HomeMy WebLinkAboutORD 3275BILL NO. 17 ORDINANCE NO. 3275 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE REZONED TO THE C-3 (SERVICE -COMMERICAL) ZONE; DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal Code, approved Case No. ZON-20-03 (Rennison Rezone) at a public hearing held, July 6, 2020. Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said following described property should be rezoned to C-3 (Service Commercial) zone: A parcel of land being a portion of the W Y2 SE Y4 SW '/4 and the E Y2 SW Y4 SW '/4 of Section 23, Township 4 North, Range 3 West, Boise Meridian, Canyon County, Idaho, more particularly described as follows: COMMENCING at the SW corner of said W Y2 SE Y. SW '/4, thence North 00°07'50" East, 64.92 feet along the west boundary of said W Y2 SE '/4 SW '/. to the POINT OF BEGINNING; thence continuing North 0°07'50" East, 267.42 feet along said west boundary of the W '/2 SE Y4 SW Y. to the SE corner of the N '/2 S Y2 SW '/4 SW '/4 of said Section 23; thence North 89'56'18" West, 147.80 feet along the South boundary of said N Y2 S Y2 SW Y4 SW Y4; thence North 00°07'50" East, 332.34 feet parallel with the East boundary of said SW Y4 SW '/4 of Section 23 to a point on the South boundary of the NE 1/4 of said SW '/4 SW '/4; thence North 89°56'16" West, 517.71 feet along said South boundary to the SW corner of said NE Y4 SW '/4 SW /4; thence North 00'12'54" East, 664.70 feet along the West boundary of said NE 1/4 SW Y4 SW Y4 to the NW corner of said NE Y4 SW '/4 SW '/4; thence South 89'56'13" East, 368.11 feet along the North boundary of said NE Y4 SW Y4 SW Y4; thence South 61 010'36" East, 774.76 feet; thence South 29°03'10" West, 23.12 feet to the centerline of the Notus Canal as it now exists; thence South 60°56'19" East, 334.94 feet along said centerline to a point on the East boundary of said W Y] SE Y4 SW '/4; thence South 00°01'46" West, 733.31 feet along said East boundary to the northerly right-of-way of Franklin Road; thence along said northerly right-of-way as follows: North 89°57'42" West, 34.00 feet; thence South 0°01'45" West, 15.00 feet; thence North 89°57'42" West, 551.27 feet; thence North 63059'40" West, 90.26 feet to the POINT OF BEGINNING. Containing 25.147 acres more or less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as C-3 (Service Commercial). Section 4. The Ordinance includes a provision to amend the official maps of the City by designating the above- described property as C-3 and providing an effective date, which shall be when published in the Idaho Press Tribune on the 14th day of July 2020. Ordinance No. 3275 was passed by the Council and approved by the Mayor on the 6th day of Month 2020.
