BILL NO. 30 ORDINANCE NO. 158 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAY CONTIGUOUS OR ADJACENT TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO; AND THAT SAID LANDS BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-1 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT; AND DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE STATE TAX COMMISSION OF THE STATE OF IDAHO, PURSUANT TO IDAHO CODE, SECTION 63-2219. BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: SECTION 1. That the following described land is contiguous to the City of Caldwell, Idaho and that the applicant has requested that said following described land should be annexed to the City of Caldwell, Idaho: The said property consists of approximately 0.92 of an acre and is located West of S. Montana Avenue and North of Ustick Road and currently has an address of 3708 Idaho Avenue and more particularly described as follows: Commencing at the Southwest corner of the Southeast Quarter of the Southwest Quarter of Section 34, Township 4 North, Range 3 West of the Boise Meridian, Canyon County, Idaho; thence North 89 ° 20' 30" East along the South boundary of said Southeast Quarter of the Southwest Quarter, a distance of 395.0 feet; thence North 1° 41' 45" East, a distance of 727.05 feet to a point on the center line of the Caldwell Low Line Canal; thence North 49° 25' 00" West along the centerline of said canal. a distance of 289.73 feet; thence North 11° 36' 00" West along the centerline of said canal, a distance of 205.11 feet to the TRUE POINT OF BEGINNING; thence continuing North 11° 36' 00" West along the centerline of said canal a distance of 203.75 feet to a point on the North boundary of said Southeast Quarter of the 06ann. ord Southwest Quarter, which point is 119.56 feet Easterly from the Northwest corner of said Southeast Quarter of the Southwest Quarter; thence North 89° 24' 30" East along the North boundary of said Southeast Quarter of the Southwest Quarter a distance of 1204.80 feet; to a point being the Northeast corner of said Southeast Quarter of the Southwest Quarter; thence South 0° 15' 30" West a distance of 40.00 feet along the easterly boundary of said Southeast Quarter of the Southwest Quarter; thence South 89° 24' 30" West a distance of 640.75 feet and parallel to the northerly boundary of said Southeast Quarter of the Southwest quarter; thence North 1° 11' 30" West a distance of 10.00 feet: thence South 89° 24' 30" West a distance of 343.35 feet; thence South 0° 35' 30" East a distance of 170.00 feet; thence South 89° 24' 30" West a distance of 181.09 feet to the TRUE POINT OF BEGINNING. SECTION 2. That the above-described real property be, and the same is hereby annexed and made a part of the City of Caldwell, Canyon County, Idaho. SECTION 3. That the real property herein by this ordinance annexed to the City of Caldwell hereinabove described shall be zoned and a part of the R-1 zoning district and the official zoning map is hereby amended accordingly. SECTION 4. That the City Engineer and the Planning and Zoning Director are hereby directed to alter all use and area maps as well as the official zoning maps, Comprehensive Plan and all official maps depicting the boundaries of the City of Caldwell in accordance with this ordinance. SECTION 5. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. SECTION 6. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. SECTION 7. The Clerk of the City of Caldwell shall, within 10 days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman manner plainly and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the following officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and shall also file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code §63-2219. 06ann. ord 2 PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this 19 day of August , 1996.
