IN WITNESS WHEREOF, I have hereunto set my hand and affixed my official seal, the day and year written above. .....e 4-11 NOT Y PUBLIC FOR IDAHO s �� ��z •h'' Residing at Caldwell, Idaho �� ,,, `As. -5 Commission expires: "---z-3 `'2-- �': fi ;. r.C O N z ' I BILL NO. 24 ORDINANCE NO. 2245 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS OR ADJACENT TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO;AND THAT SAID LANDS BE ANNEXED TO THE CITY OF CALDWELL,IDAHO,AS PART OF THE R-1 (SINGLE-FAMILY RESIDENTIAL)ZONING DISTRICT;AND DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS,ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH;AND DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE,SECTION 63-2219. BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON,STATE OF IDAHO: Section 1. That the following described land is contiguous to the City of Caldwell,Idaho and that the City Council has requested that said following described land should be annexed to the City of Caldwell,Idaho: A portion of the NE 1/4, NW 1/4 of Section 3, Township 3 North, Range 3 West, Boise Meridian, City of Caldwell,Canyon County,Idaho,more particularly described as follows: BEGINNING at the NE corner of said NE 1/4,NW 1/4 of Section 3,Township 3 North,Range 3 West,Boise Meridian,City of Caldwell,Canyon County,Idaho,said corner being the intersection of Montana Avenue and Ustick Road;thence running South 0°7'East along the Easterly boundary of said NE 1/4,NW 1/4,said Easterly boundary also being the centerline of Montana Avenue,a distance of 1340.9 feet;thence South 89°18' West along a line parallel with and 28 feet Northerly of the centerline of Palrang Drive, a distance of 1323.08 feet to a point on the Westerly boundary of said NE 1/4,NW 1/4; thence North 0°12' West along said Westerly boundary of said NE 1/4,NW 1/4 a distance of 1343.2 feet to a point on the centerline of Ustick Road,said point also being the NW corner of said NE 1/4,NW 1/4; thence North 89° 24' East along the centerline of Ustick Road,said centerline also being the Northerly boundary of said NE 1/4,NW 1/4 a distance of 1325.0 feet to the TRUE POINT OF BEGINNING. This parcel contains 40.79 acres more or less. Section 2. That the real property herein by this ordinance annexed to the City of Caldwell hereinabove described shall be zoned and a part of the R-1 zoning district and the official zoning map is hereby amended accordingly. Section 3. That the City Engineer and the Community Development Director are hereby directed to alter all use and area maps as well as the official zoning maps, and all official maps depicting the boundaries of the City of Caldwell in accordance with this ordinance. Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. • I+ Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 6. The Clerk of the City of Caldwell shall, within 10 days following the effective date of this ordinance,duly file a certified copy of this ordinance and a map prepared in a draftsman manner plainly and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the following officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and shall also file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code §63-2219.
