IC •••• O Commission expires: 57-Z3-d •••....•• ••., A H 0 ....•• • BILL NO. 22 ORDINANCE NO. 2282 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-1 (SINGLE-FAMILY) ZONING DISTRICT; AND DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL,CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION,PURSUANT TO IDAHO CODE,SECTION 63-2219. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Planning and Zoning Commission, and following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No. 1451, approved Case No.ANN-17-99(Southern Heights Subdivision)on May 17, 1999. Section 2. That the following described land is approximately 38.0 acres, and is located along the northern boundary of Homedale Road and between the east boundary of the Vallivue High School'site and the west side of Indiana Avenue. The parcel is contiguous to the City of Caldwell, Idaho, and the applicants have requested that said following described land should be annexed into the City of Caldwell,Idaho as an R-1 zone: A part of the SE 1/4 SE '/ of Section 3,Township 3 North,Range 3 West,Boise Meridian,Canyon County Idaho, more particularly described as follows: Commencing at the SE corner of said SE '/4 SE '/4, (Section corner common to sections 3, 2, 11 and 10) said point monumented with a 5/8 inch diameter iron pin, thence S. 89°50'46" W., a distance of 225.96 feet along the southerly boundary of said SE 1/4 SE '/a to the POINT OF BEGINNING, said point monumented with a 5/8 inch diameter iron pin; Thence continuing along the southerly boundary of said SE 1/4 SE 1/4, S. 89°50'46"W., a distance of 1089.83 feet to the SW corner of said SE '/4 SE '/4, (East 1/16 corner common to sections 3 and 10), said point monumented with a 5/8 inch diameter iron pin; Thence N. 0°25'16" E., a distance of 1326.35 feet along the westerly boundary of said SE 1/4 SE 1/4, to the NW corner of said SE 1/4 SE '/a, (Southeast 1/16 corner), said corner monumented with a 3 inch diameter brass disk; Thence N. 89°51'04"E., a distance of 1319.25 feet along the northerly boundary of said SE 1/4 SE 1/4, to the NE corner of said SE 1/4 SE '/4, (South 1/16 corner common to sections 3 and 2), said point monumented with a 5/8 inch diameter iron pin; Thence S. 0°34'14" W., a distance of 1015.95 feet along the easterly boundary of said SE '/4 SE 1/4 to a 5/8 inch diameter iron pin; Thence S. 89°31'36" W., a distance of 153.12 feet to a '/z inch diameter iron pin; Thence N. 0°40'00" E., a distance of 37.56 feet to a 5/8 inch diameter iron pin; Thence N. 89°41'14" W., a distance of 70.43 feet to a 1/4 inch diameter iron pin; Thence S. 0°58'49" W., a distance of 347.65 feet to the POINT OF BEGINNING. This parcel contains 38.453 acres more or less. Also,this parcel is subject to all easements and rights-of-way of record or implied. All according to the record of survey as recorded in the Office of the Canyon County Recorder. Section 3. That the above-described real property be, and the same is hereby annexed and made a part of the R- 1 zoning district of the City of Caldwell, Canyon County, Idaho, and the official zoning map is hereby amended accordingly. • • Section 4. That the City Engineer and the Community Development Director of the City of Caldwell, Idaho, are hereby instructed to alter all use and area maps as well as the official zoning map and all official maps depicting the boundaries of the City of Caldwell, Idaho, in accordance with this ordinance. Section 5.All ordinances,resolutions, orders or parts thereof in conflict herewith are hereby repealed,rescinded and annulled. Section 6. This ordinance shall be in full force and in effect from and after its passage, approval and publication,according to law. Section 7. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman manner plainly and clearly designating the boundaries of the City of Caldwell, including the land herein annexed,with the following officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code 63-2219. Said property is located along a portion of the northern boundary of Homedale Road and between the east boundary of the Vallivue High School site and the west side of Indiana Avenue. The annexed property is legally described as: The SE 1/4 of the SE 'A of Section 3, Township 3 N., Range 3 W of the Boise Meridian, Canyon County, Idaho, excepting therefrom the following: BEGINNING at the SE corner of said SE 1/4 SE '/a; thence North 89°01'00" West along the South boundary of said SE 'A SE 1/4, a distance of 225.86 feet; thence North 0°08'00"West, a distance of 347.59 feet; thence North 89°29'45" East, a distance of 70.43 feet; thence South 0°16'40"East, parallel with the East boundary of said SE 1/4 SE 'A, a distance of 37.56 feet to the East boundary of said SE 1/4 SE 'A; thence South 0°16'40"East along the East boundary of said SE '/4 SE 'A a distance of 310.25 feet to the POINT OF BEGINNING. The Ordinance includes a provision for the Community Development Director to amend the official zoning map of the City by designating the above- described property as R-1, and it provides an effective date, which shall be when published in the Idaho Press Tribune on the 14 thlay of June, 1999. Ordinance No. 2282 was passed by the Council and approved by the Mayor on the 7th day of June, 1999.
