HomeMy WebLinkAbout11-25-2008_HE CALDWELL HEARING EXAMINER MINUTES November 25, 2008 I.    Call to Order – Hearing Examiner, Mr. Jerome Mapp, opened the meeting for the public hearing at 7:00 p.m. Review of Proceedings – Mr. Jerome Mapp outlined the procedures for the public hearing. Members Present: Anne Marie Skinner (Senior Planner), Brian Billingsley (Planning Director), Brent Orton (City Engineer) and Savanna Davis (Administrative Secretary) Old Business Mr. Mapp approved the minutes of the October 28, 2008 meeting.  New Business Mr. Mapp stated that Case Number SUB-196P-08 had been continued to January, 27, 2008. Case Number SUP-322-08 a request by Boone Memorial Presbyterian Church for special use permit approval to increase the allowed square footage of a sign face from 12 square feet to 22 square feet in an R-1 Low Density Residential zone. The site is addressed as 406 South 14th Avenue. Testimony: Anne Marie Skinner, Senior Planner, presented the staff report and submitted an aerial map labeled as exhibit PZ-1000. Scott Hoover, applicant’s representative, signed in favor of the application and provided supporting testimony. Mr. Hoover expressed his concern for the fire department’s preference to have the site address on the bottom of the sign on both sides in 6-inch lettering. Matthew McCann signed in favor of the application and provided supporting testimony. Ken Scaggs signed in favor of the application but did not wish to speak. MR. MAPP CLOSED THE PUBLIC TESTIMONY. Comprehensive Plan Analysis: Mr. Mapp accepted the comprehensive plan analysis as listed. Findings of Fact for SUP-322-08:  The Hearing Examiner accepted the general facts as outlined in the staff report, public testimony, and the evidence list as presented. Conclusions of Law for SUP-322-08: The Hearing Examiner accepted the Conclusions of Law as outlined in the staff report. Order of Decision: The Hearing Examiner ordered that Case Number SUP-322-08 is approved with conditions as outlined in the staff report with the following addition to Condition 8.14: The sign to be installed shall replicate the rendition submitted with the special use permit application identified as Exhibit A-3 with the addition of the address and street name in 6” letters near the bottom of both sides of the sign, said address and street name to be in contrasting colors to the sign or as directed by the Caldwell Fire Department.  Case Number SUB-122E-05 a request by Cirrus Pointe LLC and Richard Tomlinson for a one-year time extension for Cirrus Pointe preliminary plat. This site is located on Indiana Avenue, north of Orchard Avenue and south of Karcher Road. Testimony: Anne Marie Skinner, Senior Planner, presented the staff report and submitted an aerial photo labeled as PZ-1000. Rich Tomlinson, applicant’s representative, signed in favor of the application and provided supporting testimony. Mike Bruett signed in opposition to the application and stated his concerns for the trash and construction debris that the wind blows over on to his property. Mr. Bruett also stated that there are some ditches that are not covered that he is concerned about. David and Debra Shultz signed in opposition to the application but did not wish to speak. Madline Paine signed in opposition to the application but did not wish to speak. MR. MAPP CLOSED THE PUBLIC TESTIMONY.
