MINUTES
March 25, 2008
I. Call to Order – Hearing Examiner, Mr. Jerome Mapp, opened the meeting for the public hearing at 7:10 p.m.
II. Review of Proceedings – Mr. Jerome Mapp outlined the procedures for the public hearing.
Members Present: Brian Billingsley (Planning Director), Brent Orton (City Engineer) and April Cabello (Planning Technician).
Old Business
Mr. Mapp approved the minutes of the February 26, 2008 meeting.
New Business
Case Number SUB-170PF-08 / ZON-55-08 a request by 8080 Northview Partners LLC, Garden Properties LLC, and Bailey Engineering for a rezone of 3.48 acres from R-2 Medium Density Residential
to C-2 Community Commercial, and short plat approval for Kearney Business Condominiums consisting of 10 building units and one common lot. The site is located at the southeast corner
of Kearney Street and Centennial Way.
Testimony:
Brian Billingsley, Planning Director, presented the staff report and submitted exhibit PZ-1000, an aerial photo of the subject property. Mr. Billingsley stated that condition 12.3 should
be deleted.
Mr. Mapp, Hearing Examiner, stated he would like the following condition added: parking and cross access agreement.
Mr. Billingsley stated he would like the fencing changed along 8 parking spaces that will face the Assisted Living Facility from slats to a privacy fence.
Kent Brown, applicant’s representative, signed in favor of the application and provided supporting testimony and stated he has a problem with the cross access agreement.
Mr. Mapp explained to Mr. Brown the cross access agreement.
Mr. Brown stated he agreed with the new conditions.
Terry Hayden, applicant’s representative, signed in favor of the application and wished to speak but did not speak.
MR. MAPP CLOSED THE PUBLIC TESTIMONY.
Comprehensive Plan Analysis: Mr. Mapp accepted the comprehensive plan analysis as listed in section 5.1.
Findings of Fact on Rezone: The Hearing Examiner accepted the general facts as outlined in the staff report, public testimony, and the evidence list as a part of the Findings.
Conclusions of Law for Rezone: The Hearing Examiner accepted the Conclusions of Law as outlined in the staff report.
Comprehensive Plan Analysis: Mr. Mapp accepted the comprehensive plan analysis as listed in section 9.1.
Findings of Fact on Short Plat: The Hearing Examiner accepted the general facts as outlined in the staff report, public testimony, and the evidence list as a part of the Findings.
Conclusions of Law for Short Plat: The Hearing Examiner accepted the Conclusions of Law as outlined in the staff report.
Order of Decision: The Hearing Examiner recommended that Case Number SUB-170PF-08 / ZON-55-08 be approved with the following conditions:
12.2
Delete 12.3
12.4 -12.10
Add 12.11 – development shall acquire a cross access agreement to serve the owners of the condominiums to be approved by the Planning and Engineering departments
Add 12.12 – 6 foot privacy fence on the south east corner

The Hearing Examiner adjourned the meeting at approximately 7:30 p.m.
