Case Number SUP-19-18:A request by Victor Thompson for a special-use permit to expand an existing Mobile Home Park within the R-3 (High Density Residential) zoning district. The subject property is located at 2819 S. Georgia Avenue (Parcel # R0408100000) in Caldwell, Idaho. Jerome Mapp explained the process of creating and approving a Comprehensive Plan and Map and the amendments/additions in this request. Testimony: Jarom Wagoner, 621 Cleveland Blvd., Caldwell, ID 83605, Senior Planner, presented the staff report. Mr.Wagoner stated the applicant has requested to withdraw their application based on conditions from the Engineering Department. Staff believes they can come to an agreement and would like to continue this case to the October 8, 2019 meeting. MOTION: Commissioner Nelson. SECOND: Commissioner Page. Case Number SUP-19-19:A request by Brian Rallens and Mason&Associates for a special- use permit to construct a multi-family development within the H-D (Hospital District) zoning district. The subject property is located at the southeast corner of Logan Street and Sunset Avenue (Parcel # R0586100000 &R0585600000) in Caldwell, Idaho. Page 1 Planning and Zoning Minutes • Testimony: Jarom Wagoner, 621 Cleveland Blvd., Caldwell, ID 83605, Senior Planner, presented the staff report. Mr.Wagoner stated the applicant is special use permit approval to construct a multi-family development within the H-D (Hospital District) Zoning District. The applicant intends to construct a total of 76 housing units with a mix of 4, 8 and 12 unit buildings. This would be considered an infill parcel. Staff does have conditions regarding frontage improvements including curb,gutter and sidewalk and landscaping. Commissioner Hunsicker asked about the conditions and asked which one regarded the landscaping buffer. Also, did he say there will not be an exit on Kimball? Mr.Wagoner stated that is correct,the only access on Kimball will be for the single family home.All multi family will access Logan. Regarding the landscaping buffer, it is not detail specific, it is referred to in conditions in 8.3 and 8.4. Commissioner Vance asked where the play areas will be located in this complex. Mr.Wagoner stated that will be covered in the applicant's testimony but there will be 2 play areas. Mr. Brian Rallens, 902 N. 21st St., Boise, Idaho (applicant) stated he thanks the commission for their time. They did have a neighborhood meeting, about 12 people showed up.Their biggest concern was privacy and security. Based on the feedback they did add privacy fencing along the border. They also had comments regarding traffic. As Jarom mentioned there won't be an access on the Kimball for the development. They did reconfigure the parking and add additional spaces. Another concern was congruency with the neighborhood and does it fit. In looking what is around that area they do feel it is an ideal transition. Lastly, neighbors wanted to know what it would look like. They will have a mix of buildings. They are looking to provide a clean building with various textures with an upscale look. There is a shortage of housing in the Treasure Valley and they are trying to address that need. This fits with the 2040 Comprehensive Plan. His final request is a modification they want to ask for regarding Condition 8.6 asking for 2 tot lots. They did propose one tot lot and one community gathering area and would like that modification. Commissioner Keller asked for clarification regarding the amenities/tot lots. Mr. Rallens said there are two areas; one tot lot and one community gathering area. They want the community gathering area to replace the second tot lot. Mr.Wagoner stated they have received written testimony provided by Jim McMillan. Mr.William Mason, 924 3rd St S Nampa, Idaho (in favor) stated he is the Engineer for the project. They haven't stared yet but he is here in support and to answer any questions. Angie Cuella, 924 3rd St S., Nampa, Idaho signed in favor but chose not to speak. Mr. Doug Brinkman, 210 W Elm St. Caldwell, Idaho (opposed) stated it is his recommendation that the commission deny this request as written. The first issue is the city sewage system. The existing sewer line is where they have landscape border. The sewage lines that serve 9 people will now serve 60 units. It is not a wise decision to add that much additional flow to an existing, old line. Another area they have not addressed is the original surface creek on the Kimball side, it runs to a culvert over to Sunset. This has a habit of flooding. The culvert that drains that line does not Page 12 Planning and Zoning Minutes adequately dispose of that water. When they add the pavement there will be increase run off. There is a flooding issue