3) ACTION ITEM: Consider Bill No. 14 (Ordinance No. 3273) authorizing the
Mayor, pursuant to Idaho Code §§ 50-304 and 50-606, to implement by
appropriate order any measures, at his discretion and until 9:00 pm on April
20, 2020, that are recommended by public health agencies to prevent the
spread of COVID-19, with a request to waive the rules, pass on the first
reading, and approve the summary for publication.

SPECIAL EMERGEY MEETING

The Mayor (via phone) called the meeting to order at 3:00 p.m.
The Roll of the City Council was called by the City Clerk with the following members present: Pollard,
McGee (via phone), Allgood (via phone), Wagoner, Hopper (via phone), and Callsen.
(REASON FOR THE EMERGENCY MEETING)
The Mayor acknowledged Christine Wendelsdorf, Canyon County Emergency Management Coordinator
(via phone) and Nikki Zogg, Director, Southwest District Health (via phone).
The Mayor reported that the City of Caldwell has partnered with local health officials to receive updated
information regarding the COVID-19 virus. The City of Caldwell has been in compliance with the
protocols specified by the Centers for Disease Control (CDC) and Southwest District Health.
UPDATE REPORT ON COVID-19 PROTOCOLS AND MEASURES (CDC AND STATE OF
Idaho)
Nikki Zogg of Southwest District Health (SWDH) provided an up-to-date report regarding COVID-19
activity within Canyon County. She stated that there are currently six confirmed cases within Canyon
County and two additional cases pending investigation. Best practices for the prevention of the virus
include social distancing, staying home when you are sick and continue to use good hygiene methods.
In response to questions from Councilman Allgood, Ms. Zogg reported that SWDH and City leadership
would work jointly to implement a legal order for the closure of businesses and restaurants only as a
necessary option to help prevent the spread of the virus. The health district issued the legal order within
Blaine County due to the rapid spread ofCOVID-19.
Mayor Nancolas agreed that any legal action regarding a citywide quarantine order would be in
collaboration with Southwest District Health and Canyon County Emergency Management.
Councilman Allgood expressed concern regarding the closure of businesses and the economic fallout of '
such a decision.
Mayor Nancolas reported that some local restaurants have adjusted their daily operation plan to provide
curbside pickup and/or delivery service to customers.
Ms. Zogg emphasized that SWDH was concerned about closing down local businesses. There is a need to
support our local businesses through such a crisis.
Christine Wendelsdorf concurred with statements made by Nikki Zogg. She encouraged the public to
remain calm and support community businesses.

APPROPRIATE ORDER ANY MEASURES, AT HIS DISCRETION AND UNTIL 9:00 P.M. ON
APRIL 20, 2020, THAT ARE RECOMMENDED BY PUBLIC HEALTH AGENCIES TO
PREVENT THE SPREAD OF COVID-19, WITH A REQUEST TO WAIVE THE RULES, PASS
READING, AND APPROVE THE SUMMARY FOR PUBLICATION WITH THE REQUEST TO
WAIVE THE RULES, PASS ON THE FIRST READING, AND APPROVE THE SUMMARY FOR
PUBLICATION)
Mark Hilty, 1303 12th Avenue Road, Nampa outlined the contents of the ordinance. He noted that the
intent of the ordinance is to limit the spread of COVID-19 within the City of Caldwell. The ordinance
would provide the appropriate authority for the Mayor to carry out those recommendations by the issuance
of orders pursuant to Idaho Code. The orders and recommendations would be issued by the public health
agencies. City Council has the ultimate authority concerning the length of time for such authority with the
ability to approve necessary time extensions. Section three of the ordinance states that violations to the
order would be a misdemeanor.
Mr. Hilty reported that a minor change was made to Section 4 by adding the words that upon proclamation
of the Mayor and Council, the ordinance would be effective immediately. He also noted that the ordinance
must be posted in five public places within the City of Caldwell after approval.
Comments followed by Ms. Zogg and Mayor Nancolas regarding the City working closely with SWDH
and Canyon County in order to coordinate efforts for a safe community during the COVID-19 crisis.
Councilman McGee emphasized the importance of the health officials and municipality leadership working
together to combat the effects of the virus.
In response to questions from Councilman Callsen, Ms. Wendelsdorf reported that Canyon County
Emergency Management Team is not looking to close any businesses or restaurants at this time.

Councilman Wagoner expressed his confidence with the judgement of the local health officials and Idaho
State leadership concerning this issue and would value their recommendations for any needed action.
MOVED by Wagoner, SECONDED by Callsen to amend the agenda to indicate the correct date for
Ordinance No. 3273 to read until 9:00 p.m. on April 20, 2020.

ANY MEASURES, AT HIS DISCRETION AND UNTIL 9:00 P.M. ON APRIL 20, 2020, THAT ARE
RECOMMENDED BY PUBLIC HEALTH AGENCIES TO PREVENT THE SPREAD OF COVID-19;
PROVIDING FOR THE ORDINANCE TO BE IMMEDIATELY EFFECTIVE; PROVIDING FOR
SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDER AND PARTS
THEREOF, IN CONFLICT HEREWITH.
MOVED by Pollard, SECONDED by McGee to waive the three reading process and consider Bill No. 56
(Ordinance No. 3248) on its first reading by title only.

no: none. Absent and/or not voting: none.

MOVED by Pollard, SECONDED by Allgood to sponsor Bill No. 56 (Ordinance No. 3248), move for its
passage by title only, including the minor amendment to Section 4 to read that upon proclamation of the
Mayor and Council, the ordinance would be effective immediately, and approve the summary for
publication.
