ORDINANCE NO. 3271
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY
OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE
REZONED TO THE M1 (LIGHT INDUSTRIAL) ZONE; DETERMINING THAT SAID CHANGE IN ZONING
IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING
THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID PROPERTY ON
THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL ORDINANCES,
RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and
following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal
Code, approved Case No. ZON-20-02 (Taylor Rezone) at a public hearing held, September 8, 2020.
Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said
following described property should be rezoned to M1 (Light Industrial) zone:
A portion of Lot 5 and all of Lots 6 and 7, Block 1, Caldwell Commercial Park No. 3, Book 34 of Plats at
Page 4, records of Canyon County, Idaho, lying in the NE'/. of Section 26, Township 4 North, Range 3
West of the Boise Meridian, Canyon County, Idaho and being more particularly described as follows:
COMMENCING at the NE corner of Section 26; thence S00°00'00"E, 1160.99 feet along the east boundary
of the NE Y<; thence N90000'00"W, 30.00 feet to the NE corner of Lot 7, Block 1, the POINT OF
BEGINNING; thence S00100'00"E, 95.00 feet along the east boundary of Lots 7 and 6; thence northwesterly
31.42 feet along the arc of a curve to the left having a central angle of 90000'00", a radius of 20.00 feet and
a long chord which bears N45000'00"W, 28.28 feet; thence S90°00'00"W, 137.82 feet along the north
boundary of Lot 2, Block 1; thence S00°00'00"E, 317.36 feet along the east boundary of Lots 5 and 6;
thence S90000'00"W, 211.19 feet to a point on the west boundary of said subdivision; thence traversing
said subdivision boundary as follows: N29048'00"E, 165.23 feet; N14040'00"W, 257.37 feet; N90000'00"E,
352.06 feet to the POINT OF BEGINNING. Containing 1.76 acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are
hereby instructed to so designate the same above described property on the official zoning map and other
area maps of the City of Caldwell, Idaho as M1 (Light Industrial)
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 3271
REGARDING ZONE DESIGNATION
OF CERTAIN PROPERTY
This ordinance provides for the rezone of a parcel of land in the City of Caldwell as M1 (Light Industrial)
A portion of Lot 5 and all of Lots 6 and 7, Block 1, Caldwell Commercial Park No. 3, Book 34 of Plats at
Page 4, records of Canyon County, Idaho, lying in the NE '/< of Section 26, Township 4 North, Range 3
West of the Boise Meridian, Canyon County, Idaho and being more particularly described as follows:

The Ordinance includes a provision to amend the official maps of the City by designating the above-
described property as M1 and providing an effective date, which shall be when published in the Idaho Press
Tribune on the 15th day of September 2020. Ordinance No. 3271 was passed by the Council and approved
by the Mayor on the 8th day of September 2020. The full text of the Ordinance is available at Caldwell City
Hall, 411 Blaine Street, Caldwell, Idaho. The Mayor and City Council approved the foregoing summary for
publication pursuant to Idaho Code 50-901A on the 81h day of September 2020.
