HomeMy WebLinkAbout11-11-08_PZCALDWELL PLANNING AND ZONING COMMISSION MINUTES - revised November 11, 2008 Call to Order –Chairperson Jakobson called the meeting to order for the public hearing at 7:05 p.m. Roll Call – Members Present: Mike Jakobson, Gene Shaffer, Vincent Sanchez, Scott Wallace, Betty Tollman, Geoff Oldenkamp Disclosures: Geoff Oldenkamp recused himself from item B. on the agenda case number ANN-174-08. Members Absent: Jim Runsvold Staff Present: Anne Marie Skinner (Senior Planner), Brent Orton (City Engineer), Savanna Davis (Secretary), Brian Billingsley (Planning Director) Review of Proceeding –Chairperson Jakobson announced the procedures for the public hearing.  III. Old Business Approve minutes of September 9, 2008. MOTION: Commissioner Wallace SECOND: Commissioner Tollman. Passed: Unanimous roll call vote. (continued from September 9, 2008) Case Number SUP-316-08 a request by Dazi Auto LLC and Yesco Outdoor Media for a special use permit for a used automotive/equipment storage and sales yard and an off-premise sign/billboard in an M-1 Light Industrial zone. The site is addressed as 4022 E. Linden Street. Testimony: Anne Marie Skinner, Senior Planner, presented the staff report and submitted an aerial map of the subject site labeled as PZ-1000. Ms. Skinner then stated that the applicant for this case was not in attendance for the hearing. Ms. Skinner also stated that although she had tried on several occasions she was unable to contact the applicant. NEW BUSINESS Case Number SUP-321-08 a request Loren Short and MC Ventures LLC for special use permit approval for an off-premise/billboard sign in a C-2 Community Commercial zone. The site is located at the southeast corner of the intersection of Ustick Road and Montana Avenue. Testimony: Anne Marie Skinner, Senior Planner, presented the staff report and submitted an aerial map of the subject site labeled as PZ-1000. Loren Short, Applicant, signed in favor of the application and provided supporting testimony. Commissioner Sanchez expressed his concerns for another type of sign (i.e. political) replacing the proposed sign in the future if the special use permit is approved. Ms. Skinner stated that the only sign that would be allowed, should the special use permit be approved, would be the proposed sign. Case Number ANN-174-08 a request by Vision Charter School for annexation of 7.86 acres with an R-1 Low Density Residential zoning designation and a development agreement. The site is located on the west side of KCID Road approximately 130 feet north of Lasher Lane. Testimony: Brian Billingsley, Planning Director, presented the staff report and submitted an aerial map labeled as PZ-1000. Laura Knothe, Applicant’s representative, signed in favor of the application and provided supporting testimony. Commissioner Sanchez asked Ms. Knothe if there is a time frame for opening the new school. Ms. Knothe stated that their goal would be to start design of the school right away, start construction next summer and be able to occupy the building in the fall of 2010. Recommendation on Case No. ANN-174-08 - MOTION: Commissioner Wallace SECOND: Commissioner Sanchez. The Commission voted unanimously to recommend Approval.  Case Number ZON-63-08/SUP-320-08 a request by Tom Needham for a rezone of 0.36 acres form R-2 Medium Density Residential to C-3 Service Commercial, a development agreement and a special use permit approval for an automobile/vehicle storage yard. The site is addressed as 109 W. Freeport. Testimony: Anne Marie Skinner, Senior Planner, presented the staff report and submitted an aerial map of the subject site labeled as PZ-1000. Tom Needham, applicant, signed in favor of the application and provided supporting testimony. The Commission voted unanimously to Approve with following conditions: 12.16 privacy slats to be added to the existing fence. Case Number OA-108-08 a request by Caldwell’s Planning and Zoning Department for an ordinance amendment to Section 10-12 regarding City Center Zoning District. Testimony: Anne Marie Skinner, Senior Planner, presented the staff report and explained the requested changes to the City Center zoning district ordinance. Commissioner Shaffer questioned the lack of descriptive for pre-cast concrete and suggested possibly adding “textured” to the pre-cast concrete requirement. The Commission voted unanimously to recommend Approval with the following condition: 6.2 The word “textured” shall be added prior to “pre-cast concrete” in Section 10-12-05(4)(A). V.
