ORDINANCE NO. 2328
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY
LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT
SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE
C-4 (INTERCHANGE OF FREEWAY COMMERCIAL) ZONE DISTRICT; AND DECLARING SAID
LAND BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE
CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES,
RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING
THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID
PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL,IDAHO; AND DIRECTING
THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE
AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND
THE IDAHO STATE TAX COMMISSION,PURSUANT TO IDAHO CODE, SECTION 63-2219.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council,upon recommendation of the Planning and Zoning Commission, and
following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No. 1451,
approved Case No. ANN-28-00 (Hampton Business Center)May 15, 2000.
Section 2. The site is located in the southeast corner of the intersection of State Highway 20/26 and Aviation
Way. The parcel is contiguous to the City of Caldwell, Idaho and the applicants have requested that said
following described land should be annexed to the City of Caldwell, Idaho as a C-4 zone:
A part of the West 1/2 of the NW '/4 and North 1/2 of the SW 1/4 of Section 25, Township 4 North, Range 3 West,
Boise Meridian, Caldwell, Canyon County, Idaho, more particularly described as follows: Commencing at the
NW corner of said West 1/2 of the NW 1/4 (Section corner common to sections 23, 24, 25 and 26), said corner
monumented with a 3 inch diameter brass disk; Thence S. 0° 26' 51" W., a distance of 50.00 feet along the
westerly boundary of said West 1/2 of the NW 1/4 to a point on the southerly right of way of state highways 20 and
26, said point being the POINT OF BEGINNING; Thence N. 89°49' 29" E., a distance of 1328.80 feet parallel
with the northerly boundary of said West'/2 of the NW '/4 and along said southerly right of way to a point on the
easterly boundary of said West '/2 of the NW '/a, said point monumented with a 5/8 inch diameter iron pin;
Thence S 0°34' 02"W., a distance of 2595.56 feet along the easterly boundary of said West 1/2 of the NW 1/4 to a
point on the northerly boundary of Parks Orchard Tracts as on file in Book 3 of Plats at Page 19 in the Office of
the Recorder of Canyon County, Idaho, said point also being the SE corner of said West''/2 of the NW 1/4(Center
west 1/16 corner), said point monumented with a 5/8 inch diameter iron pin; Thence N. 89° 36' 27" E., a
distance of 1323.44 feet along the northerly boundary of said Parks Orchard Tracts and northerly boundary of
said North '/2 of the SW 'A to the NE corner of said North 1/2 of the SW 'A (Center 1/4 corner), said corner
monumented with a 5/8 inch diameter iron pin; Thence S. 0° 41' 17" W., a distance of 578.43 feet along the
easterly boundary of said Parks Orchard Tracts and easterly boundary of said North 1/2 of the SW 1/4 to a point on
the Old Caldwell Ditch as shown on said Parks Orchard Tracts, said point monumented with a 5/8 inch diameter
iron pin; Thence continuing along said Old Caldwell Ditch the following courses and distances; Thence S. 53°
19' 14" W., a distance of 100.25 feet to a 5/8 inch diameter iron pin; Thence S. 36° 07' 59" W., a distance of
471.49 feet to a 5/8 inch diameter iron pin; Thence S. 35° 55' 31"W., a distance of 382.59 feet to a point on the
southerly boundary of said Park Orchard Tracts and the southerly boundary of said North '/2 of the SW 1/4, said
point monumented with a 5/8 inch diameter iron pin; Thence leaving said Old Caldwell Ditch and along the
southerly boundary of said Parks Orchard Tracts and the southerly boundary of said North 1/2 of the SW 1/4, S.
89° 34' 28" W., a distance of 747.55 feet to the SW corner of Lot 13 of said Parks Orchard Tracts, said corner
also being the SW corner of NE 1/4 SW 1/4 of said Section 25 (Southwest 1/16 corner), said point witnessed N. 0°
36' 12" E., a distance of 10.00 feet with a 5/8 inch diameter iron pin; Thence N. 0° 36' 12" E., a distance of
687.72 feet along the westerly boundary of said Lot 13 and along the westerly boundary of said NE 1/4 SW 1/4 to
the SE corner of Lot 5 of said Parks Orchard Tracts, said corner monumented with a 5/8 inch diameter iron pin;
Thence S. 89° 35' 07" W., a distance of 766.21 feet along the southerly boundaries of Lots 5, 6 and a portion of
Lot 7 of said Parks Orchard Tracts to the centerline of an irrigation canal; Thence along the centerline of said
irrigation canal the following courses and distances: Thence N. 23° 33' 47" E., a distance of 72.60 feet to a
point; Thence N. 36° 59' 47" E., a distance of 197.48 feet to a point; Thence N. 25° 33' 12" E., a distance of
43.74 feet to a point; Thence N. 16° 36' 10" E., a distance of 45.07 feet to a point; Thence N. 0° 57' 53" E., a
distance of 43.05 feet to a point; Thence N. 23°07' 01"W.,a distance of 7275 feet to a point; Thence N. 31°07'
57" W., a distance of 81.11 feet to a point; Thence N. 31° 45' 43" W., a distance of 178.47 feet to a point;
Thence N. 41° 26' 06" W., a distance of 126.17 feet to a point; Thence N. 71° 24' 09"W., a distance of 180.93
feet to a point; Thence N. 60° 52' 09" W., a distance of 170.00 feet to a point; Thence N. 64° 55' 49" W., a
distance of 177.15 feet to a point on the westerly boundary of said W '/z NW 1/4, said point witnessed S. 0° 25'
46" W., a distance of 19.02 feet with a 5/8 inch diameter iron pin; Thence leaving the centerline of said
irrigation ditch, N. 0° 26' 51" E., a distance of 2286.51 feet along the westerly boundary of said W %2 NW 1/4 to
the POINT OF BEGINNING. This parcel contains 121.569 acres more or less.
Section 3. That the City Engineer of the Community Development Director of the City of Caldwell, Idaho, are
hereby instructed to so designate the same above described property on the official zoning map and other area
maps of the City of Caldwell, Idaho as C-4 (Interchange of Freeway Commercial).
Section 4.All ordinances,resolutions, orders or parts thereof in conflict herewith are hereby repealed,rescinded
and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this
ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman-like manner plainly and
clearly designating the boundaries of the City of Caldwell, including the land herein annexed,with the following
officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and
shall file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho,
all in compliance with Idaho Code 63-2219.

more or less.The Ordinance includes a provision for a provision to amend the official zoning map of the City by
designating the above-described property as C-4, and it provides an effective date, which shall be when
published in the Idaho Press Tribune on the 22nd day of May, 2000. Ordinance No. 2328 was passed by the
Council and approved by the Mayor on the 15`h day of May, 2000. The full text of the Ordinance is available at Caldwell
City Hall, 621 Cleveland Boulevard, Caldwell, Idaho. The Mayor and City Council approved the foregoing summary for
publication pursuant to Idaho Code 50-901A on the 15th day of May,2000.
