Approve minutes of the June 9, 2020 regular meeting with one minor correction; page 3 should say, "Mr. Navarro said correct,they do want to create that area of concealment" -removing the "not" MOTION: Commissioner Zamora. SECOND: Commissioner Page. Passed: Unanimous roll call vote. New Business: 1. ACTION ITEM: Case Number AMD-20-02: Paul Navarro and the Canyon County Sheriffs Office requested and received approval for a special use permit and variance for construction to operate a temporary holding facility for up to 122 females within the T-N (Traditional Neighborhood) Zone. Also requested was a variance to allow a fence height of up to 12 feet. Both were approved by the Planning and Zoning Commission on August 14, 2018. The subject property is located at the southwest corner of Chicago Street and 12th Ave. in Caldwell, Idaho. At this time the applicant is requesting the following condition be removed from the Variance: Condition 12.6 The applicant shall use landscaping that conceals and screens to the greatest extent possible the razor wire fencing. Staff has requested this item be continued to the August 11, 2020 meeting. MOTION TO MOVE AMD-20-02 TO THE AUGUST 11,2020 MEETING: Commissioner Zamora. SECOND: Page. Passed: Unanimous roll call vote. ACTION ITEM: Case Number OA-20-02: A request by the City of Caldwell Planning and Zoning Department to make changes to Chapter 10, Article 02, Section 10-02-02 of the Caldwell City Code, making changes to certain uses in the land use schedule. Testimony: Mr.Jerome Mapp,Director, 621 Cleveland Blvd., Caldwell, Idaho,stated that our current ordinance, multi-family units are allowed in industrial zones without any formal review. We found this out earlier this year when a PUD came forward with a request for multi-family units on a residential lot. Right after that,they noticed there were a number of multi-family units being built in commercial zones. We are losing prime commercial area to residential. Not that they are opposed to it but rather we need a landscaping plan,we don't know what kind of materials are being placed on the structure,and is it compatible to the existing commercial around it.We felt,as a team,there were conflicts outright allowing the multi-family. Planning and Zoning suggests we amend our ordinance to require a special use permit for any 4-plex or above. We found in the R-3 zone for triplexes that they were being permitted as well. A lot of the developers were also trying to put more units on the site and had setbacks at a minimum but there was a lack of open space,and landscaping wasn't being provided. These uses are also being allowed in Industrial areas. Industrial uses generally have major truck traffic and/or assembly and manufacturing that sometimes can be an issue. We propose the attached land use schedule. Regarding manufacture home parks- current parks would be able to replace units,but no new manufactured home parks or PUD's would be allowed in an industrial zone. Commissioner Zamora asked for clarification on why a manufactured home was a special use permit in industrial if a manufactured home park was not allowed. Deb Root,Senior Planner,replied that we can't discriminate against someone living in a manufactured home,we would consider that the same as single family residential. Comp Plan Analysis: The Caldwell Planning and Zoning Commission accepts the Conclusions of Law components as listed. MOTION: Commissioner Zamora. SECOND: Commissioner Page. Passed: Unanimous voice vote. RECOMMENDATION FOR OA-20-02 (Ordinance Amendment) MOTION: Commissioner Zamora that Case Number OA-20-02 be approved with the modification: R-3 for 4, 5 and 6 family dwellings and multi-family dwellings go from permitted to special use permit and in regards to manufactured home parks and PUD (residential) those will go from a special use permit to not permitted. The amendment to the special use Page I 1 Planning and Zoning Minutes permit was approved and we missed the amendment to the Variance so we are back here for that request. Commissioner Hunsicker stated we discussed this at the last meeting but we neglected to include the language for the Variance as well. Mr. Mapp stated yes. Case Number CMP-20-04/ZON-20-05/SUB-20P-05: A request by Heartland Townhomes Property Management LLC and Trilogy Development, Inc., for comprehensive plan map amendments, rezones and approval of a preliminary plat for AeroSky Park Subdivision,a proposed commercial/industrial development of parcel R35305, (35.4 acres), located on the southeast corner of Hwy 20/26 and Aviation Road, Caldwell, Idaho. The City of Caldwell 2040 Comprehensive Plan designates the property as "Commercial and Services." A map amendment is proposed to allow for industrial zoning. The 35.4 acre subject property is currently zoned 'C-4' (Interchange/Freeway Commercial) and the applicant is proposing 12.6 acres of"C-3" (Service Commercial) and 24.82 acres of"M-1" (Light Industrial) zoned property.The proposed plat contains 6 commercial lots and 14 industrial lots. The subject property is located in the APO-1 Land Use Limitation Zone. Testimony: Ms. Debbie Root, Senior Planner, 621 Cleveland Blvd., Caldwell, Idaho,stated the applicant is requesting to continue this case to the September 15, 2020 meeting. Motion to move this case to September 15, 2020 meeting: Commissioner Zamora SECOND: Nelson Passed: Unanimous roll call vote. 3. Case Number OA-20-01: A request City of Caldwell Planning and Zoning to adopt an amended zoning map that supersedes and replaces the zoning map adopted by Caldwell City Council on March 18, 2019 (Ordinance No. 3195). The new map includes all rezones, Page 12 Planning and Zoning Minutes • annexations and de-annexations that occurred between January 1, 2019 and December 31, 2019. The zone boundary changes during this period were approved by City Council at respective public hearings held pursuant to the requirements of Idaho Code,Title 67, Chapter 65, Local Planning Act. Also requested is to adopt an amended City of Caldwell Comprehensive Plan Map that supersedes and replaces the comprehensive plan map adopted by Caldwell City Council on February 3,2020(Resolution 38-20). The new map includes all comprehensive plan map changes that occurred between January 1, 2019 and December 31, 2019. The comprehensive plan land use map changes during this period were approved by City Council at respective public hearings held pursuant to the requirements of Idaho Code, Title 67, Chapter 65, Local Planning Act. Case Number OA-20-03: A request by the Planning and Zoning Department amending Chapter 10, Article 12, Section 10-12-08 of the Caldwell City Code, Providing For Staff Level Design Review For Specified Design Elements. Testimony: Mr. Jerome Mapp, 621 Cleveland Blvd, Caldwell, Idaho stated the Planning Director has the task to prepare and present cases before the Design Review Commission. The Design Review Commission hears cases in the City core. The process has been that they review all land use applications; signs, canopies,landscaping issues, design of buildings no matter how small that may be. All those go through the Design Review Commission. The main design issues that usually come into effect is dealing with new structures. At this time, we don't have new structures. Staff does not have the authority to approve these cases. With staff level design review it gives the planning director the discretion to decide if it should go to commission or if it can just go to the director. Commissioner Zamora stated he just opened a business in the city center and wanted to know if this was a conflict of interest. Mr. Mapp stated no.
