainly and clearly designating the boundaries of the City of Caldwell,
including the lands herein annexed, with the following officials of the County of Canyon,
State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and shall also file
simultaneously a certified copy of this ordinance with the State Tax Commission of the
State of Idaho, all in compliance with Idaho Code §63-2219.
PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this 16 day of
October , 1995 .
APPROVED BY THE MAYOR OF THE CITY OF CALDWELL, IDAHO, this 16 day of
October , 199 5.
