HomeMy WebLinkAbout5-13-08_PZCALDWELL PLANNING AND ZONING COMMISSION MINUTES May 13, 2008 Call to Order – Commissioner Jakobson called the meeting to order for the public hearing at 7:00 p.m. Roll Call – Members Present: Gene Shaffer, James Runsvold, Scott Wallace, Geoff OldenKamp, Michael Jakobson, Betty Tollman Disclosures: None Members Absent: None Staff Present: Brian Billingsley (Planning Director), Anne Marie Skinner (Senior Planner), Brent Orton (City Engineer), Savanna Davis (Secretary). Review of Proceeding – Commissioner Jakobson announced the procedures for the public hearing.  Old Business Approve minutes of April 8, 2008. MOTION: Commissioner Runsvold SECOND: Commissioner Oldenkamp. Passed: Unanimous roll call vote. Appoint Savanna Davis, Administrative Secretary, as the Clerk for the Planning and Zoning Commission. MOTION: Commissioner Runsvold SECOND: Commissioner Oldenkamp. Passed: Unanimous roll call vote. NEW BUSINESS Case Number SUB-190PF-08 a request by Charles Cornforth and Toothman-Orton Engineering for condominium/short plat approval of Chaparro Condos consisting of two existing residential units and one common lot. The site is located at 2920 S. 10th Avenue. Testimony: Anne Marie Skinner, Senior Planner, presented the staff report and submitted exhibit PZ-1000, an aerial photo of the site. Pat Colwell, applicant’s representative, signed in favor of the application and gave supporting testimony. Mr. Colwell stated that all necessary improvements required by the building department are complete, but there are some minor improvements that still need to be completed specifically a small portion of sidewalk along the 10th Avenue frontage. This will be completed or bonded prior to signing of the final plat. MOTION TO CLOSE TESTIMONY: Commissioner Runsvold SECOND: Commissioner Wallace Passed: Unanimous roll call vote. Comprehensive Plan Analysis SUB-190PF-08 – Accepted MOTION: Commissioner Runsvold SECOND: Commissioner Wallace Passed: Unanimous roll call vote. Findings of Fact on Case Number SUB-190PF-08 – Accepted MOTION: Commissioner Runsvold SECOND: Commissioner Wallace Passed: Unanimous roll call vote. Conclusions of Law on Case No. SUB-190PF-08 –The conclusions of law were read and accepted. Recommendation on Case No. SUB-190PF-08 - MOTION: Commissioner Runsvold SECOND: Commissioner Wallace Passed: Unanimous roll call vote. Old Business (Continued from April 8, 2008) Case Number OA-96-08 a request by Caldwell’s Planning and Zoning Director for an ordinance amendment to create a new section 10-02-04 concerning accessory buildings, structures, and uses and to amend section 10-02-07 concerning accessory uses. Testimony: Brian Billingsley, Planning Director, presented the staff report. He testified tht the regulations for secondary dwelling units have been deleted from the proposed ordinance amendment. Discussion was held amongst the Commission regarding “permanent” versus “temporary” accessory uses and it was determined that it would be best if the word “permanent” was deleted from Section 10-02-04(B) Discussion then ensued regarding the setback requirements to the ponds. The commission closed public testimony. Comprehensive Plan Analysis Case No. OA-96-08 – Accepted MOTION: Commissioner Shaffer SECOND: Commissioner Wallace . Passed: Unanimous roll call vote. Recommendation on Case No. OA-96-08 - MOTION: Commissioner Shaffer SECOND: Commissioner OldenKamp. The Commission voted to recommend Approval with the following modifications: 6.2 Change Section 10-02-04(B) that States: “Except as otherwise regulated herein, a permanent accessory…” to “Except as otherwise regulated herein, an accessory…’ which deletes the word “permanent”. Delete setback requirements for any ponds and/or water features. NEW BUSINESS Case Number OA-100-08 a request by Caldwell’s Planning and Zoning Director for an ordinance amendment to sections 10-03-07 regarding the planned unit development ordinance, 10-03-02 regarding duties of the Planning and Zoning director, and 10-03-03 regarding amendment reclassification. Testimony: Brian Billingsley, Planning & Zoning Director, presented the staff report. Comprehensive Plan Analysis OA-100-08 – Accepted MOTION: Commissioner Runsvold SECOND: Commissioner Wallace . Passed: Unanimous roll call vote. Recommendation on Case No. OA-100-08 - MOTION: Commissioner Runsvold SECOND: Commissioner Wallace. The Commission voted to recommend Approval. Case Number OA-101-08 a request by Caldwell’s Planning and Zoning Director for an ordinance amendment to sections 10-02-08 regarding nonconforming uses, 10-03-04 regarding special uses, 10-03-05 regarding variances, 10-02-01 regarding general regulations, 10-03-01 regarding duties of the commission and to create a new section 10-03-12 regarding neighborhood meetings. Anne Marie Skinner, Senior Planner, presented the staff report and explained the changes to the ordinance. The Commission addressed their concerns with Ms. Skinner. Comprehensive Plan Analysis OA-101-08 – Accepted MOTION: Commissioner Shaffer SECOND: Commissioner Wallace . Passed: Unanimous roll call vote. Recommendation on Case No. OA-101-08 - MOTION: Commissioner Wallace SECOND: Commissioner OldenKamp. The Commission voted to recommend Approval with the following modification: Under Section 10-02-08(3)(D)(3) regarding the length of time allowed for the absence of a farm animal the words “one day” shall be changed to “one month” for horses and other usual farm animals.
