ORDINANCE NO. 2184
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAY CONTIGUOUS OR
ADJACENT TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO; AND THAT SAID LANDS BE ANNEXED TO THE CITY OF
CALDWELL, IDAHO, AS PART OF THE R-1 (SINGLE FAMILY RESIDENTIAL) ZONING
DISTRICT; AND DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON
COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR
PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER
AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE
OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK
OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND
MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO
AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION
63-2219.
BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That the following described land is contiguous to the City of Caldwell, Idaho
and that the applicant has requested that said following described land should be annexed
to the City of Caldwell, Idaho:
The said property consists of approximately three point eight (3.8) acres more or less and
is located generally on the south side of Palrang Drive between S. Montana Avenue and
S. Oregon Avenue and more particularly described as follows:
Commencing at the W1/16 corner of Section 3, T3N, R3W, B.M. , thence N 00° 12' 46" W
a distance of 1226.40 feet to the POINT OF BEGINNING,
Thence continuing N 00° 12' 46" W a distance of 156 feet to a point on the northerly right-
of-way of Palrang Drive,
Thence N 89° 17' 47" E a distance of 1322.99 to a point on the centerline of South
Montana Avenue,
Thence S 00° 07' 19" E a distance of 156 feet along the centerline of South Montana
Avenue,
Thence S 89° 17' 47" W 1322.77 feet to a point on the western boundary of the SE1/4,
NW1/4 of said Section 3, T3N, R3W, B.M. to the POINT OF BEGINNING.
Said total property to be annexed consists of 3.8 acres more or less.
Section 2. That the above-described real property be, and the same is hereby annexed
and made a part of the City of Caldwell, Canyon County, Idaho.
Section 3. That the real property herein by this ordinance annexed to the City of Caldwell
hereinabove described shall be zoned and a part of the R-1 zoning district and the official
zoning map is hereby amended accordingly.
Section 4. That the City Engineer and the Community Development Director are hereby
directed to alter all use and area maps as well as the official zoning maps, Comprehensive
Plan and all official maps depicting the boundaries of the City of Caldwell in accordance
with this ordinance.
Section 5. All ordinances, resolutions, orders or parts thereof in conflict herewith are
hereby repealed, rescinded and annulled.
Section 6. This ordinance shall be in full force and in effect from and after its passage,
approval and publication, according to law.
Section 7. The Clerk of the City of Caldwell shall, within 10 days following the effective
date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a
draftsman manner plainly and clearly designating the boundaries of the City of Caldwell,
including the land herein annexed, with the following officials of the County of Canyon,
State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and shall also file
simultaneously a certified copy of this ordinance with the State Tax Commission of the
State of Idaho, all in compliance with Idaho Code §63-2219.
PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this 17 day of
March , 1997.
