HomeMy WebLinkAbout7-15-08_PZCALDWELL PLANNING AND ZONING COMMISSION MINUTES July 15, 2008 Call to Order – Commissioner Jakobson called the meeting to order for the public hearing at 7:00 p.m. Roll Call – Members Present: Vincent Sanchez, James Runsvold, Scott Wallace, Geoff OldenKamp, Michael Jakobson, Betty Tollman Disclosures: Geoff OldenKamp recused himself from case number ZON-57-08 because he owns property in the Willow Falls Subdivision. Members Absent: Gene Shaffer Staff Present: Anne Marie Skinner (Senior Planner), Brent Orton (City Engineer), Savanna Davis (Secretary). Review of Proceeding – Commissioner Jakobson announced the procedures for the public hearing.  Old Business Approve minutes of June 10, 2008. MOTION: Commissioner Runsvold SECOND: Commissioner Oldenkamp. Passed: Unanimous roll call vote. NEW BUSINESS Case Number SUB-191PF-08 a request by Shawnee Development and RMR Consulting for condominium/short plat approval of Faith Landing Condominiums consisting of 48 buildings with 4 units in each building for a total of 192 units. The site is located northeast of Cleveland Boulevard and west of Hoffman Lane. Testimony: Anne Marie Skinner, Senior Planner, presented the staff report and submitted exhibit PZ-1000. Matt Schultz, applicant’s representative, signed in favor of the application and provided supporting testimony and stated that Shawnee Development is working with ITD to have a traffic light installed on Cleveland Blvd. which is a requirement of both ITD and City of Caldwell Engineering Department. T.J. Biggers signed in opposition to the application and provided opposing testimony stating his concerns for traffic and having so many different owners to the property. Matt Schultz provided rebuttal regarding Mr. Biggers’ concerns. MOTION TO CLOSE TESTIMONY: Commissioner Runsvold SECOND: Commissioner OldenKamp Passed: Unanimous roll call vote. Comprehensive Plan Analysis SUB-191PF-08 – Accepted MOTION: Commissioner Runsvold SECOND: Commissioner Wallace Passed: Unanimous roll call vote. Findings of Fact on Case Number SUB-191PF-08 – Accepted MOTION: Commissioner Runsvold SECOND: Commissioner Tollman Passed: Unanimous roll call vote. Conclusions of Law on Case No. SUB-191PF-08 –The conclusions of law were read and accepted. MOTION: Commissioner Runsvold SECOND: Commissioner Tollman Passed: Unanimous roll call vote. Recommendation on Case No. SUB-191PF-08 - MOTION: Commissioner Runsvold SECOND: Commissioner Tollman Passed: Unanimous roll call vote with the exception of Commissioner Sanchez who voted against approval of the request. Case Number ZON-57-08 a request by J&S Rentals, Willow Falls Development LLC, and Architecture Northwest for a rezone of 0.70 acres from C-1 Neighborhood Commercial to C-2 Community Commercial. The site is Lot 19, Block 1 of Willow Falls Subdivision and is addressed as 2721 S. 10th Avenue. Testimony: Anne Marie Skinner, Senior Planner, presented the staff report and exhibit PZ-1000, an aerial picture. Kieth Bradshaw, applicant, signed in favor of the application and provided supporting testimony. The commission conversed about some traffic concerns. Comprehensive Plan Analysis ZON-57-08 – Accepted MOTION: Commissioner Runsvold SECOND: Commissioner Sanchez Passed: Unanimous roll call vote. Findings of Fact on Case Number ZON-57-08 – Accepted MOTION: Commissioner Runsvold SECOND: Commissioner Wallace Passed: Unanimous roll call vote. Recommendation on Case No. ZON-57-08 - MOTION: Commissioner Runsvold SECOND: Commissioner Tollman Passed: Unanimous roll call vote with the exception of Commissioner Wallace who voted against approval of the request. Case Number ZON-58-08 a request by VVPI LLC, Craig Eisenberg and WH Pacific for approval of a rezone of 20.12 acres from M-1 Light Industrial to C-3 Service Commercial, a comprehensive plan map amendment from Industrial to Commercial, and a development agreement. The site is located on the west side of Smeed Parkway approximately 611 feet south of Highway 20/26. TESTIMONY: Anne Marie Skinner, Senior Planner, presented the staff report and submitted exhibit PZ-1000, an aerial picture. The Commission addressed concerns with Ms. Skinner regarding the zones and uses of surrounding properties. Laila Maqbool, applicant’s representative, signed in favor of the application and provided supporting testimony. Comprehensive Plan Analysis ZON-58-08 – Accepted MOTION: Commissioner OldenKamp SECOND: Commissioner Wallace Passed: Unanimous roll call vote. Findings of Fact on Case Number ZON-58-08 – Accepted MOTION: Commissioner Wallace SECOND: Commissioner OldenKamp Passed: Unanimous roll call vote. Conclusions of Law on Case No. ZON-58-08 –The conclusions of law were read and accepted. MOTION: Commissioner Tollman SECOND: Commissioner Wallace Passed: Unanimous roll call vote. Recommendation on Case No. ZON-58-08 - MOTION: Commissioner Sanchez SECOND: Commissioner Runsvold Passed: Unanimous roll call vote. Case Number OA-103-08 a request by Caldwell’s Planning and Zoning Director for an ordinance amendment to create a new section 10-02-07 concerning fencing regulations and to amend section 10-02-06 concerning the sign schedule. Testimony: Anne Marie Skinner, Senior Planner, presented the staff report and identified the amendments. The Commission then conversed with Ms. Skinner regarding the types of signs that are prohibited or exempt from the ordinance. Comprehensive Plan Analysis OA-103-08 – Accepted MOTION: Commissioner Runsvold SECOND: Commissioner OldenKamp Passed: Unanimous roll call vote. Recommendation on Case No. OA-103-08 - MOTION: Commissioner Runsvold SECOND: Commissioner Wallace Passed: Unanimous roll call vote. Case Number OA-102-08 a request by Caldwell’s Planning and Zoning Director for an ordinance amendment to amend section 10-02-13 concerning temporary uses by adding transient merchants. Testimony: Anne Marie Skinner, Senior Planner, presented the staff report and pointed out the major differences between transient merchant licenses and temporary use licenses. Comprehensive Plan Analysis OA-102-08 – Accepted MOTION: Commissioner Runsvold SECOND: Commissioner OldenKamp Passed: Unanimous roll call vote. Recommendation on Case No. OA-102-08 - MOTION: Commissioner Runsvold SECOND: Commissioner Tollman Passed: Unanimous roll call vote.
