MINUTES
April 8, 2008
Call to Order – Commissioner Jakobson called the meeting to order for the public hearing at 7:02 p.m.
Roll Call –
Members Present: Gene Shaffer, James Runsvold, Scott Wallace, Geoff OldenKamp, Michael Jakobson, Betty Tollman
Disclosures: None
Members Absent: None
Staff Present: Brian Billingsley (Planning Director), Anne Marie Skinner (Senior Planner), Brent Orton (City Engineer), Savanna Davis (Secretary).
Review of Proceeding – Commissioner Jakobson announced the procedures for the public hearing.
Old Business
Approve minutes of March 11, 2008. MOTION: Commissioner Runsvold SECOND: Commissioner Shaffer. Passed: Unanimous roll call vote.
(continued from 3-11-08) Case Number SUP-307-08 & VAR-34-08 a request by Caldwell School District, McKinstry and LKV Architects for a special use permit for a new elementary school.
The site is located at 2520 Washington Avenue. THIS REQUEST HAS BEEN OFFICIALLY WITHDRAWN AND WILL NOT BE HEARD.
NEW BUSINESS
Case Number ANN-171-08 & SUB/PUD-189P-08 a request by Niel Nielson and J-U-B Engineers for annexation of 12.00 acres with R-3 Multi-Family High Density Residential zoning and C-2 Community
Commercial zoning, a development agreement, and preliminary plat/planned unit development approval for Indian Dale Acres consisting of six buildable lots and five common lots. The site
is located at the northeast corner of Homedale Road and Indiana Avenue.
Testimony:
Anne Marie Skinner, Senior Planner, stated that this item is being tabled to a date unknown and will be re-noticed.
Case Number OA-97-08 a request by Caldwell’s Redevelopment Coordinator for an Ordinance Amendment to section 10-12, concerning the City Center Zoning District, of the Caldwell City Code.
Testimony:
Anne Marie Skinner presented the staff report, explained the modifications that were made to the City Center Ordinance, and stated all of the proposed changes on the record.
Commissioner Wallace expressed his concerns for the requirements for a professional to design the signs.
Commissioner Runsvold suggested that “or others capable of producing professional results” be added after the requirement of a professional for the design of signs.
Anne Marie stated that the temporary use and non-conforming portions of the ordinance has been stricken and the City Center zoning district will follow the same ordinances as the rest
of the city.
Dennis Cannon, applicant, signed in favor and provided supporting testimony.
Comprehensive Plan Analysis OA-97-08– MOTION: Commissioner Shaffer SECOND: Commissioner Wallace . Passed: Unanimous roll call vote.
Recommendation on Case No. OA-97-08- MOTION: Commissioner Runsvold SECOND: Commissioner OldenKamp. The Commission voted to recommend Approval with the following conditions:
Page 7, item 19, letter B. number 2 shall read “…or others capable of producing professional results.”
Page 13, item 4, letter e. should have a comma after “plastic”
Page 18, item 6, letter D. shall read “Steel, metal or tin roofs may be allowed provided they comply with the following city standards and examples. (staff shall provide examples).”
Case Number OA-96-08 a request by Caldwell’s Planning and Zoning Director for an Ordinance Amendment to create a new section 10-02-04 concerning accessory buildings, structures, and
uses and to delete section 10-02-07(2), 10-02-07(4), 10-02-07(5), 10-02-07(6), 10-02-07(7) of the Caldwell City Code, concerning accessory uses; amend Section 10-02-09 regarding Home
Occupations; create a new Section 10-02-14 concerning regulatory standards for new public schools; and create a new section 10-02-10 regarding child care facilities.
Testimony:
Brian Billingsley, Planning Director, presented the staff report for accessory uses and standards for public schools and listed the changes and additions to the ordinance.
Discussion took place amongst the commission members regarding secondary dwelling units and whether or not they should be part of the Accessory Use Ordinance.
Anne Marie Skinner, Senior Planner, presented the staff report for home occupation and daycare standards and listed the changes and addition to the ordinance.

Case Number OA-95-08 a request by Caldwell’s Planning and Zoning Director for an Ordinance Amendment to section 10-03-11, concerning zoning definitions, of the Caldwell City Code.
Brian Billingsley, Planning Director, presented the staff report.
