':' 0 va ''• I ate. :''' ,� ,... • BILL NO. 17 ORDINANCE NO. 2238 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF CALDWELL,COUNTY OF CANYON, STATE OF IDAHO;AND THAT SAID LANDS BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-1 (LOW DENSITY RESIDENTIAL) ZONING DISTRICT; AND DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL,CANYON COUNTY,IDAHO; REPEALING ALL ORDINANCES,RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL,IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION,PURSUANT TO IDAHO CODE, SECTION 63-2219. BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON,STATE OF IDAHO: Section 1. That the following described land is contiguous to the City of Caldwell, Idaho and that the Applicants have requested that said following described land should be annexed to the City of Caldwell,Idaho. Said property consists of approximately 8.26 acres more of less and is located at the western edge of W. Spruce and Hilldrop Streets, and is described as follows: A portion of the West Half of the Northwest Quarter of the Southeast Quarter of Section 33,Township 4 North,Range 3 West,Boise Meridian,Canyon County,Idaho,more particularly described as follows: BEGINNING at the Northwest corner of said West Half of the Northwest Quarter of the Southeast Quarter; thence South 89°34' 15"East along the North boundary of said West Half of the Northwest Quarter of the Southeast Quarter a distance of 663 feet to the Northeast corner of said West Half of the Northwest Quarter of the Southeast Quarter; thence South 0° 36' 44"West along the East boundary of said West Half of the Northwest Quarter of the Southeast Quarter a distance of 120 feet to a point on the North boundary of HILLDROP SUBDIVISION,Canyon County,Idaho,according to the plat filed in Book 8 of Plats, Page 30, records of said County; thence traversing the boundary of said subdivision as follows: North 89°33' 11"West a distance of 55.88 feet; thence South 0°36' 44"West a distance of 442.35 feet; thence Southwesterly 40.22 feet along the arc of a curve to the left having a central angle of 46° 04' 57", a radius of 50 feet and a long chord which bears South 60° 41' 29"West a distance of 39.14 feet; thence North 89° 34' 15" West parallel with the North boundary of said Northwest Quarter of the Southeast Quarter a distance of 573.93 feet to a point on the West boundary of said Northwest Quarter of the Southeast Quarter; thence North 0° 41' 06" East along said West boundary a distance of 581.75 feet to the POINT OF BEGINNING, containing 8.26 acres,more or less. Section 2. That the above-described real property be, and the same is hereby annexed and made a part of the City of Caldwell, Canyon County, Idaho. Section 3. That the real property annexed to the City of Caldwell herein above described shall be zoned as a part of the R-1 zoning district and the official zoning map is hereby amended accordingly. Section 4. That the City Engineer and the Community Development Director are hereby directed to alter all use and area maps as well as the official zoning maps, and all official maps depicting the boundaries of the City of Caldwell in accordance with this ordinance. Section 5. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 6. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 7. The Clerk of the City of Caldwell shall, within 10 days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman manner plainly and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the following officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor, and shall also file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code §63-2219.
