ORDINANCE NO. 2311
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY
LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT
SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE
M-1 (LIGHT INDUSTRIAL) ZONING DISTRICT; AND DECLARING SAID LAND BY PROPER
LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL,
CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR
PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND
COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS
OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF
CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO
BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX
COMMISSION,PURSUANT TO IDAHO CODE, SECTION 63-2219.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Planning and Zoning Commission, and
following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No. 1451,
approved Case No. ANN-22-99 (Alpha Houston, Caldwell Unlimited, Caldwell Economic Development) on
December 20, 1999.
Section 2. That the following described land is approximately four acres, and is located at the southeast
boundary of Parks Orchard Tracts and approximately 700 feet north of Linden Street. The parcel is contiguous
to the City of Caldwell, Idaho and the applicant has requested that said following described land should be
annexed to the City of Caldwell, Idaho as an M-1 zone:
A parcel of land located in the Southwest Quarter of the Southeast Quarter and the Southeast Quarter of the
Southwest Quarter of Section 25,Township 4 North,Range 3 West,Boise Meridian, County of Canyon, State of
Idaho; being a portion of that certain tract described in Instrument Number 9827974 recorded July 28, 1998 in
the Recorder's office, County of Canyon, State of Idaho; and more particularly described as follows:
Commencing at the South Sixteenth corner of said Section 25 and the POINT OF BEGINNING; Thence along
the North boundary of said Southwest Quarter of the Southeast Quarter, North 89° 36'29" East a distance of
80.01 feet to a point on a line 80 feet Westerly of and parallel with the West boundary of said Southwest Quarter
of the Southeast Quarter; Thence along said parallel line South 0° 41' 22" West a distance of 621.55 feet to a
point; Thence North 44° 16' 03"West(of record North 44° 54' 48"West) a distance of 113.22 feet to a point on
the West boundary of said Southwest Quarter of the Southeast Quarter; Thence continuing 44° 16' 03"West(of
record North 44° 54' 48" West) a distance of 748.53 feet to a point on the North boundary of the Southeast
Quarter of the Southwest Quarter of said Section 25; Thence along said North boundary North 89° 34' 54"East
(of record North 88° 56' 10"East) a distance of 528.99 feet to the POINT OF BEGINNING.
Section 3. That the above-described real property be, and the same is hereby annexed and made a part of the M-
1 zoning district of the City of Caldwell, Canyon County, Idaho, and the official zoning map is hereby amended
accordingly.
Section 4. That the City Engineer and the Community Development Director of the City of Caldwell, Idaho,are
hereby instructed to alter all use and area maps as well as the official zoning map and all official maps depicting
the boundaries of the City of Caldwell, Idaho, in accordance with this ordinance.
Section 5.All ordinances,resolutions, orders or parts thereof in conflict herewith are hereby repealed,rescinded
and annulled.
Section 6. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
Section 7. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this
ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman manner plainly and
clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the following
officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and
shall file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho,
all in compliance with Idaho Code 63-2219.

ORDINANCE NO. 2311
REGARDING ANNEXATIONAND ZONE DESIGNATION
OF CERTAIN PROPERTY
This ordinance provides for annexation of certain property into the City of Caldwell as an m-1 (Light-Industrial)
zone. Said property is located at the southeast boundary of Parks Orchard Tracts and approximately 700 feet

528.99 feet to the POINT OF BEGINNING. The Ordinance includes a provision for a provision to amend the
official zoning map of the City by designating the above-described property as M-1, and it provides an effective
date, which shall be when published in the Idaho Press Tribune on the 14th day of February, 2000.
Ordinance No. 2 31 t was passed by the Council and approved by the Mayor on the 7th day of February, 2000.
