ORDINANCE NO. 2312
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY
LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT
SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO,AS PART OF THE
M-1 (LIGHT INDUSTRIAL) ZONING DISTRICT; AND DECLARING SAID LAND BY PROPER
LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL,
CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR
PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND
COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS
OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF
CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO
BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX
COMMISSION,PURSUANT TO IDAHO CODE, SECTION 63-2219.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council,upon recommendation of the Planning and Zoning Commission,and
following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No. 1451,
approved Case No. ANN-23-99 (Ralph Smeed, Caldwell Unlimited, Caldwell Economic Development) on
December 20, 1999.
Section 2. That the following described land is approximately 105 acres. The northern portion of the 105 acres
is located south of Highway 20/26 and approximately 1300 feet east of Aviation Way. The parcel is contiguous
to the City of Caldwell, Idaho and the applicant has requested that said following described land should be
annexed to the City of Caldwell, Idaho as an M-1 zone:
A parcel of land located in Section 25, Township 4 North, Range 3 West, Boise Meridian, County of Canyon,
State of Idaho;being a portion of those certain tracts described in Instrument Numbers 478151 recorded October
14, 1959 and 503124 recorded June 7, 1961 in the Recorder's office, County of Canyon, State of Idaho; and
more particularly described as follows: Commencing at the North Quarter corner of said Section 25, thence
along the North-South Quarter line of said Section 25, South 0° 41' 20" West a distance of 50.01 feet to a point
on the South right-of-way line of U.S. Highway 20/26 and the POINT OF BEGINNING; Thence North 89° 24'
13" East along said South right-of-way line 40.01 feet to a point on a line 40.00 Easterly of, and parallel with,
the North-South Quarter line of said Section 25; Thence South 0° 41' 20" West along said parallel line a
distance of 50.90 feet to a point of curvature; Thence along a curve to the left a distance of 163.60 feet, said
curve having a radius of 1960.00 feet, a central angle of 4° 46' 57", and a long chord bearing South 1° 42' 09"
East a distance of 163.56 feet,to a point of tangency;Thence along said tangent South 4° 05' 37"East a distance
of 312.72 feet to a point of curvature; Thence along a curve to the right a distance of 170.28 feet, said curve
having a radius of 2040.00 feet, a central angle of 4° 46' 57", and a long chord bearing South 1° 42' 9" East a
distance of 170.24 feet to a point of tangency on a line 80.00 Easterly of, and parallel with the North-South
Quarter line of said Section 25; Thence along said parallel line South 0°41' 20"West a distance of 1894.09 feet
to a point on the East-West Quarter line of said Section 25;Thence along said East-West Quarter line North 89°
36' 14" East a distance f 1241.41 feet to a point on the East boundary of the Northwest Quarter of the Southeast
Quarter of said Section 25;Thence along said East boundary South 0°39' 01"West a distance of 1324.98 feet to
a point on the South boundary of said Northwest Quarter of the Southeast Quarter; Thence along said South
boundary South 89° 36' 29" West a distance of 1322.33 feet to the South Sixteenth corner of said Section 25;
Thence along the North-South Quarter line of said Section 25 North 0°41' 22"East a distance of 1324.90 feet to
the Center Quarter corner of Section 25; Thence along the East—West Quarter line of said Section 25 South 89°
36' 38" West a distance of 1323.42 feet to a point on the West boundary of the East Half of the Northwest
Quarter of said Section 25; Thence along said West boundary North 0° 34' 06"East a distance of 1984.25 feet to
a point on the North boundary of the South Half of the Northeast Quarter of the Northwest Quarter of said
Section 25; Thence along said North boundary North 89° 46' 23" East a distance of 1325.69 feet to a point on a
curve to the left; Thence along said curve to the left a distance of 78.65 feet, said curve having a radius of
1960.00 feet, a central angle of 2° 17' 57", and a long chord bearing North 2° 56' 39" West a distance of 78.64
feet,to a point of tangency; Thence along said tangent North 4° 05' 37"West a distance of 312.72 feet to a point
of curvature; Thence along a curve to the right a distance of 170.28 feet, said curve having a radius of 2040.00
feet, a central angle of 4°46' 57", and a long chord bearing North 1°42' 09" West a distance of 170.23 feet,to a
point of tangency on a line 40.00 feet westerly of and parallel with the North-South Quarter line of said Section
25; Thence along said parallel line North 0° 41' 20" East a distance of 49.41 feet to a point on the Southerly
right-of-way line of U.S. Highway 20/26; Thence along said right-of-way line North 89° 49' 37" East a distance
of 40.00 feet to the POINT OF BEGINNING.
Section 3. That the above-described real property be, and the same is hereby annexed and made a part of the M-
1 zoning district of the City of Caldwell, Canyon County, Idaho, and the official zoning map is hereby amended
accordingly.
Section 4. That the City Engineer and the Community Development Director of the City of Caldwell, Idaho, are
hereby instructed to alter all use and area maps as well as the official zoning map and all official maps depicting
the boundaries of the City of Caldwell, Idaho, in accordance with this ordinance.
Section 5. All ordinances,resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded
and annulled.
Section 6. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
Section 7. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this
ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman manner plainly and
clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the following
officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and
shall file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho,
all in compliance with Idaho Code 63-2219.

REGARDING ANNEXATION AND ZONE DESIGNATION
OF CERTAIN PROPERTY
This ordinance provides for annexation of certain property into the City of Caldwell as an M-1 (Light-Industrial)zone. Said
property is located north of Linden Avenue and south of Highway 20/26, approximately 1300 feet east of Aviation Way.
The annexed property is legally described as: A parcel of land located in Section 25, Township 4 North, Range 3 West,
Boise Meridian, County of Canyon, State of Idaho;being a portion of those certain tracts described in Instrument Numbers
478151 recorded October 14, 1959 and 503124 recorded June 7, 1961 in the Recorder's office,County of Canyon, State of
Idaho; and more particularly described as follows: Commencing at the North Quarter corner of said Section 25, thence

East a distance of 40.00 feet to the POINT OF BEGINNING.The Ordinance includes a provision for a provision to amend
the official zoning map of the City by designating the above-described property as M-1, and it provides an effective date,
which shall be when published in the Idaho Press Tribune on the 14thday of February,2000.
Ordinance No. 7312 was passed by the Council and approved by the Mayor on the 7th day of February, 2000.
