ORDINANCE NO. 2123
AN ORDINANCE DETERMINING THAT CERTAIN LANDS LAY CONTIGUOUS OR
ADJACENT TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO; AND THAT SAID LANDS BE ANNEXED TO THE CITY OF
CALDWELL, IDAHO, AS PART OF THE C-3 (SERVICE COMMERCIAL) AND M-1
(LIGHT INDUSTRIAL) ZONING DISTRICT; AND DECLARING SAID LANDS BY PROPER
LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES,
RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND
DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD
SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO;
AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED
COPY OF THE ORDINANCE AND MAP OF THE AREAS TO BE ANNEXED WITH
CANYON COUNTY, STATE OF IDAHO AND THE STATE TAX COMMISSION OF THE
STATE OF IDAHO, PURSUANT TO IDAHO CODE, SECTION 63-2219.
BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
SECTION 1. That the following described lands are contiguous and adjacent to the City of
Caldwell, Idaho on the North, East and South and that the City has requested that said
following described land should be annexed to the City of Caldwell, Idaho:
Said properties consists of approximately one hundred acres and is located generally
between Ustick Road and Midway Avenue north and south of Cleveland Boulevard and
more particularly described as follows:
A parcel of land being a portion of the North 1/2, Section 1, T3N, R3W, B.M.,
Canyon County, Idaho and more particularly described as follows;
Beginning at the Northeast Corner of the Northeast 1/4 of the Northeast 1/4, Section
1, T3N, R3W, B.M., Canyon County, Idaho;
thence along the Northerly boundary of the Northeast 1/4 of said Northeast 1/4,
North 89° 54'41, West 1205.98 feet to a point of intersection with the Northeasterly
right-of-way of the Oregon Shortline Railroad and the Northerly boundary of the
Northeast 1/4 of said Northeast 1/4, said point being the REAL POINT OF

SECTION 2. That the above-described real property be, and the same is hereby annexed
and made a part of the City of Caldwell, Canyon County, Idaho.

SECTION 3. That the real property herein by this ordinance annexed to the City of Caldwell
hereinabove described shall be zoned and a part of the M-1 and C-3 zoning districts and
the official zoning map is hereby amended accordingly.
SECTION 4. That the City Engineer and the Planning and Zoning Director are hereby
directed to alter all use and area maps as well as the official zoning maps, Comprehensive
Plan and all official maps depicting the boundaries of the City of Caldwell in accordance
with this ordinance.
SECTION 5. All ordinances, resolutions, orders or parts thereof in conflict herewith are
hereby repealed, rescinded and annulled.
SECTION 6. This ordinance shall be in full force and effect from and after its passage,
approval and publication, according to law.
SECTION 7. The Clerk of the City of Caldwell shall, within 10 days following the effective
date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a
draftsman manner plainly and clearly designating the boundaries of the City of Caldwell,
including the lands herein annexed, with the following officials of the County of Canyon,
State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and shall also file
simultaneously a certified copy of this ordinance with the State Tax Commission of the
State of Idaho, all in compliance with Idaho Code §63-2219.
PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this 5th day of
February , 199 6.
