BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CAL DWELL, COUNTY OF CANYON,STATE OF IDAHO: Section 1. That the Caldwell City Council,upon recommendation of the Planning and Zoning Commission, and following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No. 1451, approved Case No. ANN-33-00 (Crestline Development and Heartland Development) on July 3, 2000. Section 2. The site is Iocated at the southeast corner of the intersection of Highway 20/26 and KCID Road. The parcel is contiguous to the City of Caldwell, Idaho and the applicants have requested that said 'following described property should be annexed to the City of Caldwell as a C-2 zone. A portion of Government Lot 1 of Section 30, Township 4 North, Range 2 West, Boise Meridian, Caldwell, Canyon County, Idaho, more particularly described as follows: Commencing at the NW corner of said Government Lot 1 (Section corner common to Sections 24, 19, 30 and 25) said corner monumented with a 3 inch diameter brass disk; Thence South 0° 37' 12" W., a distance of 50.00 feet along the westerly boundary of said Government L6t 1 to the southerly right of way of U.S. Highway 20126 (Franklin Road) said point being the POINT OF BEGINNING; Thence continuing S. 0° 37' 12"W., a distance of 577.88 feet along the westerly boundary of said Government Lot 1 to a point; Thence S. 89' 50' 21" E., a distance of 753.79 feet parallel with the northerly boundary of said Government Lot 1 to a point; Thence N. 0° 37' 12" E., a distance of 577.88 feet parallel with the westerly boundary of said Government Lot 1 to a point on the southerly right of way of said U.S.Highway 20/26;Thence No. 89' 50' 21" W., a distance of 753.79 feet along the southerly right of way of said U.S. Highway 20/26 and parallel with the northerly boundary of said Government Lot 1 to the POINT OF BEGINNING, contianing 10.00 acres more or less. That the City Engineer and the Community Development Director of the City of Caldwell,Idaho,are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell,Idaho a C-21 (Community Commercial)zone. Section 4.All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman-like manner plainly and clearly designating the boundaries of the City of Caldwell,including the land herein annexed,with the following officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and i shall file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code 63-2219. The Ordinance includes a provision to amend the official zoning map and other area maps of the City by designating the above-described property as C- 2, and it provides an effective date, which shall be when published in the Idaho Press Tribune on the 24th day of July, 2000. Ordinance No. 2341 was passed by the Council and approved by the Mayor on the 17 day of July, 2000.