that has not been addressed. He would also like to address the issue of traffic. The flow will be off of Sunset. There are current residents that don't give consideration to the speed limit. With the increase of traffic flow,you are looking at a potential problem. There should be a traffic analysis completed before this project continues. He enjoys looking out at the night sky and he is worried about lighting collusion. The second stories of these buildings will be looking down on his backyard. He recommends taking one story off of all the buildings. Jim McMillin, 1812 Sunset Ave., Caldwell, Idaho signed in opposition but chose not to speak. He submitted a letter for evidence. June Beverlin, 203 W. Elm St., Caldwell, Idaho signed on opposition but chose not to speak. Vicki Purcell, 114 W. Elm St., Caldwell, Idaho signed in opposition but chose not to speak. Sondra Faull and Carolyn Westcott, 202 W. Elm St.Caldwell, Idaho signed in opposition but chose not to speak. Rebuttal: Mr. Brian Rallens, 902 N 21st Boise, Idaho stated he would like to address a couple concerns. The current vacancy rate is less than 5%. If there wasn't a need they wouldn't be interested in the project. As for the building height,there are architectural standards that have to be met regarding lighting and buffers. Mr.William Mason,924 3rd St S, Nampa, Idaho wanted to comment on the sewer connection.They will be tying into the City system.They are not tying into a private system. Sewer systems actually work better when houses are added because of the extra fluid. Regarding the gravity drain line they plan to pipe that through. They are not adding water to that drain line. Regarding traffic concerns if the City deemed a stop sign was needed in that area that would not be an issue. Commissioner Hunsicker stated that knowing that area,with the 12 plexes, it's hard to imagine the elevation among the other buildings in that area. Mr. Mason stated they are putting the 12 plexes towards the commercial side.And they tried not to have a broad front of the building facing the residential side. Commissioner Hunsicker asked staff if we had a traffic study. Mr. MacDonald stated this project does not exceed the threshold that is required for a traffic study. Case Number ANN-19-09: A request by Steve Harmsen and Superior Signs to annex two parcels totaling 8.5 acres, more or less, with a C-3 (Service Commercial) zoning designation. The subject properties are located at the southeast corner of Aviation Way and Muller Drive (Parcel # R3527701100 & R3527701000) in Caldwell, Idaho. Testimony: Jarom Wagoner, 621 Cleveland Blvd.,Caldwell, ID 83605, Senior Planner, presented the staff report. Mr.Wagoner stated the applicant is requesting to annex two parcels totaling approximately 8.5 acres with a C-3 zoning designation. This is basically clean up as the parcel next to it was annexed about a month ago. Dana Vance, 121 21st Ave.,Caldwell, ID (Applicant) stated this is basically a continuation of the annexation they did a couple months ago.The whole purpose is to relocate the sign they originally planned to install. There are no future plans of development at this time.They would like to request a deferral agreement for 18 month/or until development for landscaping on Aviation and Muller Drive. And to reduce the landscape buffer to 20 feet like they did in the previous annexation. John Ingebretson, 3808 Departure Street,Caldwell, Idaho (neutral) stated his only question is do they have the rights to develop in the future if they want to. Case Number SUB-19P-05: A request by Paul Willingham and Kurt Smith for Preliminary Plat approval of Sweet Home Subdivision consisting of 2 acres,more or less,to be subdivided into 6 residential lots and 4 common lots. The subject property is located at the northwest corner of Kimball Avenue and Newport Drive (Parcel R3567701000) in Caldwell, Idaho. Testimony: Jarom Wagoner, 621 Cleveland Blvd.,Caldwell, ID 83605,Senior Planner, presented the staff report. Mr.Wagoner stated the applicant is requesting approval for a Preliminary Plat for Sweet Home Subdivision, consisting of 6 single-family residential lots and 4 common lots. It does meet all the code requirements for this zone. Staff finds this request to be compliant with the Comprehensive Plan. There are landscaping conditions. Paul Willingham, 15149 Vanita St.,Caldwell, Idaho (applicant) stated that he doesn't have a lot to add, it is a very simple project. He appreciates the commission's time and consideration. Commissioner Hunsicker asked what the average lot size is. Mr.Willingham said he believes it is around 12,000. Commissioner Hunsicker asked if they will all be developed by different builders. Mr. Willingham said he will