Call to Order-Commissioner Vance called the meeting to order at 7:01 p.m.
Review of Proceedings-
Roll Call -

Old Business: Approve minutes of June 18, 2019, regular meeting as previously signed by
Chairman Doty-Pomoransky.
MOTION: Commissioner Page. SECOND: Commissioner Hunsicker. Passed: Unanimous roll call
vote.
New Business:
1. Case Number SUP-19-11: A request by Efren Solares Cruz for a special-use permit to place
a Manufactured Home on a parcel within the M-1 (Light Industrial) zoning district. The subject
property is located at 127 W. Belmont Street in Caldwell, Idaho.
Testimony:
Jarom Wagoner, 621 Cleveland Blvd., Caldwell, ID 83605, Senior Planner, presented the staff report.
Mr.Wagoner stated the applicant is requesting special use permit approval to locate a mobile home
onto their property.The mobile home is currently located in a storage space and the applicant
would prefer to utilize it on his property. There are existing dwellings on the property.
They are recommending a condition of approval that the applicant enter into a deferral agreement
for construction of frontage improvements.
Commissioner Vance asked about the size of the parcel and if it still falls within code with the
number of residences on the property already.

Mr. Wagoner replied that when a commercial/industrial property develops residentially it complies
with the R-3 residential code which does allow for multiple buildings on one parcel and up to 35
units per acre.
Mr. Efren Solares Cruz, 714 N. 9th Caldwell, ID, his daughter Abby will translate. He wants to move
the trailer home from where it is to his property. There is room on his property for it to be moved
there. The biggest reason to move it is so he won't have to pay to have it stored where it is.
Commission Hunsicker asked if this is a property he rents out.
Translator: Yes, he rents this out and lives at a separate property.

2. Case Number ANN-19-04:A request by Casey Gray and Linden Holdings LLC to annex 9.57
acres, more or less, with an M-1 (Light Industrial) zoning designation and annexation
agreement. The subject property is located on the west side of Interstate-84, approximately 1,500
feet south of Linden Road (Parcel# R3590100000) in Caldwell, Idaho.
Testimony:
Jarom Wagoner, 621 Cleveland Blvd., Caldwell, ID 83605, Senior Planner, presented the staff report.
Mr. Wagoner stated the applicant is requesting to annex 9.6 acres, more or less, with an M-1 zoning
designation.The applicant plans to install 2 off-premise signs (billboards) on the subject property.
He would like to add a condition that if this is approved that the applicant will file for a lot line
adjustment,within 30 days, to combine the 2 parcels.
Mr. Casey Gray, 619 E. Havasu Falls St. Meridian, Idaho thanked the commissioners and staff. He is
a real estate manager.The request tonight is for an annexation in to the City of Caldwell. This will
eliminate the land lock situation. They have a concern with condition 8.3 the landscape buffer. In
2017 they were granted a permit for another billboard and one of the conditions was similar,a
landscape buffer. It was determined by the Hearing Examiner,that as tenants,they would not be

required to have the landscape buffer. They would ask that it be approved with the same condition
that the owner do that when the area is developed.

Committee discussed the landscape buffer and a deferral. Staff recommends an 18-month deferral
or at the time of future development,whichever comes first.

RECOMMENDATION FOR ANN-19-04 (Annexation) MOTION: Commissioner Hunsicker that Case
Number ANN-19-04 be approved with the following conditions: 8.2-8.4 with the modification of 8.3
an 18-month deferral is granted for the landscaping or until adjacent properties develop, whichever
comes first. And, the addition 8.5 that the applicant must apply for a lot line adjustment within 30

approximately 672 square foot in size.
There is a minimum 1/4 mile separation requirement between billboards. There are some
conditions of approval. Staff does request a modification to condition 8.3 to match the one in the
annexation recommendation.
Mr. Casey Gray, 619 E. Havasu Falls St. Meridian, Idaho stated they started this project 2 years ago
with the intention of putting billboards all along the property but the spacing requirements
changed.
Commissioner Hunsicker asked if a neighborhood meeting was required.
Mr. Gray said yes, they had one.

Commissioner Vance asked what the distance is from the billboard to the residence.
Mr. Gray stated he doesn't have exact measurements but he believes it is 100 ft.
Commissioner Vance asked if they would be digital signs.
Mr. Gray said no.

Mr. Gray stated he wanted to clarify that as a company they are required to turn the lights off at
night.They are turned off at 11pm, they are not on all night. They are only 45 feet over all. The
residents will not be able to see the structure and it is not digital.

to amend portions of Chapter 10, the Zoning Ordinance, of City Code.
Mr. Doug Waterman stated this case will be continued to the August meeting.
Commissioner Hunsicker made a MOTION to continue this case at the August 13, 2019 meeting.

6. Case Number OA-19-04:A request by the City of Caldwell Planning and Zoning
Department to amend portions of Chapter 10, the Zoning Ordinance,of City Code. (Applicant has
requested that this item be continued to the Regularly Scheduled Planning and Zoning Commission
Meeting to be held on Tuesday,September 10,2019 at 7:00 p.m.)
