BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No. 1451, approved Case No. ANN -19-13 (Ceric Annexation) at a public hearing held December 2nd, 2019. Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be annexed into the City of Caldwell as M-1 (Light Industrial): A part of the NE '% NE '% , Section 26, Township 4 North, Range 3 West, Boise Meridian, and including a part of Lot 16 in City View Tracts according to the official plat on file in Book 1 of Plats at Page 9, Records of Canyon County, Idaho, more particularly described as follows: COMMENCING at the NE corner of said NE Y4 NE%; thence South 00000'00" East, 1325.41 feet along the East boundary of said NE Y4 NE '% to the SE corner of said NE i% NE %; thence South 89039'22" West, 338.51 feet along the South boundary of said NE '% NE%to a point on the East side of the Caldwell High Line Canal as described in Caldwell Commercial Park Subdivision according to the official plat on file in Book 26 of Plats at Page 19, Records of Canyon County, Idaho, said point being the POINT OF BEGINNING; thence continuing South 89039'22" West, 551.70 feet along said South boundary of the NE % NE '% to a point on the Easterly right-of-way boundary for Interstate 84; thence North 20057'43" West, 297.16 feet along said Easterly right-of-way boundary; thence North 811102'12" East, 543.77 feet to a point on the centerline of said Caldwell High Line Canal; thence along said centerline as follows: North 14059'35" West, 74.56 feet; thence North 34034'14" West, 319.91 feet; thence South 75049'25" West, 163.79 feet; thence leaving said centerline North 79016'25" West, 91.09 feet to a point on the southwesterly boundary of said Caldwell Commercial Park Subdivision; thence along said southwesterly boundary as follows: North 46022'15" East, 5.74 feet; thence South 87054'00" East, 103.00 feet; thence North 64028'00" East, 103.50 feet; thence South 78010'00" East, 87.90 feet; thence South 39035'00" East, 102.60 feet; thence South 30055'00" East, 194.00 feet; thence South 14040'00" East, 467.69 feet to the POINT OF BEGINNING. Parcel contains 4.62 acres, more or less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as M-1 (Light Industrial). Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman -like manner plainly and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the following officials of the County of Canyon, State of Idaho, to -wit: the Recorder, Auditor, Treasurer and Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code 63-215.