sell the lots off to different builders,but there are only 6 lots so there won't be that many different builders.They will have an HOA with requirements. Mr. Rick Coffman, 3509 Malibu Place,Caldwell, Idaho (in favor) stated this development is dependent upon his allowing them access for a sewer line. He has no problems with this development and he has a contract from the owner. Everything he has asked of the applicant and the City has been done. Tandy Willingham, 15149 Vanita Ct., Caldwell, Idaho signed in favor but chose not to speak. Carol Cutler, 3514 Malibu Place,Caldwell, Idaho (neutral) stated that if this is just the preliminary plat will it go before anyone else since they are having a number of builders. Mr.Wagoner stated it will also be heard at the City Council meeting. Ms. Cutler asked if they would all face Kimball and where would access be. Page 15 Planning and Zoning Minutes Mr.Wagoner stated they don't have that information since this is a preliminary plat.They don't get into the size or aesthetics of the home. Richard Clark, 201 Newport Dr., Caldwell, Idaho, sign in neutral but chose not to speak. Fermena Montgomery, 205 Hilldrop St., Caldwell, Idaho signed in neutral but had her questions answered. Mr.Wagoner stated code does not require that, nothing in code states the developer has to install fencing. Case Number ANN-19-07: A request by Blake Wolf to annex 2.5 acres, more or less, with an R-3 (High Density Residential) zoning designation and annexation agreement. The subject property is located on the west side of 10th Avenue, approximately 250 feet south of Amber Road (Parcel # R3566400000) in Caldwell, Idaho. Testimony: Jarom Wagoner,621 Cleveland Blvd.,Caldwell, ID 83605, Senior Planner,presented the staff report. Mr.Wagoner stated the applicant is requesting to annex 2.5 acres with an R-3 zoning designation. The applicant plans to construct multi-family structures on the property.The Comprehensive Plan map does designate this area as high density residential. Blake Wolf,843 W. Horizon Way, Nampa, Idaho stated he provided a conceptual plan and that is the general the idea of what he intends on doing. If the annexation is approved he plans to put in Page 16 Planning and Zoning Minutes triplexes and 4 plexes. There will be a secondary shared right in/right out only. He plans to put in a residential style 4 plex. This product will fit in the conceptual plan. A couple concerns at the neighborhood meeting; one is gravity irrigation. He expressed that will all be taken care of,he will have an Engineer figure out how to get water around. Traffic is another concern and there will be two ways in. Utilities are all available. This fits a very high need in the valley. Commissioner Hunsicker asked why would it better to have different owners. Mr. Wolf said the ownership is a group,a group of 3 families so they will split it up. Mr. David McKay, 3709 S Kimball, Caldwell, Idaho (neutral) stated he had one question- at the end of the field to the left he has 1.5 acre. His concern is their access road comes up to his property, he would be landlocked if they build houses along the left hand side of that. Mr.Wagoner stated he should talk to the property owner. Commissioner Keller asked where access is to his property right now. Mr. McKay said Kimball,the driveway he has now is less than 40 ft wide so he couldn't put a road through there. Mr. MacDonald said there could be a private drive, depending on how many lots they proposed. Tom Blaisdell, 3611 S 10th Ave.,Caldwell, Idaho (opposition) owns the property at 3611 S 10th, it is a very busy intersection. There needs to be something done with this intersection. People will end up parking up and down Amber because there won't be enough parking. Dale Larsen, 128 Amber Street, Caldwell, Idaho signed in opposition but chose not to speak. Julie Larsen, 128 Amber Street,Caldwell, Idaho signed in opposition but chose not to speak. Teresa Draper, 3618 S. 10th Avenue, Caldwell, Idaho signed in opposition but chose not to speak. Lyn Draper,3618 S. 10th Avenue, Caldwell, Idaho (opposition) stated his concern has been addressed so far. His main concern is traffic. He would like to see 20 mph signs placed on Amber. Even though it's a right turn only on 10th, he thinks the majority of traffic will go off Amber and it will be horrendous. He would like to see posted speed limit signs and traffic monitoring. Dean and Judy Hawley, 312 Amber St., Caldwell, Idaho (opposition)stated he moved here 20 years ago. He is concerned with the traffic and noise and the irrigation ditch behind his house. Marty Gudmundson, 3806 Brian Ave, Caldwell, Idaho, (opposition) stated she just bought her house in April and already realized traffic going