ORDINANCE NO. 3301
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-1 (LOW DENSITY
RESIDENTIAL) ZONE; DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO;
DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID
PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND
DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE
ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO
AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63-215.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and
following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No.
1451, approved Case No. ANN -20-06 (BST DEV Annexation) at a public hearing held January 19, 2021.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as R-1 (Low Density
Residential):
Parcel of land being a portion of the SW'/< SE Y< of Section 19, Township 4 North, Range 2 West, Boise
Meridian, City of Caldwell, Canyon County Idaho, and more particularly described as follows:
COMMENCING at the SE corner of the SW '/< SE'/< (East 1/16th corner) of said Section 19; From which
the S'/< corner of said Section 19 bears, N89050'28"W, 1319.10 feet; thence N00°34'37"E, 50.00 feet along
the easterly boundary line of the SW '/< SE % to a point on the northerly right-of-way line of US Hwy 20/26,
the POINT OF BEGINNING; thence N89050'28"W, 350.04 feet along said northerly right-of-way line to the
SE corner of Woodgate Subdivision, Book 38 of Plats at Page 50, records of Canyon County, Idaho; thence
N20°39'45"W, 361.31 feet along the easterly boundary line of said Woodgate Subdivision; thence
continuing along said easterly boundary line, N08055'02"E, 645.00 feet to a point on the centerline of Mason
Creek; thence along said centerline of Mason Creek as follows: S13040'18"E, 140.36 feet; thence
Southeasterly 303.03 feet along the arc of a curve to the left having a central angle of 75045'04", a radius
of 229.20 feet, and a long chord which bears S51 °32'38"E, 281.43 feet; thence S89025'1 0"E, 130.68 feet
to a point on said easterly boundary line of the SW Y< SE'/<; thence leaving said centerline, S00034'37"W,
663.54 feet along said easterly boundary line to the POINT OF BEGINNING.@ Containing 7.23 acres,
more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are
hereby instructed to so designate the same above described property on the official zoning map and other
area maps of the City of Caldwell, Idaho as R-1 (Low Density Residential).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this
ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman -like manner plainly
and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the
following officials of the County of Canyon, State of Idaho, to -wit: the Recorder, Auditor, Treasurer and
Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of
the State of Idaho, all in compliance with Idaho Code 63-215.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO.3301
REGARDING ANNEXATION AND ZONE DESIGNATION
OF CERTAIN PROPERTY i
This ordinance provides for annexation of a parcel of land to be annexed into the City of Caldwell
as R-1 (Low Density Residential)zoning.
Parcel of land being a portion of the SW 1/4 SE 1/4 of Section 19,Township 4 North, Range 2 West,
Boise Meridian,City of Caldwell, Canyon County Idaho,and more particularly des i ribed as follows:
COMMENCING at the SE corner of the SW%SE 1/4 (East 1/16th corner)of said Section 19; From
which the S 1/4 corner of said Section 19 bears, N89°50'28"W, 1319.10 feet; thence N00°34'37"E,
50.00 feet along the easterly boundary line of the SW'/ SE'/ to a point on the northerly right-of-
way line of US Hwy 20/26, the POINT OF BEGINNING; thence N89°50'28°W, 350.04 feet along

easterly boundary line of the SW 'A SE ''A; thence leaving said centerline, S00°34'37"W, 663.54
feet along said easterly boundary line to the POINT OF BEGINNING.@ Containing 7.23 acres,
more or less.
The Ordii Bance Includes a provision to amend the official maps of the City by designating the above-
describe property as R-1 and providing an effective date, which shall be when;published in the
Idaho Press Tribune on the 26th day of January, 2021. Ordinance No. 3301 was passed by the
Council and approved by the Mayor on the 19th day of January 2021. The full text:of the Ordinance
