BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning Commission, and following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No. 1451, approved Case No. ANN-62-02 (Donald Mai) at a public hearing held March 4, 2002. Section 2. The property is located at the northwest corner of the intersection of Homedale Avenue and South Florida Avenue. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be annexed into the City of Caldwell as an R-1 (Single-Family Residential) zone: A parcel of land located in the SW1/4 of Section 2, T. 3 N., R. 3 W., B.M., Canyon County, Idaho, more particularly described as follows; BEGINNING at the northeast corner of said SW1/4 (C1/4 corner), said corner monumented with a 3-inch diameter brass disk; Thence S. 0°31'25" W., a distance of 2645.26 feet along the east boundary of said SW1/4, to the southeast corner of said SW1/4, (S1/4 corner), said corner monumented with a 5/8-inch diameter iron pin; Thence S. 89°42'14" W., a distance of 372.42 feet along the south boundary of said SW1/4 to a found P.K. nail and washer as shown on a Record of Survey for Don Mai, recorded as Instrument No. 9203535 in the Office of the Recorder of Canyon County, Idaho, reset said P.K. nail and washer with a 5/8-inch diameter iron pin; Thence leaving the south boundary of said SW1/4 and along a portion of the southerly boundary of said Record of Survey for Don Mai the following courses and distances: Thence N. 42°03'39" E., a distance of 33.81 feet to a found 1/2-inch diameter iron pin; Thence continuing N. 42°03'39" E., a distance of 73.64 feet to a found 1/2-inch diameter iron pin; Thence N. 28°17'32" W., a distance of 92.97 feet to a found 1/2-inch diameter iron pin; Thence S. 89°42'40" W., a distance of 664.89 feet to a found 1/2-inch diameter iron pin; Thence N. 38°26'47" W., a distance of 82.14 feet to a found 1/2-inch diameter iron pin; Thence S. 68°49'06" W., a distance of 187.62 feet to a point in the centerline of the Dixie Drain, from which a witness corner bears N. 68°49'06" E., a distance of 25.00 feet to a found 1/2-inch diameter iron pin; Thence leaving the southerly boundary of said Record of Survey for Don Mai and following the centerline of said Dixie Drain the following five (5) courses, Thence N. 20°26'06" W., a distance of 619.77 feet to a point; Thence N. 21°29'52" W., a distance of 437.91 feet to a point; Thence N. 18°44'07" W., a distance of 324.38 feet to a point; Thence N. 25°04'18" W., a distance of 1166.89 feet to a point; Thence N. 16°02'37" W., a distance of 140.00 feet to a point in the centerline of said Dixie Drain and the north boundary of said SW1/4; Thence N. 89°51'55" E., a distance of 2273.80 feet along the north boundary of said SW1/4 to the POINT OF BEGINNING. Section 3. That the City Engineer and the Community Development Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as an R-1 (Single- Family Residential) zone. Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman-like manner plainly and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the following officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code 63-2219. The Ordinance includes a provision to amend the official maps of the City by designating the above-described property as R-1 and providing an effective date, which shall be when published in the Idaho Press Tribune on the 25th day of March 2002. Ordinance No. 2411 was passed by the Council and approved by the Mayor on the 18th day of March 2002.
