NOTAR PUBLIC FOR IDAHO' ` Residing at Caldwell, Idaho , V Commission expires: 5-.123 >r.>•: v BILL NO. 26 ORDINANCE NO. 2200 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS OR ADJACENT TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO; AND THAT SAID LANDS BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-2 (MEDIUM DENSITY RESIDENTIAL) ZONING DISTRICT; AND DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63-2219. BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the following described land is contiguous to the City of Caldwell, Idaho and that the applicant has requested that said following described land should be annexed to the City of Caldwell, Idaho: The said property consists of approximately (40) acres more of less and is located generally on the east side of Florida Avenue and directly east of Starlight Park Subdivision, Phase I and II and is more particularly described as follows: A part of the SW %4 NE 1/4 NW 1/4 SE %4 Section 35, Township 4 North, Rage 3 West, Boise Meridian, Canyon County, Idaho. BEGINNING at the NW corner of said NW 1/4 SE 1/4 (C 1/4 corner) said corner monumented with a 3 inch diameter brass disk, thence S. 0° 26' 17" W., a distance of 1,091.69 feet along the westerly boundary of said NW 1/4 SE 1/4 to a 5/8inch diameter iron pin; thence N. 89° 45' 38" E., a distance of 321.26 feet to a 1/2 inch diameter iron pin; thence S. 0° 15' 09" W., a distance of 228.75 feet to a point on the southerly boundary of said NW 1/4 SE 1/4 said point monumented with a 1/2 inch diameter iron pin; thence N. 89° 45' 38" E., a distance of 1,006.43 feet along the southerly boundary of said � f • NW 1/4 SE '/4 to the SE corner of said NW 1/4 SE 1/4 (SE 1/16 corner) said corner monumented with a 5/8 inch diameter iron pin, thence N. 0° 26' 10" E., a distance of 887.34 feet along the easterly boundary of said NW 1/4 SE 1/4 to a point on the centerline of the Wilson Drain, said point witnessed 71.34 feet southerly by a 5/8 inch diameter iron pin; thence N. 36° 24' 46" W., a distance of 149.21 feet along the centerline of said Wilson Drain: thence N. 16° 40' 00" W., a distance of 438.10 feet along the centerline of said Wilson Drain, said point witnessed 32.00 feet westerly by a 5/8 inch diameter iron pin; thence leaving the centerline of said Wilson Drain S. 89° 57' 54" W., a distance of 1,110.00 feet parallel with the southerly boundary of said SW %4 NE 1/4 to a point on the westerly boundary of said SW 1/4 NE 1/4, said point monumented with a 5/8 inch diameter iron pin; thence S. 0° 26' 23" W., a distance of 111.74 feet along the westerly boundary of said SW 1/4 NE 1/4 to the POINT OF BEGINNING. This parcel contains 40.300 acres more or less. Also, this parcel is subject to all easements and rights-of-way of record or implied. All according to the record of survey as recorded in the office of the Canyon County Recorder. Section 2. That the above-described real property be, and the same is hereby annexed and made a part of the City of Caldwell, Canyon County, Idaho. Section 3. That the real property herein by this ordinance annexed to the City of Caldwell herein above described shall be zoned as an R-2 zoning district and the official zoning map is hereby amended accordingly. Section 4. That the City Engineer and the Community Development Director are hereby directed to alter all use and area maps as well as the official zoning maps, and all official maps depicting the boundaries of the City of Caldwell in accordance with this ordinance. Section 5. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 6. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 7. The Clerk of the City of Caldwell shall, within 10 days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman manner plainly and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the following officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and shall also file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code §63-2219.
