BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No. 1451, approved Case No. ANN -20-03 (BVA North Ranch Annexation) at a public hearing held October 23, 2020 and signed the Order of Decision November 2, 2020. Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be annexed into the City of Caldwell as C-3 (Service Commercial) and M-1 (Light Industrial): C-3 Zone: This parcel is situated in a portion of the SW '/< of Section 24, Township 4 North, Range 3 West of the Boise Meridian, Canyon County, Idaho and is more particularly described as follows: BEGINNING at the SE corner of the SW'/< (S Y< Corner) of Section 24; thence S89049'34"W, 1993.19 feet along the south boundary of said SW '/4, also known as U.S. Highway 20-26 to the SW corner of the E Y2 W Y2 SW Y< of said Section 24; thence N00032'50"E, 404.07 feet along the west boundary of said E Y2 W Yz SW %; thence N90000'00"E, 679.93 feet to a point on the proposed westerly right-of-way of a roadway as described by the City of Caldwell; thence N00°27'16"E, 306.40 feet along said proposed right-of-way; thence S89046'53"E, 1312.58 feet to a point on the east boundary of said SW %; thence S00027'32"W, 699.41 feet along said east boundary to the POINT OF BEGINNING. Containing 27.50 acres, more or less. M-1 Zone: This parcel is situated in a portion of the SW'/< of Section 24, Township 4 North, Range 3 West of the Boise Meridian, Canyon County, Idaho, more particularly described as follows: COMMENCING at the SE corner of the SW '/ (S Y< Corner) of Section 24; thence N00027'32"E, 699.41 feet along the east boundary of said SW % to the POINT OF BEGINNING; thence N89°46'53"W, 1312.58 feet to a point on the proposed west right-of-way of a roadway as described by the City of Caldwell; thence S00027'16"W, 306.40 feet along said proposed right-of-way; thence N90000'00"W, 679.93 feet to a point on the west boundary of the E''/2 W Y2 SW Y< which lies 404.07 feet north of the SW corner of said E % W Y2 SW Y<; thence N00032'50"E, 2237.81 feet along said west boundary to the NW corner of said E Y2 W Y4 SW %; thence N89°30'27"E, 663.05 feet along the north boundary of said E Y2 W % SW Y< to the NW corner of the W Yz E Yz SW %; thence S00°31'00"W, 99.00 feet along said west boundary; thence N89°30'32"E, 1326.32 feet parallel with the north boundary of the E % SW % to a point on the east boundary of said SW % which lies 99.00 feet south of the NE corner of said SW Y,; thence S00027'32"W, 1854.46 feet along said east boundary to the POINT OF BEGINNING. Containing 90.49 acres, more or less. (Total combined acreage is 117.99 acres, more or less.) Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as C-3 (Service Commercial) and M-1 (Light Industrial) Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman -like manner plainly and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the following officials of the County of Canyon, State of Idaho, to -wit: the Recorder, Auditor, Treasurer and Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code 63-215.
