P► BILL NO. 20 ORDINANCE NO. 2334 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL,IDAHO, AS PART OF THE R-1 (SINGLE-FAMILY RESIDENTIAL) ZONE DISTRICT; AND DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION,PURSUANT TO IDAHO CODE, SECTION 63-2219. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council,upon recommendation of the Planning and Zoning Commission,and following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No. 1451, approved Case No. ANN-29-00(Manchester Park Subdivision)on June 5, 2000. Section 2. Said parcel abuts the southern boundary of Manchester Park,Units 1 through 6 and lies between the east side of Marshall Avenue and the west side of a portion of Airport Avenue. The parcel is contiguous to the City of Caldwell, Idaho and the applicants have requested that said following described land should be annexed to the City of Caldwell, Idaho as an R-1 zone, legally described as follows: A part of the NE '/4 SW 1/4 Section 33, Township 4 North, Range 3 West, Boise Meridian, Canyon County, Idaho, more particularly described as follows: BEGINNING at the NE corner of said NE 1/4 SW 1/4(Center 1/4 corner), said corner monumented with a 3 inch diameter brass disk; Thence S. 0° 39' 32" W., a distance of 1194.59 feet along the easterly boundary of said NE % SW 1/4 to a point in the centerline of the Phyllis Canal; Thence along the centerline of said Phyllis Canal the following courses and distances: Thence N. 62°55' 00"W.,a distance of 33.13 feet to a point;Thence 270.64 feet along the arc of a 450.00 foot radius curve left with a central angle of 34° 27' 30" and tangents of 139.55 feet,the long chord of which bears N. 80°08' 45"W.,a distance of 266.58 feet to a point;Thence S. 82° 37' 30"W., a distance of 177.12 feet to a point; Thence S. 84°48' 38" W., a distance of 276.55 feet to a point; Thence S. 85° 20' 49"W., a distance of 75.00 feet to a point; Thence 157.80 feet along the arc of a 300.00 foot radius curve right with a central angle of 30° 08' 14" and tangents of 80.77 feet, the long chord of which bears N. 79° 35' 03" W., a distance of 155.99 feet to a point; Thence N. 64° 30' 54" W., a distance of 72.53 feet to a point; Thence 175.43 feet along the arc of a 250.00 foot radius curve left with a central angle of 40° 12' 16"and tangents of 91.50 feet, the long chord of which bears N. 84° 37' 02" W., a distance of 171.85 feet to a point; Thence S. 75° 16' 50" W., a distance of 119.95 feet to a point on the westerly boundary of said NE 1/4 SW 1/4; Thence N. 0°40' 34"E., a distance of 1152.60 feet along the westerly boundary of said NE 1/4 SW '/a to the NW corner of said NE 1/4 SW 1/4, (CE 1/16 corner), said corner monumented with a 5/8 inch diameter iron pin; Thence S. 89° 34' 13" E., a distance of 1324.13 feet along the northerly boundary of said NE 1/4 SW 1/4 to the POINT OF BEGINNING,containing 35.138 acres more or less. Section 3. That the City Engineer and the Community Development Director of the City of Caldwell,Idaho,are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell,Idaho as R-1 (Single-Family Residential). Section 4.All ordinances,resolutions, orders or parts thereof in conflict herewith are hereby repealed,rescinded and annulled. • Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman-like manner plainly and clearly designating the boundaries of the City of Caldwell, including the land herein annexed,with the following officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code 63-2219. The property is located adjacent to the southern boundary of Manchester Pak Subdivision, Units 1 through 5 and lies between the east side of Marshall Avenue and the west side of Airport Avenue, and is legally described as a part of the NE '/, SW '/ Section 33, Township 4 North, Range 3 West, Boise Meridian, Canyon County, Idaho,more particularly described as follows: BEGINNING at the NE corner of said NE V. The Ordinance includes a provision to amend the official maps of the City by designating the above-described property as R-lzone, and it provides an effective date, which shall be when published in the Idaho Press Tribune on the 26th day of June, 2000. Ordinance No. 2334 was passed by the Council and approved by the Mayor on the 19th day of June, 2000. The Mayor and City Council approved the foregoing summary for publication pursuant to Idaho Code 50-901A on the 19th day of June,2000.
