MINUTES
October 28, 2008
I. Call to Order – Hearing Examiner, Mr. Jerome Mapp, opened the meeting for the public hearing at 7:00 p.m.
Review of Proceedings – Mr. Jerome Mapp outlined the procedures for the public hearing.
Members Present: Anne Marie Skinner (Senior Planner), Brian Billingsley (Planning Director), Brent Orton (City Engineer) and Savanna Davis (Administrative Secretary)
Old Business
Mr. Mapp approved the minutes of the September 23, 2008 meeting.
New Business
Case Number SUB-109E-04 a request by H&C Development LLC and Toothman-Orton Engineering for a one-year time extension for Whitney Springs Subdivision. The site is located on the south
side of Ustick Road approximately 900 feet east of Middleton Road.
Testimony:
Anne Marie Skinner, Senior Planner, presented the staff report and
submitted an aerial map labeled as exhibit PZ-1000.
Pat Colwell, applicant’s representative, signed in favor of the application and provided supporting testimony.
MR. MAPP CLOSED THE PUBLIC TESTIMONY.
Findings of Fact for SUB-109E-04: The Hearing Examiner accepted the general facts as outlined in the staff report, public testimony, and the evidence list as presented.
Conclusions of Law for SUB-109E-04: The Hearing Examiner accepted the Conclusions of Law as outlined in the staff report.
Order of Decision: The Hearing Examiner ordered that Case Number SUB-109E-04 is approved with conditions as outlined in the staff report.
Additional Old Business
(continued from August 26, 2008) Case Number ZON-61-08 a request by C&MP Properties LLC and B&A Engineers for a rezone of 1.6 acres from R-1 Low Density Residential to R-3 High Density
Residential and a development agreement. The site is addressed as 106 S. Indiana Avenue and is located on the west side of Indiana Avenue and the south side of Hillcrest Lane if it
were extended.
Testimony:
1. Anne Marie Skinner, Senior Planner, presented the staff report and submitted an aerial photo labeled as PZ-1000, a letter of opposition from
Dorothy Worman labeled as PZ-1002 and a letter of opposition from Robert Wilson labeled as PZ-1003.
2. Dave Crawford, applicant’s representative, signed in favor of the application and provided supporting testimony. Mr. Crawford stated since this case was last heard the applicant has
decided to exclude the existing home on the property from the application to rezone. Mr. Crawford gave some history on the subject property.
3. Larre Robinson, signed in opposition to the application, submitted a packet of photos labeled as PZ-1001 and provided opposing testimony.
4. Dave Smith signed in opposition to the application but did not wish to speak.
MR. MAPP CLOSED THE PUBLIC TESTIMONY.
Comprehensive Plan Analysis: Mr. Mapp accepted the comprehensive plan analysis as listed.
Findings of Fact for ZON-61-08: The Hearing Examiner accepted the general facts as outlined in the staff report, public testimony, and the evidence list as presented.
Conclusions of Law for ZON-61-08: The Hearing Examiner accepted the Conclusions of Law as outlined in the staff report.
Recommendation: The Hearing Examiner recommended that Case Number ZON-61-08 be approved with conditions as outlined in the staff report.
Additional New Business
Case Number SUB-195P-08 a request by Steven Wood, Will Anderson and Treasure Valley Engineering for preliminary plat approval of Windy City Subdivision consisting of four building lots
and one common lot in an M-1 Light Industrial zone. The site is addressed as 2416 E. Chicago Street.
Testimony:
Anne Marie Skinner, Senior Planner, presented the staff report and submitted an aerial photo labeled as PZ-1000.
2. Alan Christy, applicant’s representative, signed in favor of the application providing supporting testimony.
3. Lance Warnick signed in favor of the application and provided supporting testimony.
MR. MAPP CLOSED THE PUBLIC TESTIMONY.
Comprehensive Plan Analysis: Mr. Mapp accepted the comprehensive plan analysis as listed.
Findings of Fact for SUB-195P-08: The Hearing Examiner accepted the general facts as outlined in the staff report, public testimony, and the evidence list as presented.
Conclusions of Law for SUB-195P-08: The Hearing Examiner accepted the Conclusions of Law as outlined in the staff report.
Recommendation: The Hearing Examiner recommended that Case Number SUB-195P-08 be approved with the conditions as outlined in the staff report.
