HomeMy WebLinkAboutORD 3263Canyon County Recorder's Office Document Cover Sheet 2020-014806 RECORDED 03/18/2020 12:40 PM 1111111111111111111111111111111111111111 IN 11111 00506735202000148060030032 CHRIS YAMAMOTO CANYON COUNTY RECORDER Pgs=3 LBERG NO FEE ORDINANCE CITY OF CALDWELL Oro Ixg BILL NO.4 ORDINANCE NO. 3263 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 2, ARTICLE 1, SECTION 02-01-03 OF THE CALDWELL CITY CODE, ENTITLED "TERMS OF OFFICE;" ELIMINATING ANY REQUIREMENT FOR ELECTION BY A MAJORITY AND ESTABLISHING THAT CITY COUNCIL CANDIDATES WITH THE HIGHEST NUMBER OF VOTES IN EACH RACE SHALL BE DECLARED ELECTED; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1. That Chapter 2, Article 1, Section 02-01-03 of the Caldwell City Code is hereby amended as follows: 02-01-03: TERMS OF OFFICE The City Council does, by this action, find that the citizens of Caldwell would be best served by providing for the election of Council persons by designated Council seats pursuant to Idaho Code Section 50-707. The City shall have a City Council composed of six (6) members. During each general City election, three (3) of the six (6) members of the City Council shall stand for re- election for a four-year term of office. Each candidate for the City Council shall meet the residency requirements of the City as set out in Idaho Code. The City Clerk shall assign a number for each of the six (6) Council seats currently filled by existing Council persons. The assignment of each numbered Council seat shall be at random with the method of random selection to be determined by the City Clerk. Candidates for Council seats, as established by this Section, shall file for a designated Council seat in the manner prescribed by Idaho Code. Each Council person shall stand for election, after filing for candidacy as required by this article against other qualified candidates pursuant to and for the council seats as created by this section at the next general municipal election immediately prior to the termination of the council person's term of office. The candidate with the highest number of votes shall be declared elected. established by the 1dahe Code. Section 2. This ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law. , Section 3. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Section 4. All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed. PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this 16`h day of March, 2020.
