BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council,upon recommendation of the Planning and Zoning Commission,and following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No. 1451, approved Case No. ANN-32-00 (Colonial Heights)on July 3,2000. Section 2. A portion of said property abuts the south side of Highway 20/26 and a portion abuts the east side of KCID Road.The parcel is contiguous to the City of Caldwell,Idaho and the applicants have requested that said following described land should be annexed to the City of Caldwell,Idaho as an R-1 zone: A portion of the NW V. of Section 30, Township 4 North, Range 2 West, Boise Meridian, Caldwell, Canyon County, Idaho, more particularly described as follows: Commencing at the NW corner of said NW '/4 (Section corner common to Sections 24, 19, 30 and 25) said corner monumented with a 3 inch diameter brass disk; Thence S. 0°37' 12"W., a distance of 627.88 feet along the westerly boundary of said NW '/4 to the POINT OF BEGINNING, said point monumented with a 5/8 inch diameter iron pin; Thence continuing S. 0° 37' 12"W., a distance of 2021.96 feet along the westerly boundary of said NW '/4 to the SW corner of said NW 1/4 (West '/4 corner) said corner monumented with a 3 inch diameter brass disk; Thence S. 89° 46' 45" E., a distance of 2605.79 feet along the southerly boundary of said NW '/4 to the SE corner of said NW '/4(Center 1/4 corner) said corner monumented with a 5/8 inch diameter iron pin; Thence N. 0°22' 27"E., a distance of 2602.51 feet along the easterly boundary of said NW 1/4 to a point on the southerly right of way of U.S.Highway 20-26 (Franklin Road); Thence N. 89° 50' 21" W., a distance of 1840.85 feet along the southerly right of way of said U.S. Highway 20-26 and parallel with the northerly boundary of said NW 1/4 to a point; Thence S. 0° 37' 12" W., a distance of 577.88 feet parallel with the westerly boundary of said NW V.to a point; Thence N. 89°50' 21"W., a distance of 753.79 feet parallel with the northerly boundary of said NW 1/4 to the POINT OF BEGINNING, containing 145.269 acres more or less. Section 3. That the City Engineer and the Community Development Director of the City of Caldwell,Idaho,are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell,Idaho as R-1 (Single-Family Residential). Section 4.All ordinances,resolutions, orders or parts thereof in conflict herewith are hereby repealed,rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. • Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman-like manner plainly and clearly designating the boundaries of the City of Caldwell,including the land herein annexed,with the following officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code 63-2219. The Ordinance includes a provision to amend the official zoning map and other area maps of the City by designating the above-described property as R-1, and it provides an effective date, which shall be when published in the Idaho Press Tribune on the 24th. day of July, 2000. Ordinance No. 2342 was passed by the Council and approved by the Mayor on the 17 day of July, 2000.
