ORDINANCE NO. 2304
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY
LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT
SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE
R-1 (SINGLE-FAMILY RESIDENTIAL) ZONING DISTRICT; AND DECLARING SAID LAND BY
PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS,
ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY
ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE
OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF
THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF
THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO
STATE TAX COMMISSION,PURSUANT TO IDAHO CODE, SECTION 63-2219.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL,
COUNTY OF CANYON,STATE OF IDAHO:
Section 1. That the Caldwell City Council,upon recommendation of the Planning and Zoning Commission, and
following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No. 1451,
approved Case No. ANN-21-99 (Roman Catholic Diocese of Boise)on November 15, 1999.
Section 2. That the following described land is approximately 12.66 acres,and is located at the southeast corner
of the intersection of W.Ash Street Street and Farmway Road. The parcel is contiguous to the City of Caldwell,
Idaho and the applicant has requested that said following described land should be annexed to the City of
Caldwell, Idaho as an R-1 zone:
This parcel consists of Lots 10, 11 and a portion of Lot 12 of MITCHELL'S ACREAGE, and a portion of
vacated Dorman Avenue, all as shown on the official plat thereof on file in the office of the Recorder for Canyon
County,Idaho, lying in the SW '/4 SW '/a of Section 28,Township 4 North,Range 3 West of the Boise Meridian
and being more particularly described as follows:
COMMENCING at the northwest corner of said SW 1/4 SW 1/4; thence South 89° 21' 21" East along the north
boundary of said SW '/4 SW % a distance of 25.00 feet; thence South 0° 05' 24" West parallel with the west
boundary of said SW 1/4 SW 1/4 a distance of 25.00 feet to the northwest corner of said Lot 12, said point being
the TRUE POINT OF BEGINNING; thence South 89° 21' 21" East along the north boundary of said Lot 12 a
distance of 442.61 feet to an existing V2 inch diameter rebar; thence South 0° 06' 22"West parallel with the east
boundary of said Lot 12 a distance of 290.21 feet; thence South 89° 21'21" East parallel with said north
boundary a distance of 193.06 feet to a point in the centerline of the said vacated Dorman Avenue; thence South
0° 06' 22"West along said centerline a distance of 665.07 feet two a point on the easterly extension of the south
boundary of said Lot 10; thence North 89° 25' 33" West along said extension and said south boundary a
distance of 635.44 feet to the southwest corner of said Lot 10; thence North 0° 05' 34" east along the west
boundary of said Lots 10, 11 and 12 a distance of 956.06 feet to the TRUE POINT OF BEGINNING. This
parcel contains 12.66 acres,more or less,and is subject to all easements and rights-of-way of record or implied.
Section 3. That the above-described real property be, and the same is hereby annexed and made a part of the R-
1 zoning district of the City of Caldwell, Canyon County, Idaho, and the official zoning map is hereby amended
accordingly.
Section 4. That the City Engineer and the Community Development Director of the City of Caldwell,Idaho, are
hereby instructed to alter all use and area maps as well as the official zoning map and all official maps depicting
the boundaries of the City of Caldwell,Idaho,in accordance with this ordinance.

Section 5.All ordinances,resolutions, orders or parts thereof in conflict herewith are hereby repealed,rescinded
and annulled.
Section 6. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
Section 7. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this
ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman manner plainly and
clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the following
officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and
shall file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho,
all in compliance with Idaho Code 63-2219.