down Brian Avenue isn't from the subdivision. People race down this road. According to all her neighbors people cut through from 10th and Ustick. Also, since the Walmart was built traffic is horrendous. If there is a right turn only she would like to see a barrier in the middle of 10th. She uses flood irrigation and it is a private line so when something doesn't work they have to talk to their neighbors.At the neighborhood meeting Mr.Wolf said they would have to talk to the Engineering Dept. That makes her very nervous. Darrell Sibert,316 Amber St, Caldwell Idaho, (opposition) stated a subdivision this size needs to accommodate all the necessities for that property. It should never be a burden to the existing properties surrounding it. He figures a minimum of 80 cars and most won't go west. A left hand Page l 7 Planning and Zoning Minutes turn on 10th is pretty impossible. The conceptual plan didn't have any green space or an area for children to play. Flood irrigation will affect the area as well. Ryan McKinnon, 216 Kurt Lane, Caldwell, Idaho (opposition) stated this development will decrease his property value substantially. It all comes down to density and this is too much. He would like to formally complain that he was never informed than an area was zoned R-3 just last March. Commissioner Hunsicker asked about the area he is saying is zoned R-3. She stated that area was still agriculture,the comp plan designates it as R-3 but it is still in the county. The daycare was the only area that was rezoned. Mr.Wagoner stated the land directly to the East is in the County and the Comprehensive Plan Map designates that area as high density residential,which is just a future vision of the City rezonings. But it is in the County. Sarah Smith, 321 Amber St., Caldwell, Idaho signed in opposition but chose not to speak. Karen McKinnon, 216 Kurt Lane, Caldwell, Idaho signed in opposition but chose not to speak. Allen E Carter, 300 Amber St., Caldwell, Idaho signed in opposition but chose not to speak. Mr.Wolf(rebuttal) stated they will exceed the 1.8 parking per unit but they are confined by space. When they talked about the right in/right out a barrier will be placed on 10th to prevent traffic to turn the opposite direction. Irrigation was a big topic for the neighbors and that will be part of their design. It is their plan to divert it,they legally cannot deny anyone water. It will most likely be impossible to break ground in January, probably not until later in the spring. He apologizes to Mr. McKinnon on the zoning confusion. He didn't mean to mislead him he was speaking of what the comp plan showed in that area. Commissioner Vance asked if all the properties were fed by a private irrigation line that runs across this property. Will this be addressed later? Mr. MacDonald stated yes,when plans are submitted to the City the City reviews and tries to identify even private lines. Case Number ZON-19-02:A request by Vallivue School District to rezone 37.5 acres, more or less, from C-2 (Community Commercial) to R-1 (Low Density Residential). The subject property is located on the east side of Smeed Parkway, approximately 1,400 feet north of Hwy 20-26 in Caldwell, Idaho. Testimony: Jarom Wagoner, 621 Cleveland Blvd., Caldwell, ID 83605, Senior Planner, presented the staff report. Mr.Wagoner stated the applicant is requesting to rezone approximately 37.5 acres from C-2 (Community Commercial) to R-1 (Low Density Residential). The applicant plans to construct a middle school on the subject property. Commissioner Hunsicker asked for clarification of the location. Mr. Dion Zimmerman, 216 SW 5th Ave., Meridian, Idaho stated they hosted the neighborhood meeting and had a lot of folks.They are designing a Middle School.They received their traffic study today and it indicated a roundabout be done in Phase 1 instead of Phase 2. They look forward to working with the neighbors and plan to meet with them in the future regarding traffic and roadways. They are thinking of an internal roundabout. Mr. Lane Hall, 312 S KCID Road, Caldwell, Idaho signed in neutral but was not present. Keith Stephenhagen, 4422 Marblefront Rd.,Caldwell, Idaho signed in neutral but chose not to speak. Cindy Simpson, 4500 Marblefront Rd., Caldwell, Idaho signed in neutral but chose not to speak. Kirby Clendenon, Marblefront Road, Caldwell, Idaho stated he would like Mr. Zimmerman to address one thing. He doesn't mind the idea of a school. He suspects land would be cut off and more homes could be built. Mr. Zimmerman, (rebuttal) the answer is absolutely no. they need all the acreage for the school. They plan to put in a pedestrian pathway along Soloman drain. 1st phase is Middle school, 2nd phase is Elementary school.
