AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY
LIMITS OF THE CITY OF CALDWELL,COUNTY OF CANYON,STATE OF IDAHO,AND THAT
SAID LANDS SHOULD BE ANNEXED TO 1HE CITY OF CALDWELL,IDAHO,AS PART OF
THE R-1 (SINGLE-FAMILY)ZONING DISTRICT;AND DECLARING SAID LAND BY PROPER
LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL,
CANYON COUNTY,IDAHO;REPEALING ALL ORDINANCES,RESOLUTIONS,ORDERS OR
PARTS THEREOF IN CONFLICT HEREWITH;AND DIRECTING THE CITY ENGINEER AND
COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO 111E OFFICIAL
MAPS OF THE CITY OF CALDWELL,IDAHO;AND DIRECTING 11'11;CLERK OF 111E CITY
OF CALDWELL TO FILE A CERl'11''IED COPY OF THE ORDINANCE AND MAP OF THE AREA
TO BE ANNEXED WITH CANYON COUNTY,STATE OF IDAHO AND 1'11:IDAHO STATE TAX
COMMISSION,PURSUANT TO IDAHO CODE,SECTION 63-2219.
BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL,
COUNTY OF CANYON,STATE OF IDAHO:
Section 1. That the Caldwell City Council,upon recommendation of the Planning and Zoning Commission,
and following the public notice and hearing procedures set forth in Section 10-01-07,Zoning Ordinance No.
1451,approved Case No.ANN-18-99(Southpark Subdivision)on June 7, 1999.
Section 2. That the following described land is approximately 146.069 acres,and is located along a portion
of the southern boundary of Homedale Road and between a portion of the east boundary of South Montana
Avenue and a portion of the west boundary of South Indiana Avenue. The parcel is contiguous to the City
of Caldwell,Idaho and the applicant has requested that said following described land should be annexed to
the City of Caldwell,Idaho as an R-1 zone.
A part of the NE '/4 of Section 10, Township 3 North, Range 3 West, Boise Meridian, Caldwell, Canyon
County,Idaho,more particularly described as follows: Commencing at the NW corner of said NE 1/4(North
'/4 corner),thence N. 89°51'05"E.,a distance of 660.00 feet along the northerly boundary of said NE'A to the
POINT OF BEGINNING,said point monumented with a 5/8 inch diameter iron pin;Thence continuing along
the northerly boundary of said NE '/4,N. 89°51'05"E.,a distance of 1453.18 feet to a 5/8 inch diameter pin;
Thence S. 0°35'12"W., a distance of 574.36 feet parallel with the easterly boundary of said NE 1/4 to a 5/8
inch diameter iron pin;Thence S. 89°44'11"E.,a distance of 518.43 feet to a point on the easterly boundary
of said NE '/4, said point monumented with a 5/8 inch diameter iron pin;Thence S. 0°35'12"W., a distance
of 2070.66 feet along the easterly boundary of said NE 1/4 to the SE corner of said NE '/4(East'/4 corner), said
point monumented with a 5/8 inch diameter iron pin; Thence S. 89°52'12" W., a distance of 2370.99 feet
along the southerly boundary of said NE 'A to a point on the center line of the Deer Flat Caldwell Canal,said
point witnessed N. 89°52'12"E., a distance of 50.00 feet to a 5/8 inch diameter iron pin;Thence along the
center line of said Deer Flat Caldwell Canal the following courses and distances: N. 56°32'57"W.,93.59 feet;

1/4,said point monumented with a 5/8 inch diameter iron pin; Thence N. 0°27'03"E., a distance of 41.11 feet
along the westerly boundary of said NE '/4 to a point on the northerly Right of Way of said Deer Flat Caldwell
Canal, said point monumented with a 5/8 inch diameter iron pin;Thence S. 68°00'30"E., a distance of 161.26
feet along the northerly Right of Way of said Deer Flat Caldwell Canal to a 5/8 inch diameter iron pin;Thence
N. 0°27'03"E., a distance of 465.21 feet parallel with the westerly boundary of said NE 1/4 to a 5/8 inch
diameter iron pin; Thence N. 89°32'57"W., a distance of 150.00 feet to a point on the westerly boundary of
said NE 1/4, said point monumented with a 5/8 inch diameter iron pin;Thence N. 0°27'03"E., a distance of
1759.83 feet along the westerly boundary of said NE 1/4 to a 5/8 inch diameter iron pin; Thence N. 89°51'05"
E., a distance of 660.00 feet parallel with the northerly boundary of said NE 1/4 to a 5/8 inch diameter iron pin;
Thence N. 0°27'03" E., a distance of 330.00 feet parallel with the westerly boundary of said NE 1/4 to the
POINT OF BEGINNING. This parcel contains 146.069 acres more or less. Also, this parcel is subject to all
easements and rights-of-way of record or implied. All according to the record of survey as recorded in the
Office of the Canyon County Recorder.
Section 3. That the above-described real property be, and the same is hereby annexed and made a part of the
R-1 zoning district of the City of Caldwell, Canyon County, Idaho, and the official zoning map is hereby
amended accordingly.
Section 4. That the City Engineer and the Community Development Director are hereby directed to alter all
use and area maps as well as the official zoning maps, and all official maps depicting the boundaries of the
City of Caldwell in accordance with this ordinance.
Section 5. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 6. This ordinance shall be in full force and effect from and after its passage,approval and publication,
according to law.
Section 7. The Clerk of the City of Caldwell shall, within 10 days following the effective date of this
ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman manner plainly and
clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the
following officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and
Assessor and shall also file simultaneously a certified copy of this ordinance with the State Tax Commission
of the State of Idaho, all in compliance with Idaho Code §63-2219.
