NOTES:
1. ALL REAR LOT LINES AND LOT LINES COMMON TO A PUBLIC RIGHT-OF-WAY LINE HAVE A TEN FOOT (10')
WIDE PERMANENT PUBLIC UTILITIES, PROPERTY DRAINAGE AND IRRIGATION EASEMENT UNLESS OTHERWISE
SHOWN. SAID EASEMENT SHALL NOT PRECLUDE THE CONSTRUCTION OF HARD -SURFACED DRIVEWAYS AND
WALKWAYS TO EACH LOT. INTERIOR LOT LINES HAVE A FIVE FOOT (5') WIDE PERMANENT DRAINAGE
EASEMENT FOR THE PURPOSE OF STORING AND TRANSPORTING PROPERTY DRAINAGE.
2. ANY RESUBDIVISION OF THIS PLAT SHALL COMPLY WITH THE APPLICABLE REGULATIONS IN EFFECT AT THE
TIME OF RESUBDIVISION.
3. BUILDING SETBACKS AND DIMENSIONAL STANDARDS IN THIS SUBDIVISION SHALL BE IN COMPLIANCE WITH
THE APPLICABLE REGULATIONS OF THE CITY OF CALDWELL, IDAHO.
4. THE OWNER SHALL COMPLY WITH IDAHO CODE SECTION 31-3805; IRRIGATION WATER IS PROVIDED.
5. ALL LOTS IN THIS SUBDIVISION ARE SINGLE-FAMILY RESIDENTIAL LOTS, EXCEPT LOT 4, BLOCK 5, WHICH IS
DESIGNATED AS A COMMON AREA LOT TO BE OWNED AND MAINTAINED BY THE HOMEOWNERS ASSOCIATION.
THE COMMON AREA LOT HAS A BLANKET PUBLIC UTILITY, DRAINAGE, AND IRRIGATION EASEMENT.
6. MAINTENANCE OF ANY IRRIGATION OR DRAINAGE PIPE OR DITCH CROSSING A LOT IS THE RESPONSIBILITY
OF THE LOT OWNER UNLESS SUCH RESPONSIBILITY IS ASSUMED BY AN IRRIGATION/DRAINAGE DISTRICT OR
THE HOMEOWNER'S ASSOCIATION.
7. THIS DEVELOPMENT RECOGNIZES SECTION 22-4503 OF THE IDAHO CODE, RIGHT TO FARM ACT, WHICH
STATES: "NO AGRICULTURAL OPERATION OR AN APPURTENANCE TO IT SHALL BE OR BECOME A NUISANCE,
PRIVATE OR PUBLIC, BY ANY CHANGED CONDITIONS IN OR ABOUT THE SURROUNDING NONAGRICULTURAL
ACTIVITIES AFTER THE SAME HAS BEEN IN OPERATION FOR MORE THAN ONE (1) YEAR; WHEN THE
OPERATION WAS NOT A NUISANCE AT THE TIME THE OPERATION BEGAN; PROVIDED THAT THE PROVISIONS
OF THIS SECTION SHALL NOT APPLY WHENEVER A NUISANCE RESULTS FROM THE IMPROPER OR NEGLIGENT
OPERATION OF ANY AGRICULTURAL OPERATION OR APPURTENANCE TO IT."
8. THE BOTTOM ELEVATION OF STRUCTURAL FOOTINGS SHALL BE SET A MINIMUM OF 12 INCHES ABOVE THE
HIGHEST ESTABLISHED NORMAL GROUNDWATER ELEVATION.
9. A TEN FOOT (10') WIDE PRESSURE IRRIGATION EASEMENT IS RESERVED ON SELECT INTERIOR LOT LINES AS
SHOWN.
