BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning Commission and following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal Code, approved Case No. ZON-19-03 (Hatch Rezone) at a public hearing held the 18' day of November, 2019. Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said following described property should be rezoned to R-2 (Medium Density Residential) zone: A parcel of land being a portion of the E Y2 NW '% NE % SW % of Section 28, T4N, R3W, BM, Caldwell, Canyon County, Idaho and more particularly described as follows: COMMENCING at the West % Corner of said Section 28; thence South 89051'30" East, 1783.95 feet along the East-West centerline of said Section 28, also being the centerline of West Logan Street to the POINT OF BEGINNING; thence continuing South 89051'30" East, 204.58 feet along said centerline of West Logan Street to the NE corner of said E''% NW '% NE % SW % of Section 28; thence South 00012'27" East, 661.51 feet along the East boundary of said E Yz NW '/4 NE % SW '% of Section 28 to a point on the North right-of- way line of West Elm Street; thence North 89052'54" West, 332.07 feet along said North right-of-way line to a point on the West boundary of said E '/ NW '/4 NE % SW %4 of Section 28; thence North 00017'41" West, 450.80 feet along said West boundary; thence South 89051'30" East, 114.69 feet along a line parallel with and Southerly of said North boundary of the E '% NW % NE % SW '/4 of Section 28; thence North 03027'13" East, 211.20 feet to the POINT OF BEGINNING. Contains 4.46 acres, more or less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as R-2 (Medium Density Residential). Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. The Ordinance includes a provision to amend the official maps of the City by designating the above- described property as R-2 and providing an effective date, which shall be when published in the Idaho Press Tribune on the 26th day of November 2019. Ordinance No. 3234 was passed by the Council and approved by the Mayor on the 181h day of November 2019. The Mayor and City Council approved the foregoing summary for publication pursuant to Idaho Code 50-901A on the 18th day of November 2019.
