ORDINANCE NO. 2250
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS OR ADJACENT
TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON,STATE OF IDAHO;
AND THAT SAID LANDS BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF
THE C-3 (SERVICE COMMERCIAL) ZONING DISTRICT; AND DECLARING SAID LAND BY
PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS,
ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY
ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE
OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO;AND DIRECTING THE CLERK OF THE
CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE
AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE
TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63-2219.
BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That the following described land is contiguous to the City of Caldwell, Idaho and that the
applicant has requested that said following described land should be annexed to the City of Caldwell, Idaho:
The said property consists of approximately 5.66 acres,more or less, and is located adjacent to a portion of
the southwest side of Caldwell Boulevard and the northern boundary of a portion of Notus Canal and more
particularly described as follows:
A portion of Government Lot 2 and the Southwest Y4 of the Northeast 'A of Section 1, T3N, R3 W, B.M.,
Canyon County,Idaho,more particularly described as follows:
Commencing at the found Brass Cap lying 15.00 feet East of the Center of said Section 1 as shown on Record
of Survey Instrument No. 8818374 and 9014427,on file in the Canyon County Recorders Office in Caldwell,
Idaho;thence South 89°17'20"West a distance of 15.00 feet to the north/south center line of said Section 1;
thence North 00°04'20"West along the said north/south center of section line a distance of 931.73 feet,more
or less,to the center line of the Notus Canal as shown on said Record of Survey Instrument No. 8818374, and
the TRUE POINT OF BEGINNING;thence along the following courses and distances as shown on Record
of Survey Instrument No.'s 8818374 and 9014427;thence North 00°04'20"West along the said north/south
center of section line, a distance of 381.38 feet to the southwest corner of the land described in the Warranty
Deed Instrument Number 561405,Alden and Leona Bryan to Jay and Diana Robertson, and the Southwest
corner of said Government Lot 2;thence North 89°07'45"East along the south line of the land described in
said Robertson Warranty Deed and the south line of said Government Lot 2,a distance of 330.00 feet to the
southeast corner of the land described in Said Robertson Warranty Deed; thence North 00°04'20"West along
a line parallel with said north/south center of section line and along the east line of the land described in said
Robertson Warranty Deed, a distance of 476.49 feet,more of less,to a point on the southwest right-of-way
of Cleveland Avenue; thence South 46°33'30" East along the southwest right-of-way of said Cleveland
Avenue a distance of 196.91 feet to the beginning of a curve concave northeasterly,said curve having a Radius
of 3854.00 feet,a Central Angle of 1°49'38",a Long Chord Bearing of South 47°28'19"East,a Long Chord
distance of 122.91 feet;thence along said southwest right-of-way and said curve an arc length of 122.92 feet
to the northwest corner of the land described in the Warranty Deed Instrument No. 9620405, Lucille Grant
to Michael and Margaret Lesh;thence South 35°57'08"West along the northwest line of said Lesh Warranty

South 37°09'02"West along the southwest prolongation of the southeast line of the Lesh Warranty Deed a
distance of 161.85 feet to a point on the center line of the Notus Canal;thence South 84°59'00"West along
the center line of the Notus Canal a distance of 512.85 feet to the TRUE POINT OF BEGINNING.
Containing 5.66 acres,more of less.The Basis of Bearings for this legal description is between the Center of
Section 1 and the Center-North 1/16 corner of Section 1 T.3N.,R.3W.,and bears North 00°04'20"West as
shown on Record of Survey Instrument No. 8818374 in the Canyon County Recorders Office.
Section 2. That the above-described real property be,and the same is hereby annexed and made a part of the
City of Caldwell, Canyon County,Idaho.
Section 3. That the real property herein by this ordinance annexed to the City of Caldwell hereinabove
described shall be zoned and a part of the C-3 zoning district and the official zoning map is hereby amended
accordingly.
Section 4. That the City Engineer and the Community Development Director are hereby directed to alter all
use and area maps as well as the official zoning maps, and all official maps depicting the boundaries of the
City of Caldwell in accordance with this ordinance.
Section 5. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 6. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
Section 7. The Clerk of the City of Caldwell shall, within 10 days following the effective date of this
ordinance,duly file a certified copy of this ordinance and a map prepared in a draftsman manner plainly and
clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the
following officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and
Assessor and shall also file simultaneously a certified copy of this ordinance with the State Tax Commission
of the State of Idaho, all in compliance with Idaho Code §63-2219.
