HomeMy WebLinkAboutORD 3293BILL NO. 36 ORDINANCE NO. 3293 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 6, ARTICLE 23, SECTION 06-23-02 OF THE CALDWELL CITY CODE, EXCLUDING CERTAIN EVENTS FROM QUALIFYING FOR ANNUAL PRE - APPROVAL; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1. That Chapter 6, Article 23, Section 06-23-02 of the Caldwell City Code is hereby amended as follows: 06-23-02: PRE -APPROVED SPECIAL EVENT VENUES: (1) Avenue maybe approved on an annual basis for the hosting of events throughout the year if: A. The venue hosts a minimum of twelve (12) events per year at whieh a eatering ..e....,:.::. fequir-ed; B. The venue and host maintain good standing with all licensing and permitting; C. The venue applicant resubmits its preapproval application each year complying with section 06-23-01 of this article; and D. The venue applicant complies with all special event requirements under this Code, and any conditions set forth by City staff, each time it hosts an event. (2) A pre -approved event application must be submitted and approved as outlined in section 06-23-01 of this article. The applicant must fulfill all requirements and, additionally, must include a list of all expected and planned events for the current calendar year. Once the pre -approval application is approved by all necessary City departments, the venue applicant must submit to the City Clerk an event detail form confirming the details of each upcoming event not later than ten (10) days prior to the date of each event on the pre -approved event application. The venue applicant will not need to reapply for venue approval. (4) The pre -approval process contained in this section 06-23-02 shall not apply to events with an estimated attendance in excess of one thousand (1000) people. Such events shall require individual application and approval pursuant to Caldwell City Code 06-23-01. While a venue may choose to list such an event in a pre -approval application for administrative purposes the listing thereof shall not relieve the venue of the requirement to apply for an event permit specifically and individually for such an event. The City'srg anting of pre -approval of events listed in an application submitted pursuant to this section 06-23-02 shall never be deemed to be an approval of any event that is estimated to have an attendance in excess of one thousand (1000) people. Any event estimated to have an attendance of less than one thousand (1000) people at the time of submission of an application pursuant to this section 06-23-02, which estimate increases to over one thousand (1000) people after City approval of said application, but not less than thirty (30) days from the start of the event, shall be immediately deemed non -approved and shall require an event specific permit pursuant to Caldwell City Code 06-23-01. If said estimate increases to more than one thousand (1000) people within thirty (30) days of the start of the event, said event shall still be deemed approved, but the venue must notify the City Clerk of the new estimated attendance numbers. Section 2. This ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law. Section 3. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Section 4. All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed. PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this 8th day of September, 2020.
