Commission expires: 5- BILL NO. 18 ORDINANCE NO. 2239 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS OR ADJACENT TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO;AND THAT SAID LANDS BE ANNEXED TO THE CITY OF CALDWELL,IDAHO,AS PART OF THE C-3 (SERVICE COMMERCIAL)ZONING DISTRICT;AND DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS,ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH;AND DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE,SECTION 63-2219. That the following described land is contiguous to the City of Caldwell, Idaho and that the applicants have requested that said following described land should be annexed to the City of Caldwell,Idaho: A parcel of land situated in Government Lot 3 and the Southeast quarter of the Northwest quarter of Section 1,Township 3 North,Range 3 West,Boise Meridian,Canyon County,Idaho. Said parcel is more particularly described as follows: BEGINNING at the northwest corner of said Government Lot 3;thence south 00 degrees 23'46"West along the west line thereof a distance of 633.57 feet to the TRUE POINT OF BEGINNING; Thence continuing South 00 degrees 23'46"West,a distance of 510.13 feet to a point in the centerline of Government Drainage Ditch (Elijah Drain); Thence Southeasterly along said Government Drainage Ditch as follows: South 42 degrees 30' East, a distance of 498 feet; Thence South 34 degrees 30' East, a distance of 324 feet; Thence South 34 degrees 00'East, a distance of 305 feet; Thence South 42 degrees 30'East,a distance of 498 feet; Thence South 22 degrees 00'East,a distance of 284 feet,to a point on the South line of said Southeast quarter of the Northwest quarter of said Section 1; Thence North 88 degrees 59' 29"East along said South line, a distance of 175.4 feet,more or less,to the Southeast corner of said Southeast quarter of the Northwest quarter; Thence North 00 degrees 18' 11"East along the East line of said Southeast quarter of the Northwest quarter, a distance of 967.23 feet to the Southwest line of that tract of land described in document dated March 12, 1985 as instrument No. 8507888;Thence North 36 degrees 22' 20"West along said Southwest line and the Southwest line of that tract of land described in document dated September 25, 1973 as instrument No. 715751,a distance of 996.99 feet to the Southeasterly most corner of that tract of land described in document dated March 25, 1986 as instrument No. 8610773;Thence North 41 degrees 45' 35"West a distance of 71.52 feet to the Southwesterly most corner thereof;Thence North 41 degrees 46'20"East along the Northwesterly line thereof,and its Northeasterly extension,a distance of 684.87 feet to a point on the centerline of the Nampa Caldwell Boulevard (the same as U.S. Highway No. 30) as established by the Idaho Department of Transportation under project number NH-F-M-7963(021);Thence North 46 degrees 14'40"West along said centerline,a distance of 376.61 feet to the intersection with the Northeasterly extension of the Southeasterly r line of that tract of land described in document dated April 14, 1977 as instrument No. 9317196;Thence South 57 degrees 14' 02"West along the Southeasterly line and its Northeasterly extension of said tract,a distance of 578.34 feet to the Southwesterly most corner thereof;Thence South 55 degrees 10'06"West,a distance of 450.07 feet to the TRUE POINT OF BEGINNING,all according to Exhibit A Map attached,which by this reference is made a part thereof. Section 2. That the above-described real property be,and the same is hereby annexed and made a part of the City of Caldwell, Canyon County,Idaho. Section 3. That the real property herein by this ordinance annexed to the City of Caldwell hereinabove described shall be zoned and a part of the C-3 zoning district and the official zoning map is hereby amended accordingly. Section 4. That the City Engineer and the Community Development Director are hereby directed to alter all use and area maps as well as the official zoning maps, and all official maps depicting the boundaries of the City of Caldwell in accordance with this ordinance. Section 5. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 6. This ordinance shall be in full force and in effect from and after its passage, approval and publication,according to law. Section 7. The Clerk of the City of Caldwell shall, within 10 days following the effective date of this ordinance,duly file a certified copy of this ordinance and a map prepared in a draftsman manner plainly and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the following officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and shall also file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code§63-2219.
